PROJECT OVERVIEW
The City has received an application for a use permit from property owners Brandon and Jaclyn Fawaz to allow single-family residential use of 143 Collier Way (APN 056-161-100). The 0.48-acre property is located at the intersection of Collier Way and Frederick Street and is developed with an approximately 3,600-square foot, six-bedroom, three bath, historic building known as the Collier Hotel (see Figure 1 below). The dwelling was constructed in 1897 and previously served as a boarding house and private residence before being converted to a vacation rental in the early 2000s.

Properties to the north, east, and southeast of 143 Collier Way are developed with single-family dwellings, Ray's Food Place and the Etna Library are located to the south, and nearby land uses to the Collier Hotel Use Permit Page 2
west include the historic Odd Fellows Lodge and Collier House, the latter of which is presently occupied as a dormitory (see Figure 3).
Figure 3, Project Site Aerial Overview (parcel boundaries are approximate) According to the applicant, "The "Collier Hotel" is a house built over 100 years ago and has been used as a family home and as short-term rentals. The property is for sale and the proposed buyer would like to live in the house and not rent it out for the foreseeable future. This permit would give legal flexibility to a new owner to live onsite or rent if desired."
ANALYSIS
General Plan Consistency
The Land Use Element of the City of Etna General Plan designates the project site Central Mixed Use (CMU). According to the General Plan, the CMU land use classification "provides for a compatible mixture of nonresidential and residential uses in a centrally located area of the city to encourage a broad array of retail, entertainment, professional, social, civic, residential, and other uses that contribute to a vibrant, pedestrian-friendly environment. Typical land uses in the CMU land use classification include retail sales, offices, banks, personal services, grocery stores, public and quasi-public uses, parks, entertainment facilities, community gardens, and similar nonresidential uses, as well as low, medium, and high density residential uses."
Consistent with the General Plan, the project site is centrally located and is proposed for low density residential use.
In addition, planning staff has identified the following policies and programs as being relevant to the Council's review of the project. Following each General Plan policy or program is an analysis of the project's consistency with that policy or program (i.e., suggested findings).
Collier Hotel Use Permit Page 3
POLICY LU-2.4: The City ensures that proposed uses will be compatible with existing land uses when approving discretionary development proposals.
The property is proposed to be used as a single-family residence consistent with past residential use of the property. The proposed single-family residential use of the property is compatible with existing residential and nonresidential uses in the project vicinity.
Program LU-2C: Upon review of discretionary permits, add conditions to the project approval, when warranted, to support the public peace, health, safety, and general welfare.
Conditions of approval are recommended to support the public peace, health, safety, and general welfare. See Staff Recommendation below.
Residential use of the property is proposed. Surrounding land uses include residential, commercial, and public.
Program S-1P: Forward all applications for building permits, tentative parcel maps, tentative maps, and use permits for development in the VHFHSZ to the Etna Police Department, Etna Fire Department, and CAL FIRE for review.
Although no development is proposed, the use permit application and an administrative draft staff report were forwarded to the Etna Police Department, Etna Fire Department, and CAL FIRE Siskiyou Unit for review. No safety concerns were identified as a result of that review. On April 21, 2026, CAL FIRE submitted a letter indicating the project is in a Local Responsibility Area (LRA), CAL FIRE does not have authority to inspect in the LRA, and that inspection authority for the project rests with the local jurisdiction. No comments were received Etna Police or Fire.
POLICY S-2.3: The City considers fire-related hazards in the review of discretionary project proposals and ensures that new development in VHFHSZ is carefully sited and configured.
No development is proposed. Like the entirety of Etna, the property is in VHFHSZ. The application was circulated to the Etna Fire Department and CAL FIRE for review. No safety concerns were identified as a result of that review.
Zoning Consistency
In accordance with Etna Municipal Code Section 17.36.020 (Permitted uses), principally permitted residential uses in the High Density Residential (R-3) district are allowed by right in the T-C district when the residential use is part of a vertical mixed-use development and the residential use does not occur at street level.' Pursuant to Section 17.36.040 (Conditional uses), residential uses may be allowed in the T-C district at street level subject to approval and validation of a conditional use permit in addition to any other permits or licenses required for the use.
The owners of 143 Collier Way have requested approval of a conditional use permit to allow single- family residential use of the full property.
