ORDINANCE NO. 2022-19
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ESCONDIDO, CALIFORNIA, REPEALING ESCONDIDO
MUNICIPAL CODE CHAPTER 2, ARTICLE 4B, SECTION 2-94
AND AMENDING SECTION 2 -95 TO REDUCE C ITY
TREASURER COMPENSATION TO THE SAME LEVEL AS A
CITY COUNCILMEMBER AND TO STANDARDIZE VACANCY
PROCEDURES FOR AL L CITY OF ESCONDIDO ELECTED
OFFICIALS
WHEREAS, a voter initiative passed in 1984 (Proposition F), and modified in 1986 (Proposition N), has tied the City Treasurer’s compensation to that of the highest paid City department head and could result in the City paying $500,000 for a special election to fill a City Treasurer vacancy; and WHEREAS, since, the voters enacted the Propositions F and N, only the voters can modify the City Treasurer’s compensation and vacancy procedure; and
WHEREAS, the City Council believes the City Treasurer position is not a full time job; and WHEREAS, the City of Escondido City Treasurer receives approximately $150,000 in total compensation; and
WHEREAS, using the same vacancy provisions for the City Treasurer, City Councilmembers , and the Mayor will allow the City Council to assess all options when a vacancy occurs in any City of Escondido elected office; and
WHEREAS, if approved by the voters, the proposed ordinance would lower the City Treasurer compensation to equal that of a City Councilmember; and WHEREAS, California Government Code section 36517 states, “the city treasurer shall receive, at stated times, a compensation fixed by ordinance or resolution;” and WHEREAS, California Government Code section 36512 authorizes the City Council to fill a vacancy in the elected offices of the City of Escondido within 60 days from the commencement of the vacancy, either fill the vacancy by appointment or call a special election to fill the vacancy; and 33 Item1.
WHEREAS, on July 27 , 2022, the City Council directed the City Attorney to prepare a ballot measure for consideration of voter approval to address the City Treasurer ’s compensation and vacancy procedure.
NOW, THEREFORE, subject to approval by an affirmative, simple majority vote of the people as required by law, THE PEOPLE OF THE CITY OF ESCONDIDO, CALIFORNIA, DO ORDAIN AS FOLLOWS:
SECTION 1. The Escondido Municipal Code is revised to repeal Chapter 2 - Administration, Article 4B - City Treasurer, Section 2-94 – Terms of office and filling of vacancy.
SECTION 2. The Escondido Municipal Code is revised to repeal and replace Chapter 2 - Administration, Article 4B - City Treasurer, Section 2-95. Salary and benefits, as follows:
The city treasurer shall receive the same compensation as a city councilmember.
SECTION 3. ENVIRONMENTAL ANALYSIS. This Ordinance is exempt from review under the California Environmental Quality Act (California Public Resources Code sections 2100, et. seq., “CEQA”) and CEQA Regulations (14 California Code of Regulations sections 1500, et. seq.) because it establishes rules and procedures to implement government funding mechanisms; does not have any commitment to a specific project which could result in a potentially significant physical impact on the environment; and, constitutes an organizationa l or administrative activity that will not result in direct or indirect physical changes in the environment. CITY COUNCIL VACANCY – DISTRICT 3
DEPARTMENT
City Clerk’s Office
RECOMMENDATION
Request the City Council conduct an application/interview process and appoint a new District 3 City Councilmember or call for a special election.
Staff Recommendation: Approval (City Clerk: Zack Beck, City Clerk) Presenter: Zack Beck, City Clerk
FISCAL ANALYSIS
The San Diego County Registrar of Voters estimates that a Special Election will cost $350,000 to $600,000+. However, the Registrar has not conducted a Special Election under the recently adopted Voter’s Choice Act, which requires that ballots be mailed to all registered voters and that all vote centers be fully staffed for the 11 days leading up to the election. Therefore, the cost for a Special Election could conceivably exceed $600,000.
BACKGROUND
On November 3, 2020, Councilmember Joe Garcia was elected to the City Council District 3 seat. On March 30, 2022, the City Council adopted new District boundaries that were created by the Independent Redistricting Commission.
As a result of redistricting, Councilmember Garcia was drawn into City Counci l District 2 and became eligible to run for that seat. On November 8, 2022, Councilmember Joe Garcia was elected to the City Council District 2 Seat creating a vacancy in the City Council District 3 seat, effective December 14, 2022.
