Finance Director/HR Administrator (FDHRA), Celinda Bickner, responded that she was the Human Resources Administrator.

Sergeant Zambrana informed the council that Officer Figone had accepted a position with the City of Ripon. However, a new officer was recently cleared from training, and a second officer was 'urrently in training. He also informed the council that there had been an increase in burglaries o the north side of town during the month of May, and that patrols had been increased in the area, which seemed to be helping. Finally, he noted that Officer Palomino led the department with 12 arrests and 44 citations last month.

Public Works Superintendent/Manager (PWSM), Juston Collins, advised that the Phase 2 McHenry Sewer Project was nearly complete. He also noted that the Wastewater Treatment Plant (WWTP) Biosolids Removal Project was set to start tomorrow, with the industries beginning their operations on July Ist. He then politely reminded the public to ensure care of their overgrown lots for safety reasons, and encouraged everyone to attend the next Farmer's Market on Wednesday.

Councilmember Strohman commended Public Works for their quick work during Memorial Day weekend fixing a major water leak on Yosemite Avenue. He noted that there seemed to be an increase in water leaks lately, inquiring if that was normal for this time of year. PWSM Collins responded that it was normal for summer time, as more water was used, and that Public Works staff was doing a sizable portion of this work in-house, which helps reduce delays and reduce costs. He praised the team for their hard work and thanked the Police Department for being a great partner during water leaks. Interim City Manager French noted that Public Works staff tracks all water leaks, and that this information is used to determine which lines were needed more than periodic repairs and would incorporate this information into the City's Capital Improvement Program (CIP) for line replacements.

Escalon resident, Gabriella Vargas, brought forth several issues, acting as an advocate on behalf of residents, as the owner of the Escalon Residents Facebook page. These included the trees on Sophie Lane needing to be trimmed and the aphid problem dealt with, the nuisance excessive feral cats in town, particularly on First Street near James Street, and her concerns with police officers having an attitude and possibly profiling drivers based on the cars they drive, rather than focusing on the speeding problem on First Street between Pioneer Drive and El Portal Middle School.

Escalon resident, Ed Alves, thanked Interim City Manager French for his help in providing information to him and PWSM Collins for taking care of things in town. He inquired if the solar system installed for the city was as efficient as promised and encouraged staff to reach out to Engie to subsidize the difference if it was not. He also highlighted issues which could be improved with the budget format, including indexing and a larger print size, although he commended staff for the great job on the budget.

Escalon resident, Betty Bennett, inquired if the trees referenced on Sophie were crepe myrtles, and if so, that a treatment would need to be applied early in the year to mitigate aphids.

Escalon resident, Vance Nielsen, expressed concern regarding the number of overgrown lots in the neighborhoods and suggested having the senior patrol drive around and make note of which ones need to code enforced.

PWSM Collins noted that Public Works was gathering bids to do a full tree trimming for the Westwood Country Landscape Maintenance District and staff would be treating for the aphids on the infected trees themselves.

ADMINISTRATIVE MATTERS

11. Adopt Resolution No. XX-24, approving the Fiscal Year 2024-25 Proposed Budget, including the Capital Improvement Plan.

FDHRA Bickner presented the Fiscal Year 2024-25 Proposed Budget, with support from Interim City Manager French.

Mayor Bellinger opened the item for public comment.

Ms. Vargas thought that there could have been better communication regarding the budget workshops, including sharing on the Escalon Residents page.

Mr. Alves questioned what the balance of funds collected for the SSJID Surface Water Project was and where it was located in the budget. FDHRA Bickner responded that she would get that information to Mr. Alves.

Mayor Bellinger closed the item for public comment.

Mayor Pro Tem Hagan stated that the City needed to prioritize finding an inflation hedge and be

proactive. FDHRA Bickner responded that this was why fund management was so important.

Mayor Bellinger thanked staff for all of the hard work they put into creating a balanced budget.

Councilmember Walker questioned the South McHenry to Jones CIP Project. Interim City Manager French noted that, per previous CIP decisions, that that item would be dropped from the budget and that the City Council should include removing it as part of the motion.

Councilmember Strohman noted that he asked Chief Hardgraves what he thought of the budget cuts to the Police Department during the budget workshop. Chief Hardgraves responded that it was putting equipment and new police vehicle purchases on hold, but the budget was a real budget for the Police Department and Chief Hardgraves was not concerned with the cuts. Councilmember Strohman wanted the residents to know that all departments had made a commitment to this budget and, while it was lean, there should be no disruption to the level of service normally provided by the City. He praised staff for presenting a balanced budget, prior to July 1" ", with no excess spending.

