City Council

MEETING
DATE:

August 26, 2026

PREPARED
BY:

Niki Chalfant,
Assistant Finance Director

DEPARTMENT
DIRECTOR:

Tom Gallup
DEPARTMENT: Finance CITY
MANAGER:

Jennifer Campbell
SUBJECT:

Public Hearing for Consideration of Adopting Resolutions Authorizing Adjustments to the Cost of Services Schedule for User Fees and the Schedule of Fully Burdened Hourly Rates for Services Provided.

RECOMMENDED ACTION:

Staff recommends that City Council take the following actions:

1. Hold a public hearing; and

2. Adopt Resolution 2026-69, titled “A Resolution of the City Council of the City of Encinitas, California, Amending the Cost of Services Schedule for User Fees” (Attachment 2) effective October 1, 2026.

3. Adopt Resolution 2026-70, titled “A Resolution of the City Council of the City of Encinitas, California, Amending the Schedule of Fully Burdened Hourly Rates for Services Provided” (Attachment 3) effective October 1, 2026.

ENVIRONMENTAL CONSIDERATIONS:

The action being considered by the City Council is exempt from the California Environmental Quality Act (CEQA) because it is not a “project” under Section 15061(b)(3) of the CEQA Guidelines because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. The action is also exempt from CEQA under Section 15378(b)(5) of the CEQA Guidelines because it involves an organizational or administrative activity of government that will not result in the direct or indirect physical change in the environment.

This item does not relate to the Climate Action Plan.

GENERAL PLAN/CITY COUNCIL FOCUS AREAS:

This agenda item is related to Focus Area 2: Effective and Reliable City Services, Infrastructure, and Communications of the City Council Work Plan.

FISCAL CONSIDERATIONS:

The fiscal impact of the recommended fees as proposed would generate an annualized increase of approximately $1.5 million or 39 percent above current revenue volumes, assuming similar activity levels.

The proposed fee schedule will bring the cost recovery for all current fees less than 50 percent cost recovery to 50 percent cost recovery, all current fees within 50 percent to 79 percent cost recovery to 80 percent cost recovery, and all current fees within 80 percent to 99 percent to 100 percent cost recovery. Per this policy strategy, the recommended cost recovery would increase from 43 percent to 60 percent for the user fees included in this study. For all user fees, an annual CPI adjustment and up to an additional five percent is recommended so long as the adjustment does not exceed the cost for providing the services.

These fees ensure reasonable cost recovery from specific users who benefit from a particular City service that is not considered a general public benefit.

BACKGROUND:

User Fees are charges for goods or services that provide a special benefit to individuals requesting specific services, with limited or no benefit to the general public as a whole. State law requires that the individual’s use of the service must be voluntary, and the fees must reasonably relate to the services provided and not exceed the reasonable costs by the City to provide such services. The City’s user fee program must comply with Proposition 218 and Proposition 26, Office of Management and Budget, as well as other applicable regulations.

The City conducted its first comprehensive review of user fees and cost recovery levels in 2005 with the last study completed in 2021. Similar to the study conducted in 2021, this study includes the Development Services Planning and Land Development Engineering, as well as Fire Prevention and Marine Safety fees. This study does not include Parks, Recreation and Cultural Arts (PRCA) Department. The last comprehensive study to include PRCA was processed in 2002, however adjustments for CPI increases have been performed in recent years on an annual basis.

PRCA will complete a separate study in Fiscal Year 2027 and bring updated recommendations for Parks, Recreation and Cultural Arts fees to City Council in May 2027.

This review included a full-cost analysis which considers direct costs, departmental overhead costs, cross-departmental costs, and indirect costs from central service departments that provide support to administering departments to represent the “fully burdened cost”. Support costs (i.e. indirect costs) are calculated and documented in the citywide Cost Allocation Plan, updated in July 2026. This Cost-of-Services for User Fees study calculates the reasonable costs of providing these services, the recommended cost recovery levels based on policy direction, and the amended proposed fees to be charged to users no sooner than 30 days after City Council adoption effective October 1, 2026.

