This handbook serves to outline City Council policies and procedures relative to Council works and actions from pertinent provisions of the Escalon Municipal Code, Council Resolutions and Council Policies. It is intended, where practicable and feasible (and where not otherwise in conflict with federal, state, or local law), to provide general guidance and advice for those serving as an Escalon City Councilmember and the general public.
ORGANIZATIONAL STRUCTURE
Like the vast majority of California cities (particularly smaller cities), the City of Escalon is a General Law city and utilizes a Council-Manager form of government. As a general law city, the city has only those corporate powers which are expressly conferred on it by the California Constitution or the Legislature, along with the powers necessary to accomplish lawful activities.
The elected City Council represents the community and develops the long-term vision for the community along with the policies that affect the overall operations of the organization.
The City Manager is hired by the City Council to work in partnership with the Councilmembers to carry out the policies of the City Council. The City Manager oversees the administrative functions of the City including administration, finance, human resources, public safety, development services, engineering, building, parks, and recreation. Additionally, the City Manager will advise the City Council on policy considerations. All department heads report directly to the City Manager.
The City Attorney is hired by, and serves at the pleasure of, the City Council. The City Attorney’s duties include framing ordinances and resolutions and providing legal advice on matters which come before the City Council. The City Attorney is also permitted to prosecute certain misdemeanors and to defend the City’s interests in litigation. The City Attorney represents the City Council as an entity, but does not represent individual Councilmembers.
GENERAL REQUIREMENTS
The City Council shall is be the governing body of the municipality. All powers of the City shall be vested in the Council, subject to the provisions of the Municipal Code and the CouncilManager form of government under State law, and the Constitutions of the State of California , and the Constitution of the United States. The Council may establish the method or methods by which any of such powers may be exercised.
Role of the City Council
Based upon the Escalon Municipal Code and applicable state and federal law, Councilmembers serve in a variety of ways, depending on the nature of the matter. When adopting, revising, amending or repealing city-wide land use programs and policies, as well as General Plan and
zoning, the Council performs a legislative function. When considering the approval, modification, revocation or denial of individual land use permit (conditional use permits, subdivision maps, Site Plans, etc.), the Council acts in an adjudicatory capacity. Finally, when considering whether decisions of prior City Councils or the Planning Commission should be upheld or overturned, the Council exercises its appellate function. It is important to understand that the City Council’s appropriate role may encompass any and/or all of these functions during the course of a given meeting.
Composition of the City Council/Powers and Duties
The City Council is made up of five (5) members that are elected city-wideat large. One of the members will serve as Mayor, and another as Mayor Pro Tem. The positions of Mayor and Mayor Pro Tem generally rotate bi-annuallybiennially, upon selection of the Council. Unless precluded from voting by a conflict of interest, each member shall should generally not abstain as each has have the right and responsibility duty as an elected representative to vote on all matters coming before the Council. If a Councilmember believes he or she might have a conflict of interest on an item before the City Council that Councilmember should discuss the conflict with the City Attorney or, in some cases, obtain a legal opinion from the Fair Political Practices Commission (FPPC). Potential conflicts of interest can stem from many different sources (i.e. business relationships, sources of moneyincome, etc). If it is determined a conflict exists, the Councilmember must:
i. Remove himself/herself from any participation in the matter once the conflict becomes apparent;
ii. Identify the basis of the conflict for the record (if required under state law); and
iii. Step out of the Council Chamber while the matter is presented to the City Council for hearing and/or action.
Selection of Mayor and Mayor Pro Tem
At a regular City Council meeting, after the election has been certified, the members of the City Council will nominate and appoint a Mayor and Mayor Pro Tem from the individuals on the City Council. Nothing precludes the Council from selecting a new Mayor or Mayor Pro Tem at any time.
City Council Vacancy
If a vacancy occurs on the City Council, the City Council must address the vacancywithin sixty (60) days of the commencement of the vacancy by either 1) appointing a new Councilmember within sixty (60) days from the commencement of the vacancy, or 2) by calling for a special
election to fill the vacancy. The filling of a vacancy on the City Council shall comply with the process set forth in Government Code section 36512, or 3) electing to wait until the next general election, assuming the next election is within a reasonable number of months. The Government Code does not set out a specific process to be used to make the appointment.
Appointment
If the council fills the vacancy by appointment, the person appointed to fill the vacancy shall hold office pursuant to one of the following:
1) If the vacancy occurs in the first half of a term of office and at least 130 days prior to the next general municipal election, the person appointed to fill the vacancy shall hold office until the next general municipal election that is scheduled 130 or more days after the date the council is notified of the vacancy, and thereafter until the person who is elected at that election to fill the vacancy has been qualified. The person elected to fill the vacancy shall hold office for the unexpired balance of the term of office. 2) If the vacancy occurs in the first half of a term of office, but less than 130 days prior to the next general municipal election, or if the vacancy occurs in the second half of a term of office, the person appointed to fill the vacancy shall hold office for the unexpired term of the former incumbent.
Special Election
If the City Council calls a special election, the special election shall be held on the next regularly established election date not less than 114 days from the call of the special election. A person elected to fill a vacancy holds office for the unexpired term of the former incumbent.
All current and Ffuture City Councils should endeavor to use a fair, open, and transparent process with the purpose of yielding qualified individuals to fill the vacancy by appointment.
The recommended steps of this appointment s process are outlined below:
• At a regularly scheduled City Council meeting, City Council approves would approve the application and directs staff to open a designated application period. The advertisement of the application period shall may include a public notice in the local newspaper, shall and should, at minimum, be posted on the City’s website and social media platforms.
Formatted: Indent: Left: 0"
• After the application period has closed, the Council should hold a regular or schedule a special meeting of the City Council to review the submitted applications, and determine the format for interviews, and scoring methodology.
• At a regular or special meeting of the City Council, conduct applicant interviews. • At the same meeting interviews are conducted, or at a subsequent a regular or special meeting of the City Council, score applicants andand the Council shall appoint, via majority vote, the individual to assume the vacant Council seat.
COMPENSATION
Each member of the City Council receives a monthly salary in the amountno greater than the maximum amounts specified in Section 36516(a)(2) of the California Government Code, based on the population of the City, as adopted and approved by the City Council, and as may be amended by the Council from time to time.
The current rate as of 2025, which was last updated in ____, is $300 per month.
REGULAR MEETINGS
1. Meeting Time and Schedule. The Council will hold regular business meetings twice a month on the first and third Monday of the month at 7:00 p.m., unless otherwise amended, or unless the regular meeting date falls on a recognized Federal holiday, which the City also recognizes; provided, however, that any such regular meeting at which a special meeting or closed session is to be held may be commenced for the holding of such closed session at an earlier time on the meeting day as may be noticed on the Council’s agenda and posted at least 72 hours in advance of such earlier commencement time.
In the event of any such earlier commencement of a regular meeting for the purpose of holding a closed session, no other items of business on the Council’s meeting agenda shall be addressed before the start of the City Council meeting.
2. Place. All regular meetings of the Council shall be held in the Council Chambers, at City Hall, 2060 McHenry Avenue, Escalon, California.
3. Agenda.
a. The City Manager shall prepare the agenda for City Council meetings in accordance with the proposed order of business. The Council is prohibited from taking action on any item not appearing on the posted agenda unless:
i. A City Council majority determines that an “emergency situation” exists; or ii. The City Council determines by a two-thirds vote, or by a unanimous vote if less than two-thirds of the members are present, that there is a need to take immediate action and that the need for action came to the attention of the body subsequent to the posting of the agenda; or
iii. The item was included in a properly posted agenda for a prior meeting occurring not more than five (5) days prior to the meeting at which the action is taken and was continued to the meeting at which the action is taken.
iii.
b. The City Manager will use his or her discretion to determine which items should be placed on the consent agenda. However, the City Manager will not place items on the consent agenda if he or she anticipates the Council will need more information, have specific questions, or the public needs to hear the information. The City Council may consider all the items on the agenda marked “CONSENT” at one time by a vote after a motion has been duly made and seconded.
c. A Councilmember may have items they request to be included on a future agenda.
It is important that each City Councilmember has the same information with which to make decisions and understand the issues related to policy. Therefore, the City Council has adopted the following policy for Councilmember to request an item be placed on the agenda:
i. If a Councilmember wants to place an item on the agenda, they must do so in writing, using the attached form (see Attachment A) that may be updated periodically. Their request, which must be supported by one (1) additional councilmember, is to be submitted to the City Manager. The Councilmembers may submit additional information as appropriate. Any electronic materials (Power Point or similar programs) must be submitted at least 48 hours prior to the posting of the City Council meeting to allow staff to review and integrate these materials with the staff report. a. The items requested to be added to the agenda should address policy issues rather than one-time exemptions.
b. The City Manager is responsible for putting together (or delegating, as necessary) a staff report. The Councilmember's memo becomes an attachment to the staff report. After the staff report is prepared, the items would be placed on the City Council agenda for Council’s Formatted: Font: 12 pt, Bold

