The action being considered by the City Council is exempt from the California Environmental Quality Act (CEQA) because it is an Emergency Project as defined under Section 15269(b) of CEQA Guidelines. The action involves emergency repairs to publicly owned facilities necessary to maintain service essential to public health and safety.

This item does not relate to the Climate Action Plan.

GENERAL PLAN/CITY COUNCIL FOCUS AREAS:

This item relates to the following area of the General Plan:

Resource Management Element, Quality of Water and Groundwater Resources, Goal 2:

The City shall make every effort to improve ocean water quality.

This item relates to the following Focus Areas in the FY 2026-27 City Council Work Plan:

1. Public Health and Safety for the Protection of Life, Property and the Physical Environment, and

2. Effective and Reliable City Services, Infrastructure and Communications. 2026-09-23 Item #10E Page 1 of 68
FISCAL CONSIDERATIONS:

The fiscal impact of this item requires a budget adjustment to transfer $77,250 from Project (CS26D Leucadia Blvd/I-5 Bridge Barrier Rail) to Project CX27A (Emerg Cottonwood Cr Drain Repair).

BACKGROUND:

On September 10, 2026, the City Manager made an Emergency Determination (Attachment 1).

ANALYSIS:

Cottonwood Creek Park is situated adjacent to the North side of Encinitas Blvd, immediately east of Vulcan Ave. A storm drain constructed of thirty-six-inch corrugated metal pipe (CMP) runs East to West through the South edge of the park (Attachment 3, page 8, 18). A 35.5-foot segment of this CMP has failed and must be replaced. Minor erosion has been observed on the South side of Cottonwood Creek presumably attributable, in whole or in part, to this deficiency. Repairs are needed before anticipated heavy seasonal/cyclical rains in order to: prevent future erosion; preserve adjacent and downstream infrastructure and property; prevent excessive sediment from entering the stormwater system; and, prevent hazards to life and safety around and downstream of the failed CMP.

On September 10, the City Manager made an Emergency Determination (Attachment 1), pursuant to Encinitas Municipal Code §7.18.060, to authorize a no-bid contract for this repair. The City has requested and received a proposal for the CMP replacement from Burtech Pipeline in the amount of $77,250 (Attachment 4). Available funding has been identified in Project CS26D (Leucadia Blvd/I-5 Bridge Barrier Rail) which staff requests the City Council transfer to Project CX27A (Emerg Cottonwood Cr Drain Repair) via the attached Resolution 2026-87 (Attachment 2). This work will restore the functionality of this segment of CMP, allowing stormwater to flow downstream as designed.

Staff recommends that the City Council receive and file the attached Emergency Determination (Attachment 1) and approve Resolution 2026-87 (Attachment 2) to transfer funds needed to complete this project.
