REPORT FROM CLOSED SESSION

Mayor Ehlers reported that the City Council held a Closed Session at approximately 3:30 p.m. to consider two items. There was no reportable action for Item 1; and for Item 2 the City of Encinitas has filed a complaint for declaratory relief against WNGHHF Encinitas Apartments LP commonly known as the Clark Avenue Apartments, to clarify what the fire code requires of the Clark Avenue Project. There is a spirted debate in our community as to what the fire code requires for a 199-unit apartment building served by narrow streets, and we think it is best to ask the judge to clarify the law for the benefit of the community we serve, for the developer, and the City.

The complaint has now been filed, and the City has now reported out the action.