The City has contracted with MGT consulting services to prepare the update for both the Comprehensive User Fee Study and the update to the 2026 Cost Allocation Plan. Using the Cost 2026-08-26 Item #12D Page 2 of 63
Allocation Plan as a foundation, MGT worked with the Development Services Planning and Land Development Engineering, and Fire Prevention and Marine Safety department to estimate direct labor hours, position type involved, annual volumes, and indirect costs for each user fee. The study evaluated existing fees, new fees, and the removal of fees that may be obsolete, combined, or replaced.

ANALYSIS:

Staff is recommending an adjustment to current fees, based on User Fee Study (Attachment 1).

The proposed Cost of Services Schedule for User Fees is attached to Resolution No. 2026-69 as “Exhibit A.” The proposed Fully Burdened Hourly Rate Schedule for Services Provided is attached to Resolution No. 2026-70 as “Exhibit B.” If adopted, the new fees will become effective on October 1, 2026.

Staff recommends City Council adopt Resolution 2026-69, titled “A Resolution of the City Council of the City of Encinitas, California, Amending the Cost of Services Schedule for User Fees” (Attachment 2), with an effective date of October 1, 2026, and annual CPI adjustments for the San Diego Region, as long as those adjustments do not exceed the cost for providing services.

Staff recommends City Council adopt Resolution 2026-70, titled “A Resolution of the City Council of the City of Encinitas, California, Amending the Schedule of Fully Burdened Hourly Rates for Services Provided” (Attachment 3) effective October 1, 2026.

Notice of this public hearing was given by publication in a newspaper of general circulation at least 10 days prior to the public hearing. The notice was posted in the Coast News once a week for two weeks on August 14 and 21 and available on the City of Encinitas website as of August 13, 2026.

The purpose of the User Fee Study is to identify the full cost of fee-related activities and determine the reasonable level of cost recovery. The study used current year salary levels, assessment of which positions support or administer each fee, estimated labor hours based on average staff time spent per fee, estimated managerial and cross-departmental support levels, as well as the most recent Cost Allocation Plan from July 2026 to determine indirect support costs for central services to determine the final fully burdened rate costs. The study is intended to show the full cost to deliver each fee service and provide a maximum ceiling for rate setting. However, lower recovery targets may be appropriate when broader public benefits, affordability, legal limits, administrative practicality, market conditions, or other policy considerations justify a subsidy.

The majority of current fee rates within the areas of study do not reflect the actual costs of services provided, instead the City uses General Fund revenue to subsidize these services. Cost recovery levels range from as low as 5% up to 100% or full cost recovery. Since user fees have limited or no benefit to the general public as a whole, the City of Encinitas should aim to recover as close to full cost recovery as possible. When subsidies are utilized for fees than benefit select individuals or users, it restricts the availability of General Fund tax revenue to provide other community-wide services that benefit the general public as a whole.

The Planning and Land Development Engineering fees were housed within Development Services Department during the development of this study. The Land Development Engineering Division was reorganized and transitioned back to the Engineering Department at the start of Fiscal Year 2027. The planning fees included 129 fees ranging from 50% to 100% cost recovery based on policy strategy. The estimated additional annual revenue from the proposed fee 2026-08-26 Item #12D Page 3 of 63
increases for planning fees is $495,283. The land development engineering fees included 63 fees ranging from 50% to 100% cost recovery based on policy strategy. The estimated additional annual revenue from the proposed fee increases for land development engineering fees is $791,020.

Fire Prevention and Marine Safety Department is also included as part of this User Fee Study.

The Fire Prevention fees included 29 fees ranging from 50% to 100% cost recovery based on policy strategy. The estimated additional annual revenue from the proposed fee increases for fire prevention fees is $173,726.

The total additional annual revenue from the proposed fee increases included in the cost-ofservices fee schedule based on policy strategy as described above is $1,460,028.

The Parks, Recreation and Cultural Arts (PRCA) Department is not included in this fee study. City Council last approved PRCA user fees on June 28, 2023, as recommended by the Parks and Recreation Commission via resolution 2023-59. PRCA user fees are increased annually by the prior year’s Annual Average Consumer Price Index for the San Diego Region on the first day of each July. Most recently, City Council approved Resolution 2026-44 on June 10, 2026, which included minor fee increases for outdoor facilities, special events, indoor facility use, and commercial use. Best practice is to study cost of service for user fees every three to five years.