consideration. There may be some situations where the City Manager will need to streamline the process due to inadequate time available. c. At the Council meeting, the Mayor will introduce the item, and will note that it was placed on the agenda by Councilmember X. Councilmember X would be given an opportunity to explain why they put this on the agenda, what they are recommending, etc. Staff would then give the corresponding staff report. The staff report will typically include background information, discussion of the policy issues, legal considerations, and any fiscal impact. The Mayor will ask if there are any questions of staff.
ii. During a meeting of the City Council, two members of the Council can direct staff to bring an item forward on a future agenda for the City Council’s consideration.
iii. A member of the public may request that an item be placed on a future agenda, and must do so in writing to the City Manager using the approved form. The request will be presented during a normal council meeting resident for Council’s consideration. If the item receives majority support, the item will proceed to a future agenda as outlined above. The item procedurally then becomes a staff item, and is presented to the Council by staff. However, Tthe requesting resident will have an opportunity to briefly introduce the item in a time allotted by the Mayor, but in no case greater than 5 minutes, in addition to any public comment rights that resident may otherwise have and will generally be given the same amount of time as public comment.
d. In no caseGenerally, the City Council should endeavor that, other than for legally required second readings, shall any Agenda Item/Motion that has been voted upon at a Council meeting appear on the Agenda again so as to present the same or substantially same question for Council consideration. unless and until any one of the following has occurred:
i. A motion for reconsideration regarding the Item/Motion has been passed pursuant to Robert’s Rules of Order at the meeting at which the matter was last voted upon or at the next succeeding meeting:
Note: This means that a motion to reconsider may be made only by certain members of the Council. Specifically, a motion to reconsider may be made only by a member who voted in the majority on the original motion. If such a member has a change of heart, he or she may make the motion to reconsider (any other member of the body may second the motion). A motion for reconsideration shall require three (3) votes for approval. If the Motion passes, staff shall briefly summarize any applicable staff report and answer any questions from members and/or the public.

If a member who voted in the minority seeks to make the motion to reconsider, it must be ruled out of order. The purpose of this rule is finality. If a member of the minority could make a motion to reconsider, then the item could be brought back to the body again and again, which would defeat the purpose of finality.
POSTING OF AGENDA FOR REGULAR MEETINGS
The City Clerk shall post an agenda in a location which is freely accessible to the public at least 72 hours before each regular meeting of the City Council.
The City currently posts the Agenda on the bulletin board located at City Hall, 2060 McHenry Avenue, Escalon CA 95320, as well as on the City’s website at www.cityofescalon.org/government/agenda_packets/city_council_agendas_and_minutes.
The City also emails the agenda package to any individual who has requested such.
Note: Emergency Placement of Items on the Agenda.
All agendas of the Council must be posted 72 hours in advance of a regular meeting in accordance with the Brown Act. All agendas of the Council must be posted 24 hours in advance of a special meeting in accordance with the Brown Act. From time to time, the City Manager may present an emergency situation requiring the Council to take action on an item and the situation arose subsequent to the posting of the agenda. These items require a two-thirds vote of the Councilmembers present at the meeting, or, if less than two-thirds of the Councilmembers are present, a unanimous vote of those Councilmembers present, to place an item on the agenda and that the need to take action on this item arose subsequent to the 72 hour posting requirement. Legal Counsel will advise the Council under which circumstances this emergency provision is used pursuant to the Government Code 54954.2.
SPECIAL / EMERGENCY MEETINGS
1. Any special meeting or study session may be called at any time by the Mayor, or a majority of the members of the City Council, or City Manager.
2. The notice for a special meeting shall be posted at least 24 hours prior to the meeting in a location that is freely accessible to members of the public.
3. In the case of an emergency situation involving matters upon which prompt action is necessary due to the disruption or threatened disruption of public facilities, the City Council may hold an emergency meeting without complying with either the 24-hour notice requirement or the 24-hour posting requirement or both of the notice and posting requirements.
4. For the purposes of this section, “emergency situation” means any of the following:
a. Work stoppage or other activity which severely impairs public health, safety or both, as determined by the Mayor, or in the absence of the Mayor, the Mayor Pro Tem, or City Manager, or
b. Crippling disaster which severely impairs public health, safety or both, as determined by the Mayor, or in the absence of the Mayor, the Mayor Pro Tem, or City Manager.

