YOU COUN
To: City Council Members
From: Police Chief Josh Short
Date: May 26, 2026
Subject: 2026-2029 Fort Jones Police Contract
RECOMMENDATION:

Staff recommends approval of the 2026-2029 Fort Jones Police Contract between the City of Etna and the Town of Fort Jones.

DISCUSSION:

Since the Town of Fort Jones does not maintain its own police department, it has partnered with the City of Etna for law enforcement services. The City of Etna and the Town of Fort Jones first entered into an agreement in December 2019, establishing a six-month arrangement that continued through June 30, 2020.

Building on the success of that partnership, both communities have continued to renew and maintain contractual agreements for police services. The current agreement was developed as a three-year contract, and it is now up for renewal through 2029 to provide continued long-term stability and public safety services for the Town of Fort Jones.

Due to the success of this partnership, both communities have continued to renew and maintain a contractual agreement for police services.

FINANCIAL IMPACT:

Refer to Attachment A of the 2026-2029 Fort Jones Police Contract. 429602.1
This Agreement of Law Enforcement Services ("Agreement") is entered into by and between the City of Etna ("Etna" hereinafter) and the Town of Fort Jones ("Fort Jones" hereinafter), both municipal corporations and general law cities located in the County of Siskiyou, State of California.

RECITALS
Whereas Etna has its own police department while Fort Jones does not.

Whereas Fort Jones desires to contract with the City of Etna to provide for police protection within its boundaries pursuant to this Agreement.

Whereas this independent contractor Agreement is entered into pursuant to provisions of Government Code Sections 55631, 55632, and 55634, and all other applicable authority.

Whereas the City of Etna and the Town of Fort Jones desire to enter into an agreement effective July 1, 2026, and ending June 30, 2029. Each year both the City of Etna and the Town of Fort Jones at least three months prior to the previous year ending date of June 30t will review and be afforded the opportunity to make suggestions and or amendments to the agreement to be approved by each city council in writing.

Whereas this agreement is an independent contractor agreement and is not a joint employer arrangement between Etna and Fort Jones.

NOW, THEREFORE, in consideration of the above recitals and the mutual covenants contained herein, and for good and valuable consideration, Etna and Fort Jones agree as follows:

AGREEMENT
GENERAL PROVISIONS:

The provisions herein supersede and replace any previous Agreement or Amendments executed by the parties effective July 1, 2026.

• The authority for assignment, control and discipline of Etna officers and employees and other matters incidental to the performance of services by Etna under this Agreement, and the control of Etna personnel shall remain with Etna but should include feedback and input from the mayor, city council or City Administrator, of the Town of Fort Jones. • The Etna Chief of Police will designate a Chief of Police for the Town of Fort Jones to satisfy the provisions of Part 1, Division 3, Title 4 of the California Government Code (sections 36501, et seq.), said Chief to function and operate in conformity with the terms of this Agreement. (Attachment C.) WORKERS' COMPENSATION LIABILITY:
• Fort Jones shall not be liable for payment of salaries, wages, or other forms of compensation to any Etna personnel performing services hereunder including personnel performing indirect services hereunder, such as police management personnel, patrol supervisors, background investigators, police communications personnel, and police clerical personnel. It is understood and agreed that for such purposes all such Etna personnel performing either direct or indirect services to Fort Jones hereunder shall be deemed employees of Etna while acting in or for Fort Jones pursuant to this Agreement. Etna shall maintain Workers' Compensation Insurance covering all Etna personnel performing services under this Agreement.

MUNICIPAL AGENCY IMMUNITIES:
• For the sole purpose of giving official status to their actions while performing municipal functions within the scope of this Agreement, every Etna officer, employee, or agent engaged in performing 3 General Law Enforcement Services to Fort Jones shall be considered an employee of the Town of Fort Jones. This provision shall be implemented by Fort Jones Ordinance (is there a specific ordinance?). In this regard, Etna, its officers, employees, and agents engaged in performing any services or functions as described in this Agreement shall have the immunities that they would enjoy were they actual officers, employees and agents of Fort Jones provided the services are within the scope of this Agreement.

This Agreement shall not be construed as or deemed to be an agreement for the benefit of any third party or parties, nor shall any third party have any right or action hereunder for any cause whatsoever.

INDEMNIFICATION FOR WORKERS' COMPENSATION CLAIMS; PROOF OF LIABILITY INSURANCE COVERAGE:

Etna will provide Fort Jones with verification of Etna's Worker's Compensation Coverage and Liability Insurance Coverage regarding activities undertaken pursuant to this Agreement. In addition, Etna will indemnify Fort Jones for any claim made upon it by an Etna Police Department officer, agent, or employee for injury or sickness.