Councilmember Engle also gave his appreciation to staff for the budget presentation from two weeks ago and tonight, noting the Council and community would be tracking the progress of the budget throughout the year.

Councilmember Strohman inquired if staff would be presenting quarterly updates on the budget, which FDHRA Bickner confirmed.

MOTION - It is moved/seconded by WALKER/STROHMAN to Adopt Resolution No. XX-24, approving the Fiscal Year 2024-25 Proposed Budget, including the Capital Improvement Plan, as amended to remove the South McHenry to Jones CIP Project. Motion carried (5-0) MINUTE ORDER 38-24

Councilmember Walker thanked staff for a balanced and on-time budget and wished everyone a fun and safe 4'h of July. She encouraged the public to report overgrown lots in town through code enforcement and to attend the upcoming Farmer's Market.

Councilmember Strohman asked if council could request increased fireworks patrols for the holiday.

Mayor Bellinger agreed that more patrol would be good. Sergeant Zambrana noted that patrol is always increased for the 4th of July holiday.

Councilmember Strohman informed the council that he had been approached by the San Joaquin County District Attorney's Office asking if the City had interest in applying for an asset forfeiture grant. He noted that the application process was to submit a written request, outliningthe proposed

use of the grant money, which should include productive youth activities, and that up to $25 thousand dollars were available. He asked for consent from the council to bring this item beforeCouncil for further discussion and a decision. Consent was received.

Councilmember Strohman noted that a balanced budget was very important and thanked FDHRA Bickner for her efforts. He also asked for a status update on a potential Murphy Ranch town hall meeting, which Interim City Manager French provided. Next, Councilmember Strohman informed everyone that the senior lunch program had lost one day of programming, so it would only be held on Tuesday afternoons, and asked staff to try to find funding to bring back that second day.

Next, Councilmember Strohman stated that the Escalon Fire Protection District was looking to have regular meetings with the City, much like the City already had with the Escalon Unified School District, and asked for a consensus from council to have staff start the process of forming a 2x2 committee, which was received. Councilmember Strohman then asked for a transportation update for seniors, which Interim City Manager French provided.

Finally, Councilmember Strohman wished everyone a safe 4'h of July and encouraged everyone to support the Escalon Chamber of Commerce by attending the upcoming Farmers Market, as it was events like these that make Escalon what it is.

Councilmember Engle questioned where someone could find the budget on the City of Escalon website, which Deputy City Clerk Thompson explained.

Mayor Pro Tem Hagan asked that staff work on the weedy lots in town, and encourage everyone to maintain decorum during the election this year. He noted that staff was doing a great job and he appreciated what they did for the budget. He encouraged the public to read about the Saudi petrodollar and wished everyone a Happy 4* of July.

Mayor Bellinger praised staff for the great work on the budget. He hoped residents would support the Farmers Market and support the local non-profits by buying fireworks locally. He wished everyone a safe and sane 4* of July.

ADJOURNMENT
Mayor Bellinger adjourned the meeting at 8:23 pm.

Respectfully Submitted,
Jenny Thompson, Deputy City Clerk

ESCALON ITEM NO. 3

CALIFORNIA
TO CEl
INCORPORATED MARCH T2, 1957 COUNCIL AGENDA ITEM
FOR JULY 15, 2024
Prepared By: Jaylen French, Interim City Manager
Date: June 24, 2024
Subject: Authorize the City Manager to Approve Change Order Requests Up to 10% for Public Works Projects
Recommendation:

Approve Resolution Authorizing the City Manager to Approve Change Order Requests Up to 10% For Public Works Projects.

Background and Discussion:

The City Council, desiring transparency in the use of taxpayer dollars and the efficient administration of public works projects, directed City staff to establish appropriate change order limits for all city projects.

The recent past practice was to use a consistent change order authority amount ($50,000) across diverse projects, regardless of the cost of such project.

The new approach being proposed will be to establish a default change order authority for each project based on a percentage of that project. The City Manager has the authority to approve these change orders up to 10%. If change orders generated for the project come in above the new approved contingency amount of 10%, City staff may request more advanced change order authority at the time of contract award, not exceeding 20%, provided the project exceeds either $1 million or is particularly complex or it is anticipated it has a greater degree of possible unknowns in the field.

Providing this clear direction will help streamline the efficiency of projects and prevent undue delay, and is further in line with best practices as change order authority should generally be tied to a percentage of the construction project amount (and not a flat amount regardless of project size).