2. Getting the Floor – Improper References. Every To ensure the public can follow the full discussion of the Council, any member desiring to speak shall should try to not to speak over another member. During back and forth discussions, when appropriate, members may address the Chair, and, uponseek recognition by the MayorChair to speak, and should shall should endeavor to confine all remarks to the question under debate, avoiding all personalities personal and indecorous language.
3. Interruptions. A member, once recognized, shall should normally not be interrupted when speaking. unless it be to call said member to order, or as herein otherwise provided. If a member, while speaking, be called to order, said member shall cease speaking until the question of order be determined, and, if in order, he or she shall be permitted to proceed.
4. Time Limit. There is not an set time established guideline that would limit a member’s time in their debate, but each member should try to avoid repeating statements that have already been made that can needlessly extend the time of the debate impacting the public’s ability to follow, understand and participate in the discussion.
5. Privilege of Closing Debate. A Councilmember moving the adoption of an ordinance, resolution, or motion shall have the privilege of closing the debate. This should be made after all councilmembers and the public have had an opportunity to address the issue.
BASIC FORMAT FOR AGENDA ITEM DISCUSSION
To meet Brown Act and open meeting laws, meetings have a written, published agenda. The meeting is governed by the agenda and the agenda constitutes the body’s agreed-upon road map for the meeting. Each agenda item can be handled by the Mayor in the following basic format (but Mayor has discretion to change if necessary):
• The Mayor announces the agenda item number and states the subject. • For each item, the Mayor invites staff or the appropriate people consultant to report on the item, including any recommendation provided.
• The Mayor inquires of the Council if they have questions for staff to help clarify the issue, and if questions are posed, time is given for responses. • The Mayor invites public comments (or opens the public hearing if applicable). If numerous public members desire to speak, the Mayor may impose a uniform time limit for each public speaker. Generally speakers are provided 5 minutes to speak, which is tracked and monitored by the Police Chief or his/her designee. At the conclusion of the public comments, the Mayor announces that public input has concluded (or closes public hearing if applicable).
1. Voting on a Motion. After public input has concluded, it is time for the Council is able to take action, usually in the form of a motion. To initiate a motion, the Mayor and the Councilmembers follow the following format (but Mayor and Council has discretion to change, if necessary):
a. The Mayor invites a motion from the Councilmembers. The Mayor requests a second, if one is not timely given. A second on the motion is required; otherwise the motion dies due to the lack of a second.
b. At the Mayor’s discretion, he or she may invite further discussion of the motion (after seconded) by the Councilmembers.
c. If there is no discussion, the Mayor will call for a vote by requesting that the Councilmembers cast their votes.
d. Councilmembers cast their votes by saying either “yes” or “no”, or by abstaining from the vote. If needed (or otherwise required by law), the city clerk can take a roll call vote to ensure accuracy and clarity of a vote.
e. Once all votes provided, the Mayor or the Clerk will may announce the voting results.
2. How to Initiate a Motion. Motions are generally made using the following process:
a. The Councilmember makes a motion by stating, “I move that…” take a particular action. Example: “I move that we approve the consent calendar.” b. The Mayor may invite or suggest a motion from a Councilmember by stating, “A motion at this time would in order.” or “Is there a second to that motion?” c. If there are 2 motions before the body (e.g., the main motion and a substitute/alternate motion), the Council will act on each motion in the reverse order it was made/seconded.
d. The Mayor has every right as a member of the body to make a motion, but normally should do so only if he or she wishes a motion to be made but no other members seems willing to do so.
3. Basic Motions. Any member including the Mayor may make a motion to take an action, i.e., approving, denying, amending or continuing an item. To be a valid motion, it must be seconded (supported) by another member. If no member seconds (supports) the motion, the motion dies due to lack of a second. Most motions require only a majority vote of those Councilmembers present.
3. Two most common motions:
a. The basic motion. The basic motion is the one that puts forward a decision for consideration. A basic motion might be: “I move that we approve the annual report.”
b. The motion to amend. The following is general guidance for motions to amend. If a member wants to amend/change a basic motion that is under discussion, s/he needs to ask if the amendment to the motion is acceptable by the motion maker. The Mayor then asks if the amendment to the motion is acceptable by the motion maker.
b.
i. If the maker of the motion accepts the amendment, the second to the motion also needs to accept the amendment to the motion before a vote is taken.
ii. If the maker of the motion does not accept the amendment to the motion, the original motion stands, and a vote taken on the original motion, unless there is a first and second on a motion to amend the main motion. If there is, the motion to amend will be voted on first before returning to the main motion.
ii. .
4. Debatable vs. Non-Debatable Motions. The basic rule of motions is that they are subject to full discussion and debate. The debate can continue as long as Councilmembers wish to discuss an item, subject to the decision of the Mayor that it is time to move on and take action.
There are exceptions to the general rule of free and open debate on motions. a. Non-debatable Motions Requiring Simple Majority Vote i. A motion to adjourn. If the agenda has been completed in totality, the Mayor can adjourn the meeting without a motion. If during the meeting anyone makes a motion to Formatted: Font: Bold, No underline