According the Government Code § 36512(b) (Attachment 1), within 60 days of a councilmember seat vacancy, the Council must decide whether to (1) appoint a councilmember to fill the vacancy, or (2) call for a special election. The Council is required to decide a course of action on or before February 12, 2023.
50 Item6.
APPLICABLE LAW:
The California Government Code provides the required steps to take when a vacancy in an appointive office occurs. Within 60 days of a councilmember seat vacancy, the Council must decide whether to (1) appoint a councilmember to fill the vacancy, or (2) call for a special election. Government Code § 36512(b).
In General Law cities, the City Council has broad discretion to choose the method for filling the vacancy.
Section 36512 does not contain a detailed process, but instead gives the City Council discretion to choose either appointment or special election, and provides a 60-day deadline for making that decision from the time of the vacancy.
In the present case, the vacancy in District 3 occurred on December 14, 2022, at the time Councilmember Garcia was sworn-into the District 2 seat. Thus, the City Council has a maximum of 60 days from the date of the vacancy to make an appointment or adopt the necessary resolutions to call for a special election.
The deadline to make a decision is February 12, 2023. Currently, the final regularly scheduled Escondido City Council Meeting prior to the aforementioned deadline is February 8, 2023.
If the City Council chooses to appoint an individual to the City Council District 3 seat prior to the February 12, 2023 deadline, the appointed individual would serve as the Escondido City Council District 3 representative until the November 5, 2024 General Election.
If the City Council chooses to call for a special election at this time, the elected individual would serve as the Escondido City Council District 3 representative until the November 5, 2024 General Election.
Per California Elections Code 1000, the established election dates are as follows:
(a) The second Tuesday of April in each even-numbered year. (b) The first Tuesday after the first Monday in March of each odd-numbered year. (c) The first Tuesday after the first Monday in November of each year. (d) The first Tuesday after the first Monday in March in each even-numbered year. (e) This section shall become operative January 1, 2019.
According to the San Diego County Registrar of Voters, the special election would take place on November 7, 2023.
51 Item6.
Eligibility
In order to be eligible to hold office as the Escondido City Council Member District 3 representative, a person must be a resident of the City of Escondido within the boundaries of City Council District 3, and a registered voter of the City of Escondido within the boundaries of City Council District 3 at the time nomination papers are issued. Government Code sections 34882, 34904.
Process
If the City Council chooses to fill the vacancy by appointment, it is common practice to have the City Clerk issue a notice of the vacancy and invite interested persons to apply by completing an application and providing answers to a supplemental questionnaire (Attachment 2 ). The application form and the invitation to apply will be placed on the City’s website at www.escondido.org. If the Council would like, the City Clerk can advertise the vacancy via media, social media, local community organizations, Escondido Volunteer Hub, as well as through the Escondido Boards and Commissions.
Applicants must submit all information by January 13, 2023, in order for the City Council to have sufficient time to consider the materials. Applications and supporting material will be placed in the City Clerk’ s office for public inspection.
Interviews of eligible candidates will occur on January 25, 2023. The City Council can make an appointment at that meeting , or they can do so during the next regularly scheduled Council meeting on February 8, 2023. The Council can also call a special m eeting if needed, in order to meet the February 12, 2023 appointment deadline.
Voting Requirements
The Escondido Municipal Code does not have specific voting requirements f or City Council decisions.
Thus, state law applies and the City Council may generally take action by a vote of a majority of a quorum (Civil Code section 12, Code of Civil Procedure section 15). In the unlikely event the City Council wishes to adopt an ordinance or resolution, three votes will be required pursuant to Government Code section 36936 (requiring a majority vote of the total membership of the city council for resolutions, orders for the payment of money, and ordinances).
It should be noted that the Brown Act does not allow for the City Council to hold a closed session on the subject of filling a Mayor or City Council vacancy. Although closed sessions are allowed for the appointment or evaluation of a public employee pursuant to Government Code section 54957, "employee" does not include an elected official or member of the legislative body. Government Code section 54957.
52 Item6.
Additionally, when the public action on filling the vacancy is taken, it should be noted that the Brown Act also prohibits the use of secret ballots. Government Code section 54953(a).
