All matters listed under CONSENT CALENDAR are considered to be routine and will all be enacted by one motion in the form listed below. There will be no separate discussion of these items unless good cause is shown prior to the time the Council votes on the motion to adopt. Persons who wish to speak on matters set for PUBLIC HEARINGS will be heard when the Presiding Officer calls for comments from those persons who are in support of or in opposition thereto. After persons have spoken, the Hearing is closed and brought back to Council level for discussion and action. There is no further comment permitted from the audience unless requested by the Council.

No animals shall be allowed at or brought in to a public meeting by any person except (i) as to members of the public or City staff utilizing the assistance of a service animal, which is defined as a guide dog, signal dog, or other animal individually trained to provide assistance to an individual with a disability; or (ii) as to police officers utilizing the assistance of a dog(s) in law enforcement duties.

DATE: February 17, 2026
TO: Mayor and City Council Members
FROM: LaTanya Bellow, City Manager
SUBMITTED BY: Chadrick Smalley, Community Development Director SUBJECT: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EMERYVILLE

AUTHORIZING THE CITY MANAGER TO EXECUTE THE FIRST

AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT

WITH PRESERVATION ARTS, INCREASING THE CONTRACT
AMOUNT BY $150,000 TO AN AS-AMENDED TOTAL CONTRACT
AMOUNT OF $163,652 AND EXTENDING THE CONTRACT TERM TO
JANUARY 30, 2029 FOR PUBLIC ART COLLECTION MAINTENANCE

SERVICES

RECOMMENDATION
Staff recommends that the City Council adopt the attached resolution authorizing the City Manager to execute the First Amendment to the Professional Services Agreement with Preservation Arts increasing the contract amount by $150,000 to an as-amended total contract amount of $163,652 and to extend the term to January 30, 2029.

BACKGROUND
The City sought professional services related to public art collection maintenance services through a Request for Qualifications (“RFQ”) circulated in February 2025. After evaluation of submittals received in response to the RFQ, Preservation Arts was determined to be the highest ranked respondent. On August 7 2025, the City entered into a Professional Services Contract with Preservation Arts in the amount of $13,362 to evaluate and rank the collection of artworks owned by the City (Attachment A), except for the Sign of the Times pieces on utility boxes and murals commissioned by the City. These excluded artworks have specific maintenance requirements that do not require the services of an outside consultant to manage. In December 2025, Preservation Arts provided the characterization of the collection and identified an estimated cost of $326,832 in deferred maintenance for all artworks, with an estimated $198,774 in maintenance work needed for the six top projects as follows:
• Pumpers & Sparky (two works) $37,000
• Neighborhood Convergence (eight sculptures) $66,000
• Look Closely (seven works) $15,000
• Peninsula Tell Tail (one sculpture) $36,000
• Shellmound Gateway (six columns) $26,000

City Council Meeting | February 17, 2026

Page 2 of 3 ends

• Reflections of Time (one installation) $18,000
Details on these artworks, including images, locations and specific maintenance needs, are included in the collection survey completed by Preservation Arts (Attachment B).

The six projects include over 25 separate pieces. Neighborhood Convergence is being restored by the artists originally commissioned for the work, including relocation necessitated by an adjacent transportation project. Preservation Arts did not include the costs of relocation in its estimate of maintenance costs but rather limited the scope of work to paint and repair. This work is currently expected to be contracted with the artist separately.

DISCUSSION
For the five remaining works prioritized for near-term restoration, staff proposes amending the contract with Preservation Arts to include a $150,000 budget over a three-year period.

The intent of the structure of the contract is to seek review by the Public Art Committee (PAC) of the annual maintenance priorities and allow Preservation Arts to respond as an on-call service provider for the maintenance of the City’s art collection.

On January 8, 2026, the PAC reviewed the top five remaining maintenance projects and recommended prioritizing Peninsula Tell Tail for the earliest restoration due to this artworks visibility, prior community comments regarding its condition, and deleterious effects of the marine environment. Further, the PAC indicated that the scope should be expanded for Peninsula Tell Tail to consider repairs of the electrical system and consideration of new materials to reduce future maintenance needs. Preservation Arts revised its initial estimate to address the PAC’s recommended additions to the scope of work to $84,000-$100,000.

The PAC would review remaining funds after the Peninsula Tell Tail project is completed to discuss the next work(s) to be prioritized.

FISCAL IMPACT
The Art in Public Places (AiPP) Fund (Fund 243) has an account for maintenance of the City’s public art collection (Account 77170) this account has a balance sufficient to fund the costs of the contract amendment ($150,000).