INDEMNITY OBLIGATIONS:

Etna shall indemnify and hold harmless Fort Jones, its officers, agents, employees and independent contractors from any claim or liability whatsoever, based or asserted upon any act or omission of Etna, its officers, agents, employees, subcontractors, and independent contractors, for property damage, bodily injury or death, or any other element of damage or any kind or nature occurring in the performance of this Agreement. Etna shall defend at its own expense and costs, including attorneys' fees, Fort Jones, its officers, agents, employees, subcontractors, and independent contractors in any legal and/or administrative action of any kind based upon such alleged acts or omissions. The duty of Etna to indemnify and save harmless as set forth in this paragraph shall include the duty to defend. All persons employed by Etna in providing general law enforcement services to Fort Jones shall be Etna employees.

The indemnity hereunder extends to all costs, attorneys' fees, and expenses Incurred In obtaining expert testimony and the attendance of witnesses, expenses and liability incurred In and about any such claim, the investigation thereof, as well as the defense of any action or proceeding brought thereon, and from and against any orders, judgments or decrees which may be entered therein.

Fort Jones shall indemnify and hold harmless Etna, its officers, agents, employees, subcontractors and independent contractors from any claim or liability whatsoever based upon or asserted upon any act or omission of Fort Jones, its officers, agents, employees, subcontractors and independent contractors for property damage, bodily Injury or death or any other element of damage of any kind or nature occurring in the performance of this Agreement, including claims arising from enforcement of Fort Jones' Ordinances; excluding, however, such liabilities, claims, losses, damages, or expenses arising from the negligence or willful misconduct of Etna or its officers, agents, or employees. Fort Jones shall Indemnify and hold harmless Etna, its officers, agents, employees, subcontractors and independent contractors from any claim or liability whatsoever based or asserted upon any act or omission of Fort Jones, its officers, agents, employees, subcontractors and independent contractors for property damage, bodily injury or death, or any other element of damage of any kind or nature occurring beyond the performance of the Agreement where such claim or liability bears a reasonable nexus to Etna's performance of its obligations under this Agreement; excluding, however, such liabilities, claims, losses, 4 damages, or expenses arising from the negligence or willful misconduct of Etna or its officers, agents, or employees. By way of example, and not limiting the indemnity obligations of Fort Jones, if a dangerous condition of public property (such as an open excavation pit) caused a claim (for example If a criminal suspect was running from an Etna police officer fell in the pit), Fort Jones would owe indemnity and a duty of defense to Etna in such case. By way of further example, if a Fort Jones public works employee drove a vehicle to collide with a person who was at the side of the road because such person was stopped by an Etna police officer Incident to a traffic violation, Fort Jones would owe indemnity and a duty of defense to Etna on account of such claim. The above examples are intended to make clear that the dangerous condition, act, or omission of Fort Jones may have nothing to do with Etna's performance or providing of policing services under this Agreement, yet such dangerous conditions still fall within the scope of Fort Jones' indemnity and defense obligations to Etna because such a dangerous condition, act or omission bears a nexus to the performance of policing services under this agreement. Fort Jones shall defend at Its own expense, including attorneys' fees and costs, Etna, its officers, agents, employees, subcontractors, and independent contractors in any legal and/or administrative action of any kind based upon such alleged acts or omissions. The duty of Fort Jones to indemnify and save harmless as set forth in this Paragraph shall include the duty to defend. The indemnification hereunder extends to all costs, attorneys' fees and expenses incurred in obtaining expert testimony and in the retention, transportation and attendance of such expert witnesses as well as expenses related to lay or percipient witnesses, as well as any liability incurred or arising out of any such claim, the investigation thereof, as well as the defense of any action or proceeding brought thereupon as well as from any order, judgments, verdicts, decrees or settlements which may be reached or entered thereon.

The indemnity and hold harmless provisions contained herein are binding upon the parties hereto without regard to whether any insurance coverage or the insurance policy is available for the acts and/or condition for which the indemnity has provided pursuant to this paragraph. The indemnity and hold harmless provisions contained herein shall survive the termination of this Agreement and shall continue after such termination for any liability arising out of or as a consequence of this Agreement or the performance of any services under this Agreement. Etna shall provide evidence of liability coverage to Fort Jones and Fort Jones shall provide evidence of liability coverage to Etna related to this Agreement.