' The Zoning Code provides exceptions to the use permit requirement for street level residential use for live-work units and reasonable accommodations pursuant to the federal Fair Housing Amendments Act of 1988 and the California Fair Employment and Housing Act.
Collier Hotel Use Permit Page 4
The Zoning Code establishes site development standards for properties in the T-C district that include maximum units/acre, maximum lot coverage, maximum building height, minimum setbacks, minimum distance between buildings, and minimum off-street parking, as follows.
Maximum Dwelling Units per Acre: One to 20 dwellings/acre.
The project would result in one dwelling unit on 0.48 acre.
Maximum Lot Coverage: 100 percent on existing parcels, 75 percent on new parcels.
The project entails residential use of an existing parcel and no development or subdivision of the property are proposed. Lot coverage is presently estimated as being 25 percent or less.
Maximum Building Height: 45 feet for the primary structure, 20 feet for accessory structures - exceptions may be granted through the use permit process.
The project entails use of existing improvements and property for single-family residential use. No development is proposed and no assessment of current conformity with maximum building heights has been made. All future development would be subject to the regulations in effect at that time.
Minimum Setbacks: Front yard - 0 feet. Rear yard - 10 feet adjacent to residential district, 0 feet adjacent to mixed-use or nonresidential district. Side yard - 10 feet adjacent to residential district, 0 feet adjacent to mixed-use or nonresidential district.
The project entails use of existing improvements and property for single-family residential use. No development is proposed and no assessment of current conformity with setbacks has been made.
All future development would be subject to the regulations in effect at that time.
Minimum Distance Between Buildings: As established by the California Building Code.
The project entails use of existing improvements and property for single-family residential use. No development is proposed and no assessment of current conformity with the California Building Code has been made. All future development would be subject to the regulations in effect at that time.
Minimum Off-Street Parking: Two spaces per dwelling unit, one of which must be in a covered garage or carport outside of required setbacks - exceptions may be granted through the use permit process.
The property is developed with a detached garage and carport and there is sufficient area for off- street parking on the site.
Based on the analysis above, it is planning staff's opinion that the use, as proposed and conditioned, would be consistent with the City's General Plan and Zoning Code. If the City Council concurs, it should make a finding to this effect prior to project approval. As such, a suggested finding has been incorporated into the draft resolution prepared for the City Council's consideration.
USE PERMIT FINDINGS
In order for the City Council to approve the conditional use permit and allow for single-family residential use of 143 Collier Way, the City Council must first make certain findings. Etna Municipal Code Section
17.72.060 (Action by the city council on a use permit) details both the required findings and the provision for placing conditions on projects to ensure projects are not to the detriment of the City, as follows:
Collier Hotel Use Permit Page 5
A. In order to grant any conditional use permit, the findings of the city council shall be that the establishment, maintenance or operation of the use or building applied for will not, under the circumstances of the particular case, be materially detrimental to the health, safety, peace, comfort and general welfare of persons residing or working in the neighborhood of such proposed use, or be materially detrimental to property or improvements in the neighborhood or to the general welfare of the city.
B. The city council may designate such conditions in connection with approval of a conditional use permit as it deems necessary to secure the purposes of this title and may require that such conditions will be complied with by the permittee.
C. The city council shall render its decision on any conditional use permit within thirty-five (35) days following close of the public hearing. Failure of the city council to render its decision within the period shall be deemed to be a denial of the application. The granting of any use permit, when conforming to the provisions of this paragraph, is an administrative function, the authority and responsibility for performing which is imposed upon the city council, and the action thereon by the city council shall be final and conclusive.
It is planning staff's opinion that because the project site is properly designated and zoned for the use, and residential uses are located adjacent to or in close proximity to the property, and no safety concerns were identified by the Etna Police Department, Etna Fire Department, or CAL FIRE, approval of the project would not be materially detrimental to the health, safety, peace, comfort, and general welfare of persons residing or working in the neighborhood, or be materially detrimental to property or improvements in the neighborhood or the general welfare of the City.
If the City Council concurs, it would need to make the required finding prior to project approval. As such, a finding to this effect has been incorporated into the draft resolution prepared for the City Council's consideration. However, should concerns be raised at the public hearing that would suggest the finding cannot be made, the City Council may place additional conditions on the use permit to mitigate community concerns. Conversely, if the City Council does not feel that the concerns can be adequately addressed, the Council can deny the request for a use permit.