adjourn the meeting and it passes, the Council is required to immediately adjourn to its next regularly scheduled meeting.
ii. A motion to recess. If passed, requires the body to immediately take a recess.
Normally, the Mayor determines the length of the recess. iii. A motion to table. If passed, requires discussion of the agenda item to be halted and the agenda item to be placed on “hold” with or without a time frame or tabled entirely. b. Non-debatable Motion Requiring 2/3 Vote.
i. A motion to limit debate. The most common form of this motion is to say: “I call for the question.” When a member makes such a motion, the member is in effect indicating: There has been enough debate and the Council should proceed with the vote. ii. Motion to object to the consideration of a question. When a Councilmember does not want an item on the agenda to be considered, then such a motion is in order.
4. Other Motions Requiring Super-Majority or 2/3 Votes. Most motions require only a simple majority but there are a few exceptions under state law that the City Attorney should inform the Council of prior to voting on any item.
5. The exceptions occur when the body is taking an action that effectively cuts off the ability of a minority of the body to take an action or discuss an item. These extraordinary motions require a two-thirds majority (a super-majority) to pass:
a. Motion to suspend the rules. This motion is debatable, but requires a two-thirds vote to pass. If the body has its own rules of order, conduct or procedure, this motion allows the body to suspend the rules for a particular purpose. b. Motion to add an item to the agenda due to an emergency. All agendas of the Council must be posted 72 hours in advance of a meeting in accordance with the Brown Act.
Special meetings must be posted 24 hours in advance. From time to time, the City Manager may present an emergency situation requiring the Council to take action on an item and the situation arose subsequent to the posting of the agenda. These items require a 2/3 vote of the Councilmembers present at the meeting, or if less than 2/3 of the Councilmembers are present, a unanimous vote of those Councilmembers present, to place an item on the agenda and that the need to take action on this item arose subsequent to the 72-hour posting requirement. Legal Counsel will advise the Council under which circumstances this emergency provision is used pursuant to the Government Code 54954.2.
6.5. Withdraw a Motion. During debate and discussion of a motion, the maker of the motion, at any time, may interrupt a speaker to withdraw his or her motion. The motion is immediately deemed withdrawn, although the Mayor may ask the person who seconded the motion if he or she wishes to make the motion, and any other member Formatted: Indent: Left: 1.25", Space After: 10 pt, Line spacing: Multiple 1.15 li

To ensure the speaker is granted a full, uninterrupted five minutes, Councilmembers may respond or question the person addressing the Council at the conclusion of the public member’s comments or upon expiration of the person’s time limit to speak if one has been imposed. Councilmembers must confine communications to a question-and-answer format conducted through the Mayor.
The Mayor should always ensure that debate and discussion of an agenda item focus on the item and the policy in question, not on any matter pertaining to an individual.
Debate on policy is healthy and welcomesd; comments about individuals is are not.
The Mayor has the right to cut off discussion that is too personal, too loud or too crude.
Once the individual has finished his/her comments or time has expired and Councilmembers have no questions, the Mayor is to request the individual returns to his or her seat in the audience.
Items From Audience. During this portion of the Council agenda, citizens may comment on any subject within the jurisdiction of the City Council for items not on the Agenda. A time limit may be imposed for this comment opportunity (generally 5 minutes). The Brown Act prohibits dialogue with the City Council on items not on the published agenda, therefore, this is not a time for discussion with the Council is limited regarding these subjects not on the Agenda for this meeting. If additional discussion or action is required, it would be appropriate for the Mayor to request the individual to meet with the City Manager, or his/her designee, on the issue.
4. Public Hearings and protests, etc. Persons may address the Council by reading protests, petitions, or communications, hearings on protests, appeals and petitions, or similar matters, in regard to matters then under consideration.

No qQuestion shall should be asked directly=directed to the chair of the meetingan individual Councilmember or staff except through the Mayor. The Mayor Chair has the discretion to impose time limits for comments from the public (generally 5 minutes), but may also waive this limitation when deemed necessary to more fully accommodate a request to be heard, provided all speakers on that item are afforded the same time period.
6. .
7. Resident Agenda Request Items Requests. As outlined in this Handbook, any resident who requests an agenda item, which is subsequently approved by the Council, is able to introduce that timeitem, generally being provided 5 minutes for this introduction. All items before Council are the purview of City Sstaff’s or a partner agency’s, and therefore should primarily be presented by City staff.

b. Call for order. If a member believes that the body has drifted from the agreed upon agenda item, the member may Call for Order. This action does not require a vote, and when the Mayor discovers that the agenda has not been followed, the Mayor reminds the body to return to the agenda item properly. After the City Council considers an individual’s Councilmember’s request, the City Council may take action to direct the City Manager to prepare the appropriate action for the City Council’s consideration.
2. Approval by administrative staff. All ordinances, resolutions and contract documents shall, before presentation to the Council, have been approved as to form by the City Attorney or his or her authorized representative, and shall have been examined and approved for the administration by the City Manager or his or her authorized representative, where there are substantive matters of administration involved.