Fiscal Impact:

The adoption of this policy would have no direct impact on the City's General Fund budget, nor any direct impact on the Capital Improvement Program Budget. This policy establishes protocols for the identification and approval of an advanced change order authority. The vast majority of capital improvement projects are funded with outside funds or enterprise funds and in all cases, the projects are fully funded, including contingency authority prior to approval.

The Escalon Police Department is currently only one officer short of fully staffed.

The two Crown Victoria's put up for auction on PublicSurplus.com sold for $1,425 and $1,300 for a total of $2,725.

The 4' of July was fairly standard. We had multiple calls of illegal fireworks and loud parties, but no reports of injuries or fires caused by fireworks. Officer Harrison and Officer Kyes worked undercover in an unmarked vehicle to locate and identify individuals setting off illegal fireworks. They cited one person for possession of illegal fireworks on Deborah Circle.

An iPhone glitch caused the weather forecast for July 6th to be 119 degrees to 121 degrees. After multiple people brought the forecast to my attention, I decided to host a cooling center at the library for that day. We had not been hosting cooling centers, because nobody attended the last several that we hosted. After it was determined that the 119 degree temperatures were a glitch, I decided to keep the cooling center open to gauge community interest. Once again, nobody attended the cooling center we hosted on July 6th

NOTES AND INSTRUCTION
I. Rouine samples include:
. Samples required pursuant to 22 CCR Section G4423 and any additional samples required by an approved routine sample siting plan established pursuant to 22 CCR Scetion 64423 . Extra samples for systems with high source water turbidities that are using surface water or proundwater under direct influence of surface water an do not practice filtration in compliance with regulations; The following are situations (boxed entrics) are E. coli MCL violations and require immediate notification to the Division (22 CCR, Section 64426.1):

2. Any E.coli positive repeat following a total coliform positive sample.

3. A total coliform positive repeat, following an E.coli positive routine sample.

4. Failure to take all required repeat samples following an E. coll positive routine sample.

5. Failure 10 test for E. coli when any repeat sample tests positive for total colifonn

6. Second Level 1 coliforn treatment technique trigger exceedance in a rolling 12-month period.

7. Level 1 Coliform Treatment Technique (TT) Triggers:
a. For systems collecting less than 40 samples, if two or more samples are total colifonn positive, then the TT is exceeded and a Level I Assessment is required. b. For systems collecting 40 or more samples, if more than 5.0 percent of samples collected are total coliform positive, then the TT is excecded and a Level I Assessment is required.

If a trigger is excecded as a result of a total coliform positive repeat sample, the system must notify the Division by the end of business day, section 64-124( Contact the Division as soon as practical to arrange for the Division to conduct a Level 2 Assessment of the water system. The water system shall complete a Level Assessment and submit it to the Division within 30 days of learning of the trigger exceedance.

9. Conduct a Level 1 Assessment as soon as practical that covers the minimum elements (22 CCR. Section 64426.8 (a)(2), Submit the report to the Division within 30 days of leaming of the trigger exceedance.

10. Positive results and their associated repeat samples are to be tracked on the Coliform Monitoring Worksheet.

11. Repcat samples must be collected within 24 hours of being notified of the positive results. At east 3 repcat samples must be collected for each total coliforn positive sample.

12. For systems subject 10 the Groundwater Rule: Positive results and the associated triggered source samples are to be tracked on the Coliform Monitoring Worksheet.

13. For triggered sample(s) required as a result of a total colifor routine positive sample, an E.culi-positive triggered sample (boxed entry) requires immediate notification to the Division, Tier 1 public notification, and corrective action. Updated 07/01/2021

CALIFORNTA
INCORPORATED MARCH 12, 1957 COUNCIL AGENDA ITEM
FOR JULY 15, 2024
Prepared By: Jaylen French, Interim City Manager
Date: July 5, 2024
Subject: Placement of a General Tax Measure on the Ballot for the November 5, 2024 General Municipal Election for the Submission to the Qualified Voters of an Ordinance to enact a General Transaction and Use Tax at the rate of one percent (1%)
Recommendation:

The Escalon City Council will vote on whether to place a measure on the November 5, 2024 ballot to provide voters the option of enacting a new general fund revenue source. The measure would increase the City's sales tax by 1%, generating an estimated $900,000 annually to maintain City services, including 911 emergency response, local drinking water, street repairs, and maintain neighborhoods and play areas for children and Escalon's long-term finances.