PRCA fees will be studied later in Fiscal Year 2027 and will be presented to City Council in spring 2027. Due to market sensitivities, the consultant recommends evaluating PRCA fees from both a cost-of-service and peer comparison perspective.

CITY OF ENCINITAS | USER FEE STUDY | AUGUST 2026 PAGE 2 Executive Summary
Introduction
MGT is pleased to present the City of Encinitas with this final report of findings from the City's Comprehensive User Fee Study. The report summarizes the cost-of-service analysis, current cost recovery, and recommended fee levels for the participating areas of study.

What Is a User Fee?
A user fee is a charge imposed on a person or entity receiving a specific City service, regulatory review, permit, inspection, benefit, or privilege. Unlike a tax raised primarily for general revenue, a cost-based user fee is tied to the payor's use of or burden on the service and is limited by the reasonable cost of the governmental activity.

Proposition 26 (California Constitution, article XIII C) defines local taxes broadly but excludes specified cost-based charges, including charges for direct services, regulatory activities, and development conditions, when the amount and allocation bear a fair or reasonable relationship to the payor.

Proposition 218 (article XIII D) governs assessments and property-related fees; the Planning, Engineering, and Fire Prevention fees in this study are evaluated as service, regulatory, and development-related charges rather than charges imposed merely as an incident of property ownership. This study supports fee treatment by calculating service costs, allocating costs to the benefiting or burdening user, and capping recommendations at no more than 100% of estimated reasonable cost. Final adoption and legal compliance remain subject to City Attorney and City Council review.

The analysis was developed in collaboration with City management and staff using the FY26 fee model, current fee levels, FY25 annual activity volumes, staff time estimates, and fully burdened service costs. The FY26 model incorporates FY25 actual expenditure data used in the City's cost allocation plan, FY27 budgeted salaries and benefits, and the Fire worksheet uses FY25 actual activity data. The results provide an updated basis to show the full cost of service and allow for fee-setting decisions while recognizing that the City Council may adopt recovery levels below full cost when policy or market considerations warrant a subsidy.

Study Scope and Objectives
The study included only the following areas of study:
• Development Services - Planning
• Land Development - Engineering
• Fire Prevention
The primary objectives were to determine the reasonable cost of providing fee-related services, compare current fees with those costs, establish policy-based recovery targets, and estimate the annual revenue effect of the recommended fee levels. 2026-08-26 Item #12D Page 7 of 63
CITY OF ENCINITAS | USER FEE STUDY | AUGUST 2026 PAGE 3 Study Findings
Across the three areas of study, the study evaluated $8,665,411 in annual user-fee service cost. Current fees are estimated to generate $3,769,036, equal to 43% cost recovery. The remaining $4,896,375, or 57% of cost, is funded from other sources.

At the policy recovery levels reflected in the model, annual revenue is projected at $5,229,064 equal to 60% cost recovery. This represents $1,460,028 in additional annual revenue, approximately 39% above current collections, assuming activity volumes remain stable.

CITY OF ENCINITAS | USER FEE STUDY | AUGUST 2026 PAGE 5 Methodology
A cost-of-service study has two core inputs: the fully burdened hourly rates of staff providing each service and the time required to perform the service. Multiplying staff time by the applicable hourly rates, then adding allowable direct expenses, produces the estimated reasonable cost of each activity.

Fully Burdened Hourly Rates
Fully burdened rates incorporate direct salary and benefits together with a proportionate share of allowable departmental and citywide indirect costs. Indirect costs include administrative and supervisory support, service and supply costs that benefit multiple activities, and citywide overhead allocated through the City's cost allocation plan, including central service support costs such as Human Resources, Information Technology, Finance, and Risk Management.

Time and Annual Workload
City staff identified and reviewed the time required for each fee-related task and supplied annual activity volumes. Per-unit costs were multiplied by annual volumes to estimate annual service cost. Current and recommended fees were then applied to the same volumes to estimate current revenue, recommended revenue, and the associated subsidy.

Policy Recovery Levels
The model applies policy recovery targets to services that benefit individual applicants or select users rather than the general public as a whole. Development-related and inspection services often provide a direct benefit to the applicant and may support relatively high cost recovery. Lower recovery targets may be appropriate when broader public benefits, affordability, legal limits, administrative practicality, market conditions, or other policy considerations justify a subsidy.