ENVIRONMENTAL RECOMMENDATION
It is planning staff's recommendation that the project does not have the potential to have a significant adverse effect on the environment and is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15301 and 15061(b)(3), as described below.
Section 15301, Existing Facilities. The "Existing Facilities" exemption applies to "the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use."
ection 15061(b)(3). This section is better known as the "common sense exemption" in that it state hat CEQA only applies to projects that have the potential for causing a significant effect on th environment. Where it can be seen with certainty that the project will not have a significant negative impact on the environment, the project is exempt from CEQA.
If the City Council concurs, it would need to make the finding that the project is exempt from CEQA prior to project approval. As such, a finding to this effect has been incorporated into the first of two suggested motions on page one of this staff report.

STAFF REPORT
UNE 10, 1903 ETNA CITY COUNCIL
OU COUNT
To: City Council Members
From: Cora Brownell for Marble Rim Gallery
Date: April 27, 2026
Subject: Building Modifications - Rental Portion of City Hall Painting Improvement & Second Emergency Exit
RECOMMENDATION: Approve to continue and complete the exterior painting work project of rental portion of City Hall. Approve options to provide Marble Rim Gallery rental space with a second emergency exit as required for fire safety reasons.
DISCUSSION: Since occupying the rental space of City Hall, the Marble Rim Gallery has been working on improving the appearance of the space both inside and outside. Recently they have begun painting the exterior of City Hall with the intention of benefiting its visual appeal and are hoping to be finished by May 2nd. Marble Rim Gallery is requesting permission to continue and complete the project.
Second Emergency Exit: Marble Rim Gallery's insurance lists the need for two accessible means of exit and all exit signs to be illuminated. Currently there is only one exit through the front entrance.
An option for consideration would be to convert the existing door between City Hall and the rental space into an emergency exit with an alarm if the door is opened. This option may compromise the security for the city since the exit goes through an office with sensitive information.
Another option to consider would be to open the once useable door on the side of the building. The door is currently boarded up on the outside and has drywall over it on the inside. It appears to line up with the outside wall in the far office of the space currently occupied by Marble Rim Gallery. This option would require deconstruction and reconstruction.
FINANCIAL IMPACT: Marble Rim Gallery is providing the labor and paint - no cost to the city.
Second Emergency Exit:
For #1: A security emergency exit with an alarm installed - TBD.
For #2: Financial impact would consist of removal of the boarding on the outside of the building and removal of drywall on the inside. Depending on the condition of what is uncovered, there would have to be some reconstruction of the doorway and door - TBD. 429602.1
Hi Cora,
Following up here to see if you can provide me with the below information that USLI's underwriting department is requiring:
-Description of operations/activities taking place at this location:
-Are all exit signs illuminated on premises?
-Are there at least two accessible means of exit?
-Does the organization have functioning and operational smoke and/or heat detectors in all public areas and units?
-Does the organization's property have any aluminum wiring (including partial) or knob and tube wiring present?
-Is 100% of the electrical wiring on functioning and operational circuit breakers? -Square footage occupied:
-Is there any anticipated construction of new buildings or alterations to existing structures?
-Please confirm if any changes in ownership, hazard, operation, scope of work or financial interest in the organization at new location.
-Name, mailing address and insurable interest (if an additional insured is needed):
Thank you,

Subject: Ambulance Repairs
RECOMMENDATION:
Complete all work through Quote 1 and approve additional for incidentals.
DISCUSSION:
The 2007 Ford E-350 is a good ambulance with 70,000 miles on it. It blew a fuel injector that requires the entire motor pulled for repair. Most of the cost is in labor due to accessibility.
Request approval to replace other parts while the engine is out.
FINANCIAL IMPACT:
$28,000

Etna Police Department Monthly Report
March 2026
The month of March, with all its supposed madness, has come and gone without too many hiccups and a lot of positive progress within the department as well as town. April will lend itself to many events coming to town, with further projects being developed and completed making town a safer community to live in. With new officers joining the department it may be a great time to think about coming out for a ride along. The insight you gain from seeing first-hand law enforcement day-to-day operations is invaluable and something you can bring back to council and our constituents when critical information is needed. A quick thank you to all council and town staff for being so responsive when we run into an issue. It means a lot to be able to reach out to others when we need assistance.