The terms of the ad-hoc committees shall not exceed one year unless reestablished or extended by resolution of the Council.
MANDATED REQUIREMENTS OF ELECTED OFFICIALS – FAIR POLITICAL PRACTICES COMMISSION
1. Economic Interest Statements – Form 700. The Fair Political Practices Commission (FPPC) Form 700 is used by individuals who make or participate in government decisions that could affect their personal financial interests. City Councilmembers are designated as “code filers”, and are required to file Form 700 to satisfy provisions under the Political Reform Act. New Councilmembers must file these statements within 30 days of taking office. Annual statements are due April 1 of each year. Councilmembers will be notified of upcoming filing deadlines. This form is filed with the City Clerk’s Office through the electronic filing system.
2. Campaign Statements. Form 460, Recipient Committee Campaign Statement is used by an officeholder who has a controlled committee, or who has raised or spent or will raise or spend $2,000 or more during a calendar year in connection with holding office. This form is used to file a semi-annual statement. This form is filed with the City Clerk’s Office.
3. Ethics Training. State Assembly Bill 1234 (AB 1234) requires Councilmembers to take Ethics Training because of the compensation received for service or the reimbursement received for expenses. Councilmembers are required to take training no later than one year from the first day of service. A refresher training is required every two years thereafter.
A free online ethics training course is available at: http://localethics.fppc.ca.gov.
Upon completion of the online course, a Public Service Ethics Education Online Proof of Participation Certificate is issued, which must be signed and the original Certificate filed with the City Clerk.
If taking advantage of the online training course, make sure to stay online for the entire 2-hour course, or this training will not satisfy the requirement.
Training is also available through the League of California Cities City Councilmember conferences. A Proof of Participation Certificate will be issued at the end of the training and should be filed with the City Clerk.
COUNCIL COMMUNICATION
1. Communicating with the public. It can be important for Councilmembers to communicate with the public. This allows Councilmembers to understand the issues of the community and to hear about issues, concerns, or positive views from their constituents. It also allows an opportunity for a Councilmember to provide information
on an issue the resident may not be aware of or how to get additional information.
When communicating with a resident, below are some principles to keep in mind:
a. Do not make personal comments or promises on behalf of the City because only the City Council can commit to an action or policy.
b. Often there is a fair amount of background to an issue, so try to refrain from providing input until you are comfortable that all sides of the issue are known. c. If an issue is raised by a resident that is not related to a policy, but rather an operational issue, direct them to the City Manager.
d. If the issue raised is a policy issue, the Councilmember can discuss options to address with the City Manager, request a designated committee discuss the issue and make a recommendation to the City Council, or add to a future City Council agenda for discussion.
e. During discussions on a policy of the City Council, when on the dissenting side of issue, it is best to clarify your view while supporting the adopted City Council policy.
e.
2. Communicating with other agencies. At times, a Councilmember may attend a public meeting of another agency as a representative of the City Council. During such times, please advise:
a. Speak to issues as approved by the City Council and do not deviate from the approved message or position.
b. If the City Council has not yet taken a position on an issue, clearly state that any comments are a single councilmember’s opinion.
c. Learn about and understand the interests and needs of the other agency. d. Keep communication professional and civil, and always show other agencies the same respect you hope to receive in return.
3. Communicating with Developers/Applicants. The Escalon Municipal Code outlines the process for considering the various applications submitted to the City. Some of these processes give staff the authority to approve an application if the applicant meets certain criteria defined in the Escalon Municipal Code. Other applications require approvals from the Planning Commission and/or the City Council. In these instances when the City Council provides the final approval of an application, the applicant may request to meet with City Councilmembers individually to discuss the application.
Below are some principles to keep in mind:
a. These meetings are not mandatory; if a Councilmember prefers not to meet, he or she can explain they are part of the approval process and prefers not to discuss the project outside of a public meeting.

between paragraphs of the same style, Numbered +
Level: 2 + Numbering Style: a, b, c, … + Start at: 1 +
Alignment: Left + Aligned at: 0.75" + Indent at: 1"
b. If a Councilmember chooses to meet with an applicant, which is perfectly acceptable, it is important for the Council to remember they are one member of a five member Council and they should not speak for the Council or commit to a position prior to the full completion of the approval process. Any information they learn in that private meeting is required to be disclosed at the public hearing.
4. Communicating with City Staff. The City’s success in accomplishing its mission is partly due to the direct and regular access between the City Manager, City Attorney and Councilmembers. This helps because decisions are made in real time. However, even with real-time communications, there are times when a Councilmember needs additional information. Councilmembers are encouraged to seek additional input and information as necessary from the City Manager or City Attorney to make informed decisions. When discussing these matters, please keep in mind the following principles:
a. Take any information as work in progress. Very often, there are differences of opinion among staff as an issue is vetted prior to being presented to the City Council.
b. Request information judiciously to avoid overwhelming the City Manager and City Attorney, but feel free to gather all information necessary to make an informed decision.
5. Speaking as a Private Individual. If a Councilmember attends a public gathering and is asked to speak, the following is important to consider in your comments:
a. Clearly state your comments are yours, as a private citizen. b. Keep in mind that even when you are speaking as a private individual, the audience may hear your comments as a Councilmember.
c. Avoid personal statements that conflict with approved policy and clearly state when your personal opinions deviate from City Council policy as determined by the City Council majority.
d. If you speak on an issue not related to the Escalon City Council, make it clear that your remarks are solely your own, not the position of the Escalon City Council.
6. Communicating with the Media. If you choose to talk with the media, the following practices can help you present your thoughts effectively:
a. Schedule a time to talk, do not try to provide an interview without putting together talking points for the interview. Contact the City Manager to ensure you are fully briefed on the facts associated with the topic. b. Feel free to contact the City Manager to prepare talking points and other information that may be useful for the interview.
c. If you do not choose to provide an interview, you may direct them to the the City Manager rather than saying, “no comment”.
d. If you communicate with the media before you vote on a matter, you can inadvertently become a party to a serial meeting in conflict with the Brown Act by sharing your position on a matter before the City Council.
7. Communicating Electronically. This includes all emails, text messages, social media posts, and other electronic communications that could be considered public record and are subject to disclosure under the Public Records Act. The following are some items to consider when communicating electronically:
a. Electronic communications are potentially discoverable if legal proceedings are involved.
b. Electronic communications are retrievable even if you delete from your display. c. When you are communicating with an individual, it may be better to communicate in person rather through electronic communication, to avoid misinterpretation which is more likely through electronic communication. d. Feel free to contact the City Manager for assistance in drafting a response to an email.