Subject: Ambulance Rates
RECOMMENDATION:

Adjust ambulance rates per Resolution 2025-004, Section 2.

DISCUSSION:

Last year, we were given directions by the state of California on ambulance rates. Resolution 2025-004 was adopted on 3/24/2025. Per section 2 of that resolution, annual increases would occur effective July 1 in an amount equal to the California Consumer Price Index as published by the Office of Policy, Research and Legislation (OPRL) or 3%, whichever greater. Attached is the Resolution, and the current percentages listed at the OPRL. I recommend that we increase our current rates by 3% effective July 1, 2026.

FINANCIAL IMPACT:

Although this reflects a 3% increase on paper, we remain bound by reimbursement rates and regulations established by CMS. With the continued rise in fuel and insurance costs, this increase will not fully cover our growing expenses. However, without implementing the 3% adjustment, we will continue to fall further behind financially. Failing to increase our fees could ultimately threaten the sustainability of our ambulance service, which has faithfully served Etna and Scott Valley for decades.

RECOMMENDATION:

Provide guidance on how to go about a replacement ambulance DISCUSSION:

Last fall, I came to you with prices of used ambulances on auction asking for direction on ambulance replacement and if I could be given a preauthorized number if I found something on auction as the good ones go quickly. There was no motion or directives except to look into leasing and the purchase price of a new unit.

Attached is a quote for a new ambulance and after speaking with the representative, the most recent interest rate they were able to secure for an organization buying 1 ambulance was 4.2%.

Also attached is a used ambulance off of an auction site, GOV Deals.

Leasing an ambulance does not seem to be an option that I have found.

Searching GovDeals has given 3 other agencies in Siskiyou County good, reliable and affordable ambulances. They state they go fast once they come up on auction and you have to be prepared to look at it and bid on it immediately.

FINANCIAL IMPACT:

Without replacing our aging ambulance, we will be unable to be prepared for emergencies in our community or be available for opportunities to work assignments that could bring extra revenue to the city.

Purchasing either a new ambulance or a used ambulance will have a financial impact on the city. 429602.1

Subject: Re: estimate on a new ambulance
Hello, Teresa:

Thank you for reaching out to us. I'm happy to help. An estimated budgetary range for a straight-forward, Type I ambulance with 150" module, on a Chevrolet 3500HD Gas Chassis Cab 4X2, VORTEC SFI 6.6L Gas V8 is between $211,000 - $225,000 before taxes and registration, depending on if you need an upgraded AC system, which I think you could likely do without based on the temps in your area. If you need a Stryker PowerLoad powered loading device instead of antlers, you need to add another $38,000 to be safe. If you need a powered cot, that will run an estimated $37,000. All of these are budgetary ranges to give he City Council a sense of the investment involved. To develop the ambulance pricing, I've used our Crestline CCLP150 model (find more information here which offers a very attractive price based on having a select group of available options. Of course, you can certainly spend more, but this is our model for budget conscious purchases.

In terms of payments:

Term Annual Payment
3 years $74,953.53
4 years $57,159.90
5 years $46,455.87
6 years $39,326.18

RECOMMENDATION:

Clarify, correct and adjust the Salary Schedule after mistake had been noted last year.

DISCUSSION:
$16.90 per hour
The current minimum wage in Siskiyou County, California, is $16.90 per hour, effective January 1, 2026. This rate applies to all employers in the state. « Calforia State Portal
Last fiscal year, it was determined my salary rate was incorrect. I believe Schedule A was supposed to be $33.00. It was adjusted and I received back pay. I requested that the Salary Schedule be corrected so that each section with COLA increases was correct. After several requests to correct the Salary Schedule, I still have heard nothing back.

I do not believe that my current salary is correct. If my calculations are correct, base salary at double minimum wage with a 2.5% COLA should be $34.65. If what I'm being paid IS correct, no communication or updated schedules have been provided.

At the current minimum wage, a salary- double minimum wage, would be $33.80/hr.

My current pay is $33.86/hr.

Date: May 26, 2026
Subject: City of Etna Policies Relating to Drought
RECOMMENDATION:

Review City of Etna Water Conservation Plan - discuss policies relating to drought.

DISCUSSION:

The State Water Resources Control Board has recently reinstated curtailments for all surface water rights in the Scott River watershed. Review attached information.

