COUNCIL AGENDA ITEM
FOR DECEMBER 1, 2025
Prepared By: Jaylen French, City Manager
Date: November 24, 2025
Subject: Discussion and Direction Regarding Initiation of a Proposition 218 Balloting Process to Add Amenities and Increase the Westwood Country Landscape and Lighting Maintenance District’s Assessment Level Per Resident Request Recommendation:

Discussion and direction regarding initiation of a Proposition 218 balloting process to add amenities to, and increase the Westwood Country Landscape and Lighting Maintenance District’s assessment level per resident request.

Strategic Plan Priority:

This item is not directly applicable to a Strategic Priority of the adopted Escalon 2025-2026 Strategic Plan.

Background Information:

At the August 4, 2025 Escalon City Council meeting, Resident Robert Perata addressed the Council requesting that a swing set be added to Swanson Park and generally to the Westwood Country LLMD.

He noted strong neighborhood support for the improvement and expressed interest in collaborating with the City and district residents to fund installation and long-term maintenance.

Since that time, the City has coordinated with Mr. Perata to explore installing a half court basketball court in addition to the swing set. Recently, Mr. Perata agreed that this would be a good idea and believed there would be support in the community based on his couple of conversations with neighbors.

Discussion:

Per the Westwood Country Landscape and Lighting Maintenance District Fiscal Year 2025-2026 Final Engineer’s Report (page 3)
“Improvements and Services Provided
The following are the specific improvements which are maintained and serviced within the District:
- A 6-foot masonry wall on the property line along the east side of Swanson Park.

Page 29 of 37 ends

- Graffiti abatement on masonry walls within Swanson Park, on the McHenry Avenue commercial lots and the Burlington, Northern Santa Fe (“BNSF”) Railway. - Street trees along McHenry Avenue from north to south, along property line of the development. - 38 streetlights located throughout the interior and exterior of the tract. - Street trees along interior streets of the tract.
- Wood fence along southern boundary of the District on Countrywood Lane. - Utility costs for lighting and landscaping systems.
- Landscaping improvements inside Swanson Park.
- Playground equipment (added in Fiscal Year 2012).
- Benches, trash cans and other amenities (added in Fiscal Year 2012). - Chain link fencing around pump station at Swanson Park.1 If approved by the property owners in the District, per a formal Proposition 218 balloting process, as outlined below, a swing set and a half-court, concrete basketball court would be added to the list of improvements in the District.

This District has a history of such actions. In Fiscal Year 2012, the City conducted a Proposition 218 assessment ballot procedure, in which the property owners approved playground equipment, benches, trash cans and related amenities.

The District’s current assessment level is $304.10 per residential property. The maximum assessment level is currently at $352.37.

Any direction given as part of this item is a first step in the overall process, and this item seeks Council direction to initiate the Proposition 218 assessment ballot process. Should the City Council direct staff to begin the process to consider added amenities in the Westwood Country LLMD and thus an increased assessment level, a ballot will be mailed to all property owners within the District; the City will determine the budget for the next 20 years; prepare necessary reports; perform community outreach; and hold a public hearing.

Notice, protest, and hearing requirements for new, extended, or increased assessments levied on real property are governed by Proposition 218 (Cal Const art XIIID, §§4 and 5).

After making any necessary changes to the engineer’s report and other required work and approvals prior to imposing the assessments. A 45-day notice of a public hearing is required, which continues to the conclusion of the public hearing, and accompanied by assessment ballots to all assessed property owners by which each such owner may express support for or opposition to the assessment proposed to be levied on their property.

After the conclusion of the public hearing, all assessment ballots are tabulated by an impartial person and the presence or absence of a majority protest is determined. (Cal Const art XIIID, §4(c)–(e); Govt C §53753.) A majority protest exists if the ballots submitted in opposition to the assessment exceed the ballots in favor. The ballots are weighted according to the proportional financial obligation of each property owner. (Cal Const art XIIID, §4(e); Govt C §53753.) 1 Chain link fencing around the pump station was installed as part of the development and should have been included with the other improvement items at the time of formation.