1. Adopt Resolutions xx-24 and xx-24 and xx-24, to approve the following:
a. Call for the placement of a General Tax Measure on the ballot for the November 5, 2024 General Municipal Election for the submission of the City's qualified voters of an Ordinance to enact a general Transactions and Use Tax (sales tax) at the rate of one percent (1%); b. Request the Board of Supervisors of the County of San Joaquin to consolidate a general Municipal Election with the Statewide Election to be held on Tuesday, November 5, 2024; c. Provide for the filing of primary arguments for and setting rules for the filing of written arguments regarding a city measure to be submitted at the November 5, 2024 General Municipal election;

2. Authorize the City Manager to execute all the necessary documents on behalf of the City.

Background and Discussion:

The City of Escalon has sought to demonstrate resilience, responsibility, and responsiveness to the community's needs. Following the Great Recession around 2008, Escalon took proactive measures to maintain its finances, by reducing staffing levels and expenditures. These actions resulted in the establishment of an emergencies reserve fund which is currently at $3.23 million. Despite widespread and frequent fiscal impacts, Escalon has remained committed to providing local services.

General Fund Overview:

The City's General Fund is the operating fund for the majority of the City's services and activities, as summarized below:
• Police
• Streets
• Recreation
• Parks
• Animal Control
• Community Center
• Library
• Trees/Landscaping
• Street Lighting
The City's costs are outpacing the nominal growth in revenue each year, creating a structural budgetary deficit. Therefore, the challenge at each budget cycle is how to maintain local City services while addressing unfunded projects for infrastructure and neighborhoods.

The General Fund budget is $5,342,682 for Fiscal Year 2024-2025. This balanced budget represents programs and services required to operate the City for one fiscal year. City staff worked diligently to cut $515,000 in expenditures, while maintaining current service and maintenance levels, as well as positions. However, this does not provide sufficient revenue to invest in strategic and priority areas for the City.

General Fund Forecast:

Inflation and the increased costs of providing services, combined with the loss of the City's largest sales tax producer, mean that despite a balanced budget for FY 2024-2025, expenses are estimated to outpace revenues over the next decade. To maintaining the City's finances, revenues should align with the costs of ongoing community expectations and priorities as much as possible.

The City Council has historically maintained a moderate General Fund reserve to help mitigate potential future risks like revenue shortfalls or unexpected expenditures. However, without additional revenue, the General Fund Reserves of $3.23 million are estimated to be depleted by FY2028-29.

Understanding these forecasts, staff reduced expenditures in the FY 24-25 budget, and continue to evaluate existing and potential revenue sources to maintain a balanced budget. If the status quo remains, maintaining current programs and services will become more difficult.

•General Fund Assigned Reserve (33%) •General Fund Unassigned Reserve Fund Balance as% of Expenditures To maintain current and expected service standards, the City Council has explored different revenue- generating approaches, including Community Facilities Districts (CFDs), grants, and productive use of city assets. An additional revenue source would support the City's long-term finances, allowing for infrastructure investment and addressing public safety challenges. A potential 1é sales tax measure on the November 2024 ballot would allow Escalon voters to decide on this additional revenue source.

If approved, on November 5, 2024, qualified City of Escalon voters will have the option to vote on the following ballot question:

City of Escalon Local Services Measure
To protect Escalon's long-term financial stability by funding Escalon services such as maintain 911 response; neighborhood police patrols; recruiting/retaining police officers; repairing streets/potholes; protecting essential drinking water sources from pollution; maintaining Hogan Park, youth sports leagues; and for general governmental use; shall the City of Escalon adopt a 1C sales tax providing approximately $900,000 annually until ended by voters; requiring audits/public spending disclosure/all funds benefit Escalon residents, be adopted? Sales Tax and Transaction and Use Tax Overview:

The California Department of Tax and Fee Administration (CDTFA) collects the sales and use tax from local retailers selling tangible personal property or from the users of tangible personal property purchased from retailers outside California. The base statewide sales tax is 7.25%. California cities currently receive 1% of the total 7.25% sales tax rate within its jurisdiction, known as the Bradley Burns Uniform Local Sales and Use Tax, whereas the State receives 6 percent. State law authorizes city and county residents to adopt local Transaction and Use Taxes in addition to the Bradley Burns tax, with 100% of any local tax proceeds going directly to that city.

The statewide base sales and use tax rate is currently 7.25%, with an additional maximum combined county/city tax rate of 2%The County currently imposes a 2% tax, so the current total sales tax rate the customer pays in Escalon is 7.75%. The City of Escalon may adopt a Transaction and Use Tax to increase the total sales tax rate - in this case the proposal is to increase it by 1%, for a total 8.75% rate.

