DEPARTMENT
DIRECTOR:
Dan Nutter, PE
DEPARTMENT: Engineering CITY
MANAGER:
Jennifer Campbell
SUBJECT:
Amendment No. 2 to the Professional Services Agreement with Michael Baker International, Inc. for additional engineering support related to private land development review RECOMMENDED ACTION:
Authorize the City Manager or her designee, in coordination with the City Attorney, to execute Amendment No. 2 to the Agreement with Michael Baker International, Inc. in substantial form as Attachment 1, to add $150,000 of capacity for a new not-to-exceed amount of $300,000 over the duration of the Agreement for as-needed engineering services for review of private land development projects.
ENVIRONMENTAL CONSIDERATIONS:
The action being considered by the City Council is exempt from the California Environmental Quality Act (CEQA) because it is not a “project” under Section 15061(b)(3) of the CEQA Guidelines because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. The action is also exempt from CEQA under Section 15378(b)(5) of the CEQA Guidelines because it involves an organizational or administrative activity of government that will not result in direct or indirect physical change in the environment.
GENERAL PLAN/CITY COUNCIL FOCUS AREAS:
The recommended action aligns with the Land Use Element of the General Plan by protecting our natural resources and ensuring infrastructure and public facilities are adequately planned. This item also supports Council Goal 5.3.1 to provide timeliness, consistency and efficiency, in the permit review process and to streamline workflows and improve service delivery.
FISCAL CONSIDERATIONS:
The fiscal impact of $150,000 is included in the FY 2026-27 Engineering Department Operating Budget and no further funding is being recommended.
2026-08-12 Item #08F Page 1 of 49
BACKGROUND:
The Land Development Engineering Division of the Engineering Department provides construction and discretionary plan review services for private development and utility work throughout Encinitas. City staff lead the plan review process, and consultant support is used during periods when application volumes exceed staff capacity and/or require a level of review that City staff do not have the requisite expertise to perform proficiently. This combined approach helps maintain timely turnaround, consistency, and service quality for applicants.
On June 18, 2025, City Council approved an agreement with Michael Baker International, Inc (MBI) for as-needed engineering services for private land development projects with a not‑to‑exceed amount of $150,000. Amendment No. 1 to the agreement was executed on June 18, 2026, to extend the contract by one (1) year through June 30, 2027.
The original $150,000 not‑to‑exceed amount approved in June 2025 was anticipated to cover approximately one year of supplemental plan review support. As expected, that initial capacity was fully utilized due to consistently high development activity and elevated submittal volumes.
Due to the continued elevated activity in private development applications and plan review volume, additional consultant support is needed to maintain service levels. Increasing the agreement not-to-exceed by $150,000 will allow for the continuation of current service levels to meet the current plan review demands.
ANALYSIS:
During the past year, the Land Development Engineering Division reviewed more than 2,800 private development submittals to ensure compliance with federal, state, and local regulations.
Michael Baker International, Inc. has consistently provided reliable engineering review services and possesses the expertise needed to support specialized reviews and maintain turnaround times for a wide variety of private development applicants. The $150,000 increase in agreement capacity will ensure the division has adequate resources to meet the current and projected demand for development project review.