Legal Considerations
California user fees generally may not exceed the estimated reasonable cost of providing the service. Consistent with Proposition 26, recommended cost-based charges are no more than necessary to cover the governmental activity and are allocated in a manner intended to bear a fair or reasonable relationship to the payor's burden on or benefit from the service. Proposition 218 governs assessments and property-related fees, while Proposition 13 principally governs property taxes and voter-approval requirements for certain taxes. The service, regulatory, and development-related charges evaluated here are not presented as taxes. Recommended fees in the model are capped at not to exceed 100% of estimated reasonable cost. Punitive fines and charges governed by separate laws, resolutions, policies, or studies are identified in the model and are not reset through the cost-of-service calculation. Final legal compliance remains subject to City Attorney review.

Planning Fees
Planning fees include land-use, development, regulatory, and business registration activities. The model marks 129 fee lines for report inclusion and applies service-specific recovery targets, ranging from 50% (for fees recovering 0-49% currently), 80% (for fees recovering 50-79% currently), and up to 100% of calculated cost recovery.

Annual user-fee service cost is estimated at $3,789,349. Current revenue is $1,735,967, equal to 46% recovery, leaving a current subsidy of $2,053,382. Recommended annual revenue is $2,231,250 or 59% recovery, producing $495,283 in additional annual revenue and a remaining subsidy of $1,558,099.

For reviews requiring City Attorney input and review, the City will collect a $15,000 deposit. Actual attorney time will be billed against the deposit at the applicable hourly rate, and any unused balance will be returned to the developer, applicant, or user. If costs exceed $15,000, an additional deposit will be required under the same approach.

A technology fee or surcharge of $119 will be applied to Planning fees to offset technology costs and Information Technology Department support associated with user-fee services. This replaces the existing $40 technology fee currently applied only to valuation-based building permits.

The greatest modeled opportunities for increased Planning revenue are business registration renewals, for which the fee would increase from $24 at 17% recovery to $72.00 at 50% recovery, generating approximately $150,576 annually; business registration applications, increasing from $39 at 25% recovery to $77.00 at 50% recovery, generating approximately $70,110 and right-of-way design review, increasing from
$1,324 at 46% recovery to $1,435.00 at 50% recovery, generating approximately $55,500 2026-08-26 Item #12D Page 11 of 63

The model identifies Planning fees for which the full fee name or fee basis/description contains the standalone word 'New'. Most calculated fees are recommended at the policy level shown in the model. The State Housing Law review is structured as a legal-review deposit, while the unpermitted-construction charge is identified for separate policy setting because its amount is not driven primarily by staff time.

CITY OF ENCINITAS | USER FEE STUDY | AUGUST 2026 PAGE 10 Recommendations Going Forward
The City should adopt fee levels only after considering the cost results together with service access, community benefit, development policy, market conditions, legal constraints, and administrative practicality. Where a recommended fee is below full cost, the difference should be recognized as an intentional subsidy.

MGT recommends applying an annual inflationary adjustment to adopted fees as part of the City's budget process, subject to the controlling resolution or ordinance. The inflationary adjustment can be derived from Bureau of Labor Statistics or the latest Consumer Price Index figures for the respective time period.

A comprehensive update should generally be performed every three to five years, or sooner when staffing, service delivery, technology, market conditions, or activity volumes change materially. This approach is consistent with the Government Finance Officers Association's User Fee Policy best practice, which recommends developing a complete fee inventory, documenting applicable legal restrictions, defining cost-recovery strategies, and regularly reviewing and updating fee policy.

The City should move toward a consolidated master fee schedule so that all City fees are presented in one accessible document with their effective dates, bases, and responsible departments. Maintaining a master schedule will improve public transparency and help the City identify, review, and update intended cost recovery levels and subsidies consistently.

Parks, Recreation and Cultural Arts plans to conduct a separate user fee study in FY27 and present updated PRCA user fees in spring 2027.

Those fees should be incorporated into the master fee schedule following adoption.