The City Council is the governing body of the municipality. All powers of the City shall be vested in the Council, subject to the provisions of the Municipal Code and the Council-Manager form of government under State law, and the Constitutions of the State of California of the United States.
Role of the City Council
Based upon the Escalon Municipal Code and applicable state and federal law, Councilmembers serve in a variety of ways, depending on the nature of the matter. When adopting, revising, amending or repealing city-wide land use programs and policies, as well as General Plan and zoning, the Council performs a legislative function. When considering the approval,
modification, revocation or denial of individual land use permit (conditional use permits, subdivision maps, Site Plans, etc.), the Council acts in an adjudicatory capacity.
The City Council is made up of five (5) members that are elected at large. One of the members will serve as Mayor, and another as Mayor Pro Tem. The positions of Mayor and Mayor Pro Tem generally rotate biennially, upon selection of the Council. Unless precluded from voting by a conflict of interest, each member should generally not abstain as each has the right and duty as an elected representative to vote on all matters coming before the Council. If a Councilmember believes he or she might have a conflict of interest on an item before the City Council that Councilmember should discuss the conflict with the City Attorney or, in some cases, obtain a legal opinion from the Fair Political Practices Commission (FPPC). Potential conflicts of interest can stem from many different sources (i.e. business relationships, sources of income, etc). If it is determined a conflict exists, the Councilmember must:
i. Remove himself/herself from any participation in the matter once the conflict becomes apparent;
If a vacancy occurs on the City Council, the City Council must within sixty (60) days of the commencement of the vacancy either 1) appoint a new Councilmember , or 2) call a special election to fill the vacancy. The filling of a vacancy on the City Council shall comply with the process set forth in Government Code section 36512
All current and future City Councils should endeavor to use a fair, open, and transparent process with the purpose of yielding qualified individuals to fill the vacancy by appointment.
The recommended steps of this appointment process are outlined below:
• At a regularly scheduled City Council meeting, City Council would approve the application and direct staff to open a designated application period. The advertisement of the application period may include a public notice in the local newspaper, and should, at minimum, be posted on the City’s website and social media platforms. • After the application period has closed, the Council should hold a regular or special meeting to review the submitted applications, and conduct applicant interviews. • At the same meeting interviews are conducted, or at a subsequent regular or special meeting of the City Council, and the Council shall appoint, via majority vote, the individual to assume the vacant Council seat.
COMPENSATION
Each member of the City Council receives a monthly salary no greater than the maximum amounts specified in Section 36516(a)(2) of the California Government Code, based on the population of the City, as adopted and approved by the City Council, and as may be amended by the Council from time to time.
The current rate as of 2025, which was last updated in ____, is $300 per month.
REGULAR MEETINGS
1. Meeting Time and Schedule. The Council will hold regular business meetings twice a month on the first and third Monday of the month at 7:00 p.m., unless otherwise amended, or unless the regular meeting date falls on a recognized Federal holiday, which the City also recognizes; provided, however, that any such regular meeting at which a closed session is to be held may be commenced for the holding of such closed session at an earlier time on the meeting day as may be noticed on the Council’s agenda and posted at least 72 hours in advance of such earlier commencement time.
3. Agenda.
a. The Council is prohibited from taking action on any item not appearing on the posted agenda unless:
i. A City Council majority determines that an “emergency situation” exists; or ii. The City Council determines by a two-thirds vote, or by a unanimous vote if less than two-thirds of the members are present, that there is a need to take immediate action and that the need for action came to the attention of the body subsequent to the posting of the agenda; or
iii. The item was included in a properly posted agenda for a prior meeting occurring not more than five (5) days prior to the meeting at which the action is taken and was continued to the meeting at which the action is taken.
b. The City Manager will use his or her discretion to determine which items should be placed on the consent agenda.
Therefore, the City Council adopted the following policy for Councilmember to request an item be placed on the agenda:
After the staff report is prepared, the items would be placed on the City Council agenda for Council’s
consideration.
The request will be presented during a council meeting for Council’s consideration. If the item receives majority support, the item will proceed to a future agenda as outlined above. The item then becomes a staff item, and is presented to the Council by staff. However, the requesting resident will have an opportunity to briefly introduce the item in a time allotted by the Mayor, but in no case greater than 5 minutes, in addition to any public comment rights that resident may otherwise have.
GENERALLY, THE CITY COUNCIL SHOULD ENDEAVOR THAT, OTHER THAN FOR
LEGALLY REQUIRED SECOND READINGS, ANY AGENDA ITEM/MOTION THAT HAS
BEEN VOTED UPON AT A COUNCIL MEETING APPEAR ON THE AGENDA AGAIN TO
PRESENT THE SAME OR SUBSTANTIALLY SAME QUESTION FOR COUNCIL CONSIDERATION.
SPECIAL / EMERGENCY MEETINGS
1. Any special meeting may be called at any time by the Mayor, or a majority of the members of the City Council, or City Manager.
PROCEDURE AT COUNCIL MEETINGS
1. Call to order. The Mayor, or, in his or her absence, the Mayor Pro Tem, shall take the chair at the hour appointed for the meeting, and shall call the Council to order. In the absence of the Mayor and the Mayor Pro Tem, the City Clerk, or his or her deputy, shall call the Council to order, whereupon a temporary chairperson shall be elected by the members of the Council present. Upon the arrival of the Mayor or Mayor Pro Tem, the temporary chairperson shall relinquish the chair upon the conclusion of the business immediately before the Council.
2. Roll call. Before proceeding with the business of the Council, the City Clerk or his or her deputy shall call the roll of the members, and the names of those present shall be entered in the minutes.
3. Quorum. A majority of all the members elected to the Council shall constitute a quorum at any regular or special meeting or study session of the Council.
4. Order of business. All meetings of the Council shall be open to the public, except for closed sessions as permitted by law. The agenda shall outline the order of business for regular meetings of the Council, and shall provide therein for public comment as
required by law. In attendance shall be the City Manager, the City Clerk, and the City Attorney or their authorized designees.
5. Reading of minutes. A reading of the minutes may be dispensed with provided that the Clerk has previously furnished each member with a synopsis thereof with the published agenda. The minutes, which are provided in agenda packages, are considered as part of the Consent Calendar.
6. Adjournment. The Mayor, or, in his or her absence the Mayor Pro Tem, or appointed chairperson, shall adjourn the meeting as allowed by law.
RULES OF DEBATE
1. Mayor May Debate and Vote. The Mayor or Mayor Pro Tem or such other member of the Council as may be presiding may move, second, and debate from the Chair, and shall not be deprived of any of these rights and privileges of a Councilmember by reason of acting as the Mayor or Mayor Pro Tem, as the case may be.
2. Getting the Floor. To ensure the public can follow the full discussion of the Council, any member desiring to speak should try not to speak over another member. During back and forth discussions, when appropriate, members may seek recognition by the Chair to speak, and should endeavor to confine all remarks to the question under debate, avoiding all personal and indecorous language.
3. Interruptions. A member, once recognized, should normally not be interrupted when speaking.
4. Time Limit. There is not anestablished guideline that would limit a member’s time in their debate, but each member should try to avoid repeating statements that have already been made that can needlessly extend the time of the debate impacting the public’s ability to follow, understand and participate in the discussion.
