Staff recommends approval of the above titled Resolution.

Background
The City of Emeryville (City) is one of several cities in the San Francisco Bay Area that are subject to a Consent Decree (CD) with the United States Environmental Protection Agency to reduce the sanitary sewer overflows into San Francisco Bay. The CD requires the subject agencies to investigate their sewer systems, identify deficiencies, and make necessary repairs to reduce inflow and infiltration (I&I) pursuant to compliance with criteria and timelines established by the CD. The City utilizes the services of contractors to perform the work necessary to bring its sewer systems into compliance with the CD. Included in the City Sewer System are parcels and buildings that are owned by the City which are served by sewer laterals also owned by the City.

Pursuant to the provisions of the CD, the City is required to conduct and pass pressure verification tests on the sewer laterals that serve the parcels and properties that it owns by June 30, 2024. The City has completed pressure verification testing, and it must now repair laterals that have failed the test.

Discussion
The City approved a contract with Monarch Plumbing (Monarch) to provide pressure testing services and cost estimates to rehabilitate City-owned sewer laterals that failed that pressure test. Monarch has provided the City with cost estimates to rehabilitate the laterals and the total cost to complete the lateral rehabilitation is greater than the current capacity of the current contract. In addition, the total amount of required funding is greater than the amount of funding allocated to the CIP Project.

Fiscal Impact
This Project is titled Rehabilitation of City Sewer Laterals, CIP# FM-15, Project # 20650006. Additional money must be allocated from Fund 650 to the project to complete the work. The allocation request value tabulated below includes a 15% contingency.

$ 73,720.00