STAFF COMMUNICATION WITH THE PUBLIC
As mentioned above, staff communicated with the PAC on January 8, 2026, to determine maintenance priorities. In 2025, a member of the public indicated concern regarding deferred maintenance of Peninsula Tell Tail in public comment to the PAC. Staff reviews maintenance issues with the PAC monthly at the PAC’s regular meetings.

CONFLICT OF INTEREST
None.

Preservation Arts First Amendment
City Council Meeting | February 17, 2026

Page 3 of 3 ends

CONCLUSION
Staff recommends the City Council approve an amendment of the Professional Services Contract with Preservation Arts to provide three years of on-call public art maintenance services for $150,000. The maintenance of Peninsula Tell Tail will be the first maintenance project under the amended contract. This follows the initial work by Preservation Arts to complete an assessment of the collections’ condition, at a cost of $13,652, for a total proposed contract amount of $163,652. The contract amendment also extends the contract term to January 30, 2029.

The artwork is a composition of several granite boulders including a central water feature set upon a paving design. The water feature is made out of one large granite boulder that was cut in three sections. Each "strata” are a metaphor for past, present and future. The channels were carved with reliefs from abstracted handprints, creating a visual cascade with or without water.

The patterns of the handprints are made from adults to children’s sizes starting from the lowest section moving to the highest. As one sits on the sculptural benches, one can discover wave and shell patterns, reminding the visitor of the natural land and indigenous people who lived here for generations.

Fountain is not currently operating. Overall installtion is in reasonable sturctural condition, although individual elements have extensive surafce condition issues including surface grime; graffiti; large areas of works dept graffiti overpaint; spalling; staining; scratching from skateboards; adhesive labels and degrading anti-graffiti coatings. There are 3 half polished slabs 2 with tagging; and three rock ends around monolith one tag). 5 flat top rounds with tagging and overpaint on three. Skateboard transfer marks. Four flat top squares; minor spalling and transfer red marks.

Overall surface cleaning and reduction of staining;

January 23, 2026
Attn: Amber Evans, Economic Development & Housing Div., Community Dev. Dept., City of Emeryville Dear Amber,
Thank you for giving Preservation Arts the opportunity to provide an estimate for a comprehensive treatment of Anita Margrill-Peninsula Tell-Tail and Overlook. The sculpture has the following condition issues: the solar lighting system is non functional, the kinetic movement is not moving smoothly; the paint has chalked and blanched with areas of rust and ferrous corrosion beneath the paint; there is advanced corrosion of the steel bands to the seating requiring some areas of replacement, and other scattered areas of corrosion on the seats; small tags and adhesive stickers are apparent on the painted surfaces; one padlock is missing from the control box and the wiring is accessible to the public; there is a deteriorated band of silicon around the base of the main pole with organic material present; a bird nesting material is present on the upper surface and the bird deterrents are bent or missing.

The proposed work will include repair to the functionality of electrics and kinetic elements; welding and repair of degraded metal sections to the seating; rust removal, preparation of painted surfaces, and overall application of a high performance 4 coat industrial paint system color matched to the original; overall cleaning and improvement of the bird deterrants; project management and oversight of subcontractors; photography and documentation. A scaffold will be required for access, a fence and City permit, the costs of which are included. The estimated cost range is $84,406-$99,439. All work will be consistent with the ethics and guidelines of the American Institute of Conservation.

Preservation Arts will also provide labor and materials as needed on a per hour time and materials basis for other City of Emeryville public artworks.

RECOMMENDATION
Staff recommends that the City Council adopt the above-entitled Resolution.

BACKGROUND
The Civic Center Exterior Painting project was approved in the 2023-2028 Capital Improvement Program under CIP # FM -04 Project # 16650015 due to visible corrosion of exposed steel at the Civic Center. In addition, the paint on Town Hall had significantly faded and there was damaged stucco. In order to prevent further deterioration and incur additional costs, the project was initiated and completed.

This project entailed removal of corrosion, repair of exterior stucco, and painting the exterior surface of Town Hall as well as painting wooden windows. The work included repainting steel columns, steel girders, deck soffit, fascia assembly, and cleaning the metal panels and window mullions and glass of the New Civic Center building.

The scope of work for this project included painting the exterior of the new Civic Center building and Town Hall as well as all the wood windows at Town Hall. During performance of the work, the City issued change orders to add the following to the scope of work: removal and disposal of lead paint and lead-containing materials from the exterior wall surfaces of Old City Hall, as well as the