For all fees under 100% cost recovery that will not be proposed to move to full cost recovery immediately, a phased approach alongside appropriate CPI adjustments during the three-to-five-year period between this study and the City's next comprehensive user fee analysis is recommended.

WHEREAS, the City Council finds that it is in the interest of the City of Encinitas to amend the cost of services schedule for development services, planning services, engineering services, fire prevention and marine safety services.

NOW, THEREFORE:

BE IT RESOLVED by the City Council of the City of Encinitas that the cost of services schedules as shown in Exhibit A, are hereby adopted and will become effective as of October 1, 2026; and that beginning July 1, 2027 and on the first day of each July thereafter, the fees shall be increased by the prior calendar year’s Annual Average Consumer Price Index for the San Diego Region and up to an additional five percent so long as the adjustment does not exceed the cost for providing the services.

BE IT FURTHER RESOLVED that certain types of development applications will be processed via the City’s deposit system. Further, in special circumstances, the Department Head of the applicable Department may exercise the right to utilize the deposit system in lieu of standard service fees at their sole discretion. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS, CALIFORNIA

AMENDING THE SCHEDULE OF FULLY BURDENED HOURLY RATES FOR SERVICES

PROVIDED TO USERS OF DEVELOPMENT SERVICES, PLANNING SERVICES,

ENGINEERING SERVICES AND FIRE PREVENTION AND MARINE SAFETY SERVICES WHEREAS, the Government Code of the State of California establishes procedures and criteria for the imposition of fees by local agencies; and WHEREAS, the City of Encinitas provides a variety of services to the General Public and Other Governmental Agencies; and
WHEREAS, the City desires to recover direct and indirect support costs associated with the costs of providing services that benefit an individual or business and does not have a widespread general public benefit; and
WHEREAS, the schedules of fully burdened hourly rates were last modified pursuant to City Resolution 2021-58; and
WHEREAS, the City completed an independent user fee and cost recovery study dated August 7,2026; and
WHEREAS, notice has been given that a public hearing will be held on August 26, 2026, in accordance with California law prior to adoption of this Resolution which amends fees for fully burdened hourly rates; and
WHEREAS, such hearing was duly and regularly convened in the Council Chambers of the City of Encinitas and at said hearing all interested persons were given an opportunity to be heard; and
WHEREAS, not less than 10 days prior to the public hearing, the data supporting the amounts of the proposed fully burdened hourly rates was on file for public review in the Office of the City Clerk; and
WHEREAS, after receiving the evidence presented at the public hearing, including the staff report and oral and written testimony received from the public, the City Council found and determined that the amounts of the fully burdened hourly rates established by this Resolution do not exceed the estimated actual costs associated with providing those services.

NOW, THEREFORE:

BE IT RESOLVED by the City Council of the City of Encinitas that the amended schedule of fully burdened hourly rates as shown in Exhibit B, are hereby adopted and will become effective as of October 1, 2026; and that beginning July 1, 2027 and on the first day of each July thereafter, the fees shall be increased by the prior calendar year’s Annual Average Consumer Price Index for the San Diego Region and up to an additional five percent so long as the adjustment does not exceed the cost for providing the services.

BE IT FURTHER RESOLVED that certain types of development applications will be processed via the City’s deposit system. Further, in special circumstances, the Department Head of the applicable Department may exercise the right to utilize the deposit system in lieu of standard service fees at their sole discretion. When the deposit system is utilized, charges for development services shall be billed either: (a) at actual labor costs including all benefits, plus overhead, or (b) direct costs pass-through or (c) at the fully burdened hourly rates specified in Exhibit B hereto. 2026-08-26 Item #12D Page 57 of 63
BE IT FURTHER RESOLVED the amended schedule of fully burdened hourly rates established by this Resolution attached hereto as Exhibit B do not exceed the estimated reasonable costs of providing the related services pursuant to California Government Code Section 66000 et seq.

BE IT FURTHER RESOLVED the City Council finds and determines that the fees for services and the billing and overhead rates established by this Resolution do not exceed the estimated reasonable costs of services and otherwise comply with the provisions of California law.

BE IT FURTHER RESOLVED that this action is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15378(b)(5) of the CEQA Guidelines, as an organizational or administrative activity of government that will not result in a direct or indirect physical change in the environment.