• For each item, the Mayor invites staff or the appropriate consultant to report on the item, including any recommendation provided.
After public input has concluded, the Council is able to take action, usually in the form of a motion.
If needed (or otherwise required by law), the city clerk can take a roll call vote to ensure accuracy and clarity of a vote.
e. Once all votes provided, the Mayor or the Clerk may announce the voting results.
2. How to Initiate a Motion. Motions are generally made using the following process:
a. The Councilmember makes a motion by stating, “I move that…” take a particular action. Example: “I move that we approve the consent calendar.” b. The Mayor may invite or suggest a motion from a Councilmember by stating, “A motion at this time would in order” or “Is there a second to that motion?” c. If there are 2 motions before the body (e.g., the main motion and a substitute/alternate motion), the Council will act on each motion in the reverse order it was made.
3. Basic Motions. Two most common motions:
a. The basic motion. The basic motion is the one that puts forward a decision for consideration. A basic motion might be: “I move that we approve the annual report.”
b. The motion to amend. The following is general guidance for motions to amend. If a member wants to amend/change a basic motion that is under discussion, s/he needs to ask if the amendment to the motion is acceptable by the motion maker.
4. Other Motions Requiring Super-Majority or 2/3 Votes. Most motions require only a simple majority but there are a few exceptions under state law that the City Attorney should inform the Council of prior to voting on any item.
5. Withdraw a Motion. During debate and discussion of a motion, the maker of the motion, may not withdraw the motion if it has been first and seconded, unless the majority of the body consents to such withdrawal.
6. Tie Votes. Any time there is a tie vote of those Councilmembers present, the motion fails.
ADDRESSING THE COUNCIL
1. Any person desiring to address the Council should first seek to secure the permission of the Mayor to do so, provided, however, that the request is being made at the appropriate time in the agenda, during Items from Audience pertaining to matters within Council’s purview, but not on the published Agenda, or as part of the discussion.
The Mayor should not deny the right of any qualified and interested person from addressing the Council.
2. Written Communications. Interested parties or their authorized representatives may address the Council by written communications in regard to matters then under discussion.
3. Oral Communications.
a. Persons may address the Council by oral communications on any item on the agenda. Speakers may approach the podium to address the Council. To ensure all members of the public have an opportunity to speak, and so as not to extend any discussion needlessly, in order to ensure the public can without undue difficulty follow the discussion, the Mayor may impose a time limit for public comments (generally 5 minutes).
To ensure the speaker is granted a full, uninterrupted five minutes, Councilmembers may respond or question the person addressing the Council at the conclusion of the public member’s comments or upon expiration of the person’s time limit to speak if one has been imposed.
The Mayor should ensure that debate and discussion of an agenda item focus on the item and the policy in question. Debate on policy is healthy and welcomed; comments about individuals are not.
Items From Audience. During this portion of the Council agenda, citizens may comment on any subject within the jurisdiction of the City Council for items not on the Agenda. A time limit may be imposed for this comment opportunity (generally 5 minutes). The Brown Act prohibits dialogue with the City Council on items not on the published agenda, therefore, discussion with the Council is limited regarding these subjects.
5. Addressing the Council After Motion is Made. After a motion is made by the Council, no person should address the Council without first securing the permission of the Mayor to do so.
6. Manner of Addressing Council – Time Limit. At the Mayor’s discretion, persons addressing the Council should proceed to the podium to address the Council. The individual has the option (but not the obligation) of stating their name and address for the record. All remarks should be addressed to the Council as a body and not to any member thereof or to City staff or other members of the public. Persons, other than the Council and the person who has the floor, are generally not permitted to enter into the discussion, either directly or through a member of the Council, without the permission
of the Mayor. Question should be directed to the chair of the meeting. The Chair has the discretion to impose time limits for comments from the public (generally 5 minutes), but may also waive this limitation when deemed necessary to more fully accommodate a request to be heard, provided all speakers on that item are afforded the same time period.
7. Resident Agenda Item Requests. As outlined in this Handbook, any resident who requests an agenda item, which is subsequently approved by the Council, is able to introduce that item, generally being provided 5 minutes for this introduction. All items before Council are the purview of City staff, and therefore should primarily be presented by City staff.
DECORUM
Councilmembers comprise the City Council, the governing body of the City. Each member represents the residents and therefore should respect the public, city staff and each other.
Members should not disparage each other, prior actions taken, staff or the public.
1. By Councilmembers. While the Council is in session, the members should preserve order and decorum, and therefore, a member should neither, by conversation or otherwise, delay or interrupt the proceedings or the peace of the Council, use personal, impertinent, or slanderous remarks, nor disturb any member while speaking or refuse to obey the orders of the Council or the Mayor, except as otherwise herein provided.
Councilmembers should endeavor to not speak twice unless all other members have had an opportunity to speak.
2. By City Staff. City staff should not engage in dialogue with public members during public meetings, or respond directly to questions from the public. All staff responses should be directed to the City Council. City staff shall give professional and balanced staff reports.
3. Persons addressing the Council. Persons who address the Council are encouraged not to make slanderous or profane remarks to any member of the Council, staff or general public. Persons who disrupt the meeting, or utter threats of violence or who engage in any other conduct which disrupts, disturbs or otherwise impedes the orderly conduct of a Council meeting may be subject to removal from the meeting. The same goes for audience members who are not, or have not, addressed the Council.
4. When a Speaker may be Interrupted. Debate and discussion should be focused, but free and open. In the interest of time, the Mayor may, however, limit the time allotted to speakers (generally 5 minutes). Councilmembers should endeavor to not interrupt a Councilmember speaking on an item, but if necessary should occur under one of the following scenarios:
a. Order. A councilmember may ask for a “Point of order.” Points of order pertain to anything that would not be considered appropriate conduct of the meeting; for example, if the Mayor moved on to a vote on a without receiving a second for that motion.
b. Appeal. If the Mayor makes a ruling that a member of the body disagrees with, that member may appeal the ruling of the Mayor. If the motion is seconded and after debate, if it passes by a simple majority vote, then the ruling of the Mayor is deemed reversed.
COUNCIL MEETING AGENDAS AND ACCESS
1. City Council meetings video streamed and broadcast live. Most meetings of the City Council and all Regular meetings are video streamed and broadcast live. The video stream may be accessed via the City’s YouTube page.
2. Agendas. City Council agendas are posted at least 72 hours in advance of Regular meetings with a goal of posting by Thursday at noon and shared with Council prior to a Council meeting via email. City Council agendas are posted 24 hours before Special meetings.
3. Questions regarding the agenda. If an individual Councilmember has questions regarding the agenda, he or she is encouraged to contact the City Manager through email, phone call, or an in-person meeting to get answers to his or her questions, prior to the City Council meeting. The same arrangement is available for members of the public.