Sales Tax Breakdown:

This year, of the $8.14 million in sales tax revenue generated in Escalon, $6.3 million goes to the State of California, $787,500 to San Joaquin County, and $1.05 million is returned to Escalon for local use. Please see the chart below. The bottom portion of the graphic represents the estimated funds available to the City should a 1% sales tax measure pass in the City.

In San Joaquin County, Escalon and Ripon have a sales tax rate of 7.75%. Other nearby rates include Riverbank (7.875%), Manteca and Lodi (8.25%), Oakdale (8.375%), Lathrop (8.75%), Modesto (8.875%), and Stockton (9.0%).

If a local sales tax was approved by the voters, it would not apply to purchases such as groceries, medical and dental services, rent, utilities, real estate, education, personal services, and labor.

The City of Escalon maintains a location along Highway 120 that sees millions of travelers each year. Consequently, some of the city's sales tax revenue is derived from these travelers. Therefore, the total revenue generated from a sales tax measure would not fall entirely on residents and businesses of the City for the use of public safety services, emergency 911 response, use of roads & sidewalks, parks, recreation, and trash collection.

The City would maintain control of this sales tax revenue which could be allocated to necessary and strategic services, projects and facilities. The locally controlled revenue generated from this Measure would help the City maintain Escalon's long-term finances while providing a defined level of service for residents and businesses.

Expenditure Reductions:

According to the budget estimates, without significant additional revenues, the City may have to make cuts to local services.

Public safety, roads, parks, and facilities maintenance expenditures are expected to have the most significant negative impact on the City's General Fund reserves. Based on the City's management plans for City facilities, parks and streets, continuing to defer maintenance may result in accelerated deterioration and needed replacement, in addition to negatively impacting the residents and businesses that use these facilities.

Community Survey:

A recent survey conducted by Fairbank, Maslin, Maullin, Metz & Associates (FM3) shows there is broad community support for a 1¢ sales tax measure if placed on the ballot this November. The revenue could be used to maintain 911 emergency response, prevent thefts and burglaries, protect local drinking water sources, provide clean and safe public areas and neighborhoods, and repair streets and potholes, among other things while retaining and attracting small businesses. The survey indicates that over 70% of those surveyed recognize the City's fiscal position and would support a sales tax measure.

The survey also reflects the value voters place on the City of Escalon services. FM3's survey explored the following sentiments.
• More than 7 in 10 respondents agree that the following City services are priorities:
• Maintaining 911 emergency response (93%)
• Maintaining local drinking water (91%)
• Maintaining crime prevention programs involving thefts and burglaries (90%) • Providing safe places for children to play (87%)
• Protecting Escalon's long-term financial stability (87%) • Repairing streets & potholes (83%)
• Preventing drastic police department cuts (81%)
• Maintaining City services (76%)
• Retaining and attracting small businesses (75%)
• Maintaining crime prevention programs (73%)
• Maintaining safe routes to school (72%)
• Maintaining youth recreation programs (71%)
• Cleaning and maintaining public areas (71%)
• Nearly 3 in 5 voters feel the City is headed in the right direction.

Fiscal Impact:

Subject to the approval by Escalon voters on the November 5, 2024 General Election, a local transaction and use tax (sales tax) would take effect on April 1, 2025. Based on estimates, a 1% local sales tax would generate approximately $900,000 annually in additional General Fund revenues (based on FY 2023-2024 sales tax projections).

Under Revenue and Taxation Code § 7272, the California Department of Tax and Fee Administration (CDTFA) will assess the City charges to administer the new local sales tax based on actual costs, with a statutory maximum not to exceed $175,000. However, CDTFA rarely charges the statutory maximum, and the fees are typically a small fraction of sales tax revenues.

San Joaquin County will incur additional costs by consolidating elections as requested by the City of Escalon. The City would be required to reimburse the County for the City's share of the applicable costs, estimated to be $26,000.00. The FY 2024-2025 Budget would be adjusted an additional $11,000.00 from $15,000.00.

Impact and Applicability:

Should the majority of qualified voters (50% + 1) vote "Yes" on the proposed measure, a 1% increase to the City of Escalon sales tax will be enacted starting in April 1, 2025, generating approximately $900,000 annually in General Fund revenue. For those making applicable purchases in the City of Escalon, the sales tax will add 1¢ per $1.00 spent on taxable goods (not including medicine, doctor appointments, groceries, utilities, or real estate).
