MINUTES OF THE ENCINITAS CITY COUNCIL SPECIAL MEETING
AUGUST 26, 2026, 3:30 P.M., 505 SOUTH VULCAN AVENUE,
ENCINITAS, CA 92024
CALL TO ORDER/ROLL CALL
Mayor Ehlers called the meeting to order at 3:30 p.m.
Present: Mayor Bruce Ehlers, Deputy Mayor Jim O’Hara (arrived at 3:37 p.m.), Council Members Joy, Lyndes, Luke Shaffer (arrived at 3:39 p.m.), and Marco San Antonio.
Absent: None
Also present: City Manager Campbell, City Attorney Thind, Assistant City Manager Schwarm, Code Enforcement Manager Jemison City Clerk Weichers, and Deputy City Clerk Rapp
There being a quorum present, the meeting was in order.

1. CLOSED SESSION: CONFERENCE WITH LEGAL COUNSEL, WHETHER TO INITIATE
LITIGATION

There were no public speakers.
The Mayor and City Council adjourned into Closed Session at 3:31 p.m.
REPORT FROM CLOSED SESSION
At the Regular 6:00 p.m. City Council meeting City Attorney Thind reported that the City Council meet earlier today for closed session at approximately 3:30 p.m., to discuss one item related to potential initiation of litigation. By a vote of 5–0, the City Council voted unanimously to initiate litigation related to unpermitted construction and other work at the property located at 2000 Playa Riviera Drive.
ADJOURNMENT
Mayor Ehlers adjourned the meeting at 3:47 p.m.