Traffic - After some time of positioning our speed sign and message board around both towns, we have moved it on to greener pastures in another location, Callahan Way. We recently had several concerns with speed throughout the road and have implemented the sign as well as installing several new speed limit signs. Thank you to public works for jumping on the project so quickly. We are already seeing a large reduction in speed issues in this area and should have a statistical report based on the time the sign has been in place. We were also able to utilize the statistical features to narrow down problematic times and days when additional police presence was needed helping our speed patrol more practical and efficient.
Recently, with the help from public works we have also placed truck route signs on Main Street to help educated vehicles associated with new logging operations on Etna Mountain to use Main Street and not attempt the turn onto Collier Way. I have also reached out to these companies to see if there is anything we can do to help with their travels through town.
Additional patrol will be added to ensure these issues are reduced and violators of other vehicle-related problems are held accountable. We have also been expanding our scope of traffic enforcement outside town limits in an attempt to slow people down before affecting our city streets and pedestrians. It is very often we receive calls reporting vehicle driving recklessly or speeding in these areas. If we can remain proactive outside of town limits it will ensure the town itself to be a safer environment.
Schools- Our school partnership remains closer than ever as we team up to not only resolve ongoing issues but also prevent future issues from occurring. This year has really tested our partnership as the PD has taken a larger role within the schools, but we have seen a large increase in issues related to school behavior. Don't get me wrong, we live in one of the best places with the best schools throughout the country, however we are not immune and want to maintain our way of life. It's through this very proactive partnership we are to increase our odds of maintaining that very way of life but also have local control over how we feel our valley's morals and values can continue as proven through history.
Animal Control- After last month's uptick in animals at large, we have seen animal control response come down to a normal level. We recently had a local business owner inform us of her intentions of holding an estate sale where all proceeds would go to our animal control efforts and program. It is with generous donations like these that we are able to continue and improve our animal control department in a positive direction. There has been additional talk lately regarding the possibility of holding another spay and neuter clinic for our local cat population. In the past this has been a very positive program bring an affordable way for us to contain and control our local animals.
Reports/Cases - Cases have been holding steady and normal for this time of year with several search warrants being obtained and executed around our two towns. Positive outcomes will be obtained from these warrants as the cases are adjudicated through the Siskiyou County's District Attorney's office. These cases are very detailed and precise, requiring many hours from our officers. A big thank you to them for putting in the time to resolve issues in town and make our community a safer place.
Calls for Service- As mentioned before, as the weather improves, we see a large increase in activities around town and our Scott Valley Community. Mostly positive, however, does bring in others from out of town and increases our chances of issues occurring. Officers remain vigilant and part of many of these activities to make sure people are in a safe environment and have fun. It is our goal to have others visit our communities and take back positive exciting stories to their friends and families with the intention of returning for more.
Attached is the monthly statistical data you desired. If there is anything you would like me to add to the report, please let me know.
Ordinance Enforcement- Recently we set a meeting date for local code enforcement personnel to come together and speak about the issues we are all facing and the success's they have had in finding solutions to problematic properties. While we are all from different communities we are all seeing very similar problems and finding solutions has become very difficult in many ways. We have a good game plan and plan on meeting several more times as we move forward. I just had a conversation from our county DA Andrus regarding these issues we are seeing, and he would like to join us in our efforts. This is big as the district attorney's office often is the deciding factor in adjudication or which direction a case goes.
Recently a problematic property within the town of Ft. Jones has been purchased and the property owner has already made great strides in cleaning up the area. A very positive move forward into a property that has been an issue for several years. We have similar properties in Etna that could benefit from the same process and we hope to have the same outcomes in the near future with new owners taking possession of dilapidated properties.
PAL- PAL is continuing to grow in several programs as summer approaches and we look forward to another great year in clay birds, wrestling, and swimming. It is a lot of work to maintain these programs and keep them going, so thank you to all the volunteers and their tireless efforts in making sure these youth programs can continue.
MisC.- Recently it was brought to my attention for the need for a prescription drop off location for Scott Valley. It was a pleasure for me to inform others that we do have and will continue to provide two locations at both the Etna and Ft Jones Police Departments drop boxes for everyone within the Scott Valley community. Attached is a flyer describing the process and additional information related to disposing of prescription drugs. We can also make house calls for those in need and transport the prescriptions for them. Please send people our way if they have questions or need assistance in any way.