Page 30 of 37 ends

After complying with the notice, protest, and hearing requirements, and if a majority protest is not received from the property owners, the legislative body may adopt a resolution to establish the assessment and levy the assessment.

Fiscal Impact:

This action and any subsequent efforts by the City would be cost neutral to the General Fund as all costs associated with the Proposition 218 assessment ballot effort and subsequent efforts would be funded by the District.

COUNCIL AGENDA ITEM
FOR DECEMBER 1, 2025
Prepared By: Jaylen French, City Manager
Date: November 24, 2025
Subject: Agenda Item Request to Consider Ordinance Restricting Use of Fluoride in City Water Treatment Processes and Restricting Acceptance of Water from Outside Source Treated with Fluoride
Recommendation:

Consider Agenda Item Request from Mayor Hagan, supported by Councilmember Kay, consider Ordinance restricting use of Fluoride in city water treatment processes, and restricting acceptance of water from outside source treated with Fluoride.

Strategic Plan Priority:

This item is not directly applicable to a Strategic Priority of the adopted Escalon 2025-2026 Strategic Plan.

Background Information:

Mayor Hagan submitted an Agenda Item Request Form on October 27, 2025 with support from Councilmember Kay “To ban the use of Fluoride from being used in Escalon water; and to prohibit receipt of Fluoride treated water (surface or other) from outside entity.” This item will introduce the topic and seek full council direction. If directed by the Council to move forward, the City would likely draft an ordinance outlining the restriction on treating city water with Fluoride and prohibition on receiving water from an outside entity treated with Fluoride. If, in the event that the City were in an existing agreement to receive treated water from an outside entity and said outside entity began to treat water with Fluoride, the Ordinance could specify that the Council shall automatically and at that time review the current matter as it pertains to this Ordinance and the full scope of the situation.

Fiscal Impact:

There is no direct fiscal impact associated with banning a treatment substance in City water or received water.

ITEM NO. 7

COUNCIL AGENDA ITEM
FOR DECEMBER 1, 2025
Prepared By: Jaylen French, City Manager
Date: November 25, 2025
Subject: Resident Agenda Item Request by Escalon Little League for Use of Hogan Park for Two Years at No Cost and Use of City Equipment Recommendation:

Consider a resident Agenda Item Request from the Escalon Little League for the use of Hogan Park for two years at no cost as well as use of City equipment.

Strategic Plan Priority:

This item is not directly applicable to a Strategic Priority of the adopted Escalon 2025-2026 Strategic Plan.

Background Information:

The President of the Escalon Little League Board, Randy Waters, submitted a resident Agenda Item Request Form “Request field and park use in order to provide practice, games, and events to players, coaches, residents and ELL volunteer members.” And “Request for access to equipment currently available for baseball and softball play.”
A group of community members have initiated and are implementing the process to provide an opportunity for children in the community to play baseball and softball in the National Little League structure. To do so, this group has formed a Board—Escalon Little League—and are working to finalize their 501c3 non-profit status. Upon completion of this process all 10U and above baseball/softball players would play Little League and would play under the auspices of the ELL Board and structure. TBall and 8U players would continue to play in the City of Escalon recreation program.

Per the City of Escalon City Council Agenda Policy, requests from the public are to be submitted to the City on the prescribed form. City staff will then bring the item before the City Council to determine if there is support by a majority of the City Council. If so, the item will be placed on a future regular City Council meeting for full consideration.

Therefore, this item seeks Council support to include the specific request on a future Council agenda.

Page 35 of 37 ends

Fiscal Impact:

Currently, the City assumes all costs associated with the care and maintenance of the requested fields. In part, these costs are offset by recreation program registration fees, sponsorships and other program collections. If approved, all ELL registration funds will be directed to the ELL organization. This shift of revenue is expected to reduce funds available for maintenance costs.