It also allows an opportunity for a Councilmember to provide information on an issue the resident may not be aware of or how to get additional information.
Below are some principles to keep in mind:
a. These meetings are not mandatory; if a Councilmember prefers not to meet, he or she can explain they are part of the approval process and prefers not to discuss the project outside of a public meeting.

ITEM NO. 9
COUNCIL AGENDA ITEM
FOR NOVEMBER 3, 2025
Prepared By: Celinda Bickner, Finance Director and HR Administrator Date: October 27, 2025
Subject: Consider Approving the Associate Planner Job Description, Confirming the Classification and Compensation Plan to add an Associate Planner Position, and Affirming the Salary Range
Recommendation:
Adopt Resolution xx-25, approving the Associate Planner job description, confirming the Classification and Compensation Plan to add an Associate Planner, and affirming the salary range.
Strategic Plan Priority:
This item is not directly applicable to a Strategic Priority of the adopted Escalon 2025-2026 Strategic Plan.
Background Information:
The City, in its efforts to review, adjust, right size and correct various policies, personnel issues, processes and procedures is reassessing existing positions and the employee dynamic within those positions to determine if any changes to positions are appropriate. Management has determined that establishing greater flexibility for the Planner class is beneficial for the Department.
The current Assistant Planner is working at a higher level than the current job description, and therefore, this item is to follow up on the process started in the current budget to establish the professional Planner as a two-step class as approved for the Maintenance Workers (I, II, and III), Accounting Technician (I and II), Police Officer (I and II), and Recreation Assistant (I and II) positions. This item seeks approval of the Associate Planner job description (Attachment 2), confirms the addition of the Associate Planner position as outlined in the Classification and Compensation Plan (Attachment 3) adopted on June 20, 2025, as part of the FY 25-26 Budget. This action provides the City with optimal flexibility to hire a planner at various skill levels based on the City’s needs, the market or current budget.
Fiscal Impact:
There is no direct impact on the General Fund by adding this position to the professional class.
However, if approved, the City would elevate the current Assistant Planner to the Associate Planner level and therefore, there would be an approximately 10% increase for this salary and a nominal increase to the overall approved budget.

ITEM NO. 10
COUNCIL AGENDA ITEM
FOR NOVEMBER 3, 2025
Prepared By: Frank Splendorio, City Attorney
Date: October 27, 2025
Subject: Consider Adopting the First Amendment to City Manager’s Employment Agreement and Approving Update to City Salary Schedule
Recommendation:
Approve the attached First Amendment to Employment Agreement making certain changes to the City Manager’s condition of employment and approve a revised City Salary Schedule.
Strategic Plan Priority:
This item is not directly applicable to a Strategic Priority of the adopted Escalon 2025-2026 Strategic Plan.
Background Information:
In recognition of the excellent annual performance review, it is recommended to extend the City Manager’s Employment Agreement term a further year to November 3, 2030, to adjust the salary by 5%, to increase the deferred compensation match, and to provide an additional 20 hours of administrative leave.
Since the City Manager’s salary is set at the contract amount in the approved salary schedule, an adjustment to the City Manager’s employment agreement requires approval of an updated City Salary Schedule.
Fiscal Impact:
The costs associated with the First Amendment are within the Council-approved budget for the City Manager position.
Attachments:

2. City of Escalon Salary Schedule, revised as of November 3, 2025

CITY OF ESCALON
FIRST AMENDMENT TO EMPLOYMENT AGREEMENT AS CITY MANAGER This First Amendment to Employment Agreement ("Agreement") is made and entered into by and between the City of Escalon (the "City"), a California municipal corporation, and Jaylen French ("Employee") an individual, both of whom agree as follows:
RECITALS
WHEREAS, the City and Manager entered into an employment agreement ("Original Agreement") on October 8, 2024, to employ and appoint Employee as City Manager; and WHEREAS, the City and Employee desire to amend Section 4.1 of the Original Agreement to extend the term of employment to November 3, 2030; and WHEREAS, the City and Employee desire to amend the Original Agreement to adjust Employee’s base salary by 5%, adjust Employee’s 457B Plan deferred compensation match to 4% (2% above the deferred compensation match provided under the City’s Personnel System Rules and Regulations), increase Employee’s entitlement to administrative leave by 20 hours, and in case of separation without cause, provide severance payout of seven (7) months of base salary; and
WHEREAS, no other changes or modifications are requested and the Original Agreement shall otherwise remain in full force and legal effect.
1. Section 4.1 of the Original Agreement is deleted in its entirety and replaced as follows:
“4.1 Manager's employment will commence effective October 8, 2024 ("Effective Date") and shall continue in effect until November 3, 2030, or the date of earlier termination in accordance with provisions of this Agreement.”
2. Section 7.1 of the Original Agreement is deleted in its entirety and replaced as follows:
“Manager will be compensated for his services as of the date of execution of this Agreement at an annual base salary of $160,402. Said amount shall be payable at the same time and in the same manner as other employees of the City are paid.
3. Section 7.2 of the Original Agreement is deleted in its entirety and replaced as follows:
“City shall provide Manager with benefits consistent with the City's Personnel System Rules and Regulation (non-sworn, exempt), except as otherwise stated herein.
Manager shall receive an additional 2% deferred compensation match paid to Manager’s 457B Plan (relative to the match contemplated in the City’s Personnel System Rules and Regulations), for a total of 4%. Manager shall be entitled to 120 hours of annual administrative leave each fiscal year (and shall be provided with a full balance of 120 hours upon the Effective Date of this Agreement). Thereafter, 120 hours will be provided on July 1st of each calendar year. Manager may elect to receive cash payment at his regular salary rate for any

portion of administrative leave (Manager is not required to maintain a minimum balance of administrative leave). In accordance with section 8.18 of the City's Personnel Rules and Regulations, Manager may elect this option by December 31 of each year for the cash payment to be made in the following calendar year. The cash out election is irrevocable, and the City will follow IRS regulations regarding cash payment of administrative leave.”
4. Except as otherwise amended by this First Amendment, the Original Agreement shall remain in full force and effect and is otherwise not modified, changed or revised.
IN WITNESS WHEREOF, the City has caused this First Amendment to be signed and executed on its behalf by its Mayor and duly attested by its City Clerk, and Employee has signed and executed this Agreement, on the day and year written below.
Approved this 3rd day of November 2025:
