Current Building Code Provisions
- City Council Adopted 2025 California Building Code on September 24, 2025
- Included a revision to the composition of the Board of Appeals to hear appeals of Building Permit-related
decisions
- Contemplates a Board of Appeals that is made up of 10 individuals, with very specific qualifications
- Contemplates a quorum of 6 individuals
- Beyond the requirements of most cities and has made
empaneling the Board of Appeals a lengthy process
2 Proposed Ordinance Amendment
- Revision to Section 23.12.030(B)(7) of the EMC and
Section 113.2 and 113.3 of the California Building
Code
- Will allow for a Board of Appeals made up of 3 to 5
persons
- Will still be volunteers who have experience and
training related to the Building Code
- No more requirements related to
employment/residence
3 Recommended Action
- Hold Public Hearing
- Introduce Ordinance No. 2026-21, titled “An
Ordinance of the City Council of the City of
Encinitas, California, adopting Amendments to
Section 23.12.030 of the Encinitas Municipal Code
Pertaining to the Board of Appeals Under the
California Building Code
