MINUTES OF THE ENCINITAS CITY COUNCIL SPECIAL MEETING
SEPTEMBER 24, 2025, 4:00 P.M., 505 SOUTH VULCAN AVENUE, ENCINITAS, CA 92024
CALL TO ORDER/ROLL CALL
Mayor Ehlers called the meeting to order at 4:01 p.m.
Present: Mayor Bruce Ehlers, Deputy Mayor Joy Lyndes, Council Members Jim O’Hara (arrived at 4:05 p.m.), Luke Shaffer, and Marco San Antonio
Absent: None
Also present: City Manager Campbell, City Attorney Preziosi, Assistant City Manager Schwarm, Fire Chief Gordon, Assistant Director of Engineering Nutter, Special Counsel Michael Colantuno, City Clerk Hollywood, and Deputy City Clerk Weichers
There being a quorum present, the meeting was in order.

1. CLOSED SESSION: CONFERENCE WITH LEGAL COUNSEL, WHETHER TO
INITIATE LITIGATION
AUTHORITY: Government Code 54956.9(d)(4)
NUMBER OF POTENTIAL CASES: (1)
There were no public speakers.
The Mayor and City Council adjourned into Closed Session at 4:02 p.m.
REPORT FROM CLOSED SESSION
City Attorney Preziosi reported at the 6:00 p.m. regular City Council meeting that the City Council held a Closed Session at approximately 4:00 p.m. and recessed at approximately 5:50 p.m. to discuss one case listed on the Closed Session Agenda, and the City Council took the following action. The City Council voted to initiate litigation by the following vote:
motion of Council Member Shaffer, seconded by Council Member San Antonio, with four in favor (Shaffer, San Antonio, Ehlers, and O’Hara) and one Council Member voting against (Deputy Mayor Lyndes). The name and identify of the potential defendant will be revealed if and when the lawsuit is filed.
ADJOURNMENT
Mayor Ehlers adjourned the meeting at 5:46 p.m.