FINANCIAL IMPACT:

None.
429602.1
Subject: Scott River Watershed: Reinstatement of Curtailments for All Surface Water Rights (Groups 1-8) - (Addendum 9)
To: Scott River Water Right Holders (sent to water right holders for which the Board has email addresses and to the Scott-Shasta Drought E-mail List) The State Water Resources Control Board (State Water Board or Board) is reinstating curtailments for all surface water rights in the Scott River watershed as listed in Attachment A of Order WR 2024-0024-DWR (Order), as authorized under the Scott and Shasta River Watersheds Drought Emergency Regulation (Regulation). This Addendum to the Order requires all surface water diverters to cease all diversions immediately. You may not resume diversions until otherwise informed by the State Water Board.

Curtailments are needed to maintain the minimum flow requirement at the Fort Jones United States Geological Survey (USGS) gage. For reference, the required minimum flows for the Scott River watershed in the coming months are the natural flow of the system up to the amounts listed in the table below, as measured in cubic feet per second (cfs), at the Fort Jones USGS gage.

June June
May July August September October
1-23 24-30
150 125 90 50 30 33 40
The Regulation allows for limited diversions under curtailed water rights for specific purposes. More information on these exceptions can be found below.

Background
Pursuant to flow regulations that establish minimum instream flows for fishery protection, which with minor exceptions and changes have been in effect since August 30, 2021, the State Water Board issued a curtailment order (Order WR 2024- 0024-DWR) on July 23, 2024. It curtailed all surface water rights in the Scott River watershed, as specified in Attachment A of the Order. Subsequent addendums have been issued to suspend or reinstate curtailments as required to maintain minimum flow requirements established in the Regulation. (The Regulation is available online at:
https://www.waterboards.ca.gov/drought/scott_shasta_rivers/docs/2025/2025-scott- shasta-emergency-reg-adopted-searchable.pdf.)
Flow measurements were taken in the field on May 14, 2026, and resulted in an upward adjustment to the flow readings at the Fort Jones USGS gage. An additional flow measurement was conducted on May 20, 2026, that resulted in a downward adjustment to the flows at the USGS Fort Jones. As of 10:00 am on May 21, 2026, the flow at the Fort Jones USGS gage was recorded at 145 cubic feet per second. Due to flows substantially falling below the minimum requirement of natural flows up to 150 cubic feet per second for May, the State Water Board is reinstating curtailments that require the immediate cessation of all surface water diversions.

Based on the current flow, the downward trend of flows at the Fort Jones USGS gage, insignificant snowpack, warmer temperature trends, water demand, seasonal drought, precipitation and temperature forecasts, and comparison to flows in recent years with similar snowpack measurements, curtailments are needed to assist in meeting the minimum instream flow requirement of natural flows up to 150 cfs for May. While the lack of snowpack, seasonal forecasts, and historic flows indicate curtailment will be necessary for much of the irrigation season, the State Water Board will continue to monitor flows, flow forecasts, precipitation and temperature forecasts, and watershed conditions regularly to determine if adjustments to the curtailments are appropriate.

Allowances for Continued Limited Diversions
The Regulation has exceptions for certain types of diversions that may continue even after you receive a curtailment order, if the appropriate form(s) is submitted to the State Water Board (see more on this below). These exceptions are:
• Non-consumptive Diversions. This exception applies if your diversion is not consumptive, meaning that it does not use up water or change the time the water is available to others (e.g., run-of-river hydropower with returns entering the same stream, instream use).
• Minimum Human Health and Safety Diversions. This exception applies if a curtailed diversion is your only water source for minimum human health and safety purposes, like drinking, cooking, washing, or meeting the state's critical infrastructure needs. Please note that diversions for firefighting may continue under this exception.
• Minimum Livestock Watering Diversions. This exception applies if a curtailed diversion is your only source for minimum livestock watering. See section 875.3 in the Regulation for more information on minimum livestock watering.

Reporting, certification, and petition forms previously submitted for the Order are still active and do not need to be resubmitted, unless you are updating your previous submittal. If you want to continue diverting using one of the above exceptions, and you have not submitted information already, you must submit the relevant information to the State Water Board. Please contact us using the information in the Questions section below if you have questions about a prior submittal or need to submit a certification or petition.

City of Etna - Water Conservation Plan
City of Etna - Water Conservation and Outreach Plan - Established in July 2021, amended July 25, 2022, amended June 24, 2024
Background
Along with the rest of California and much of the Western United States, the City of Etna is experiencing a prolonged drought and above-average heat temperatures. Precipitation in Scott Valley during the 2020-2021 winter was below average and, combined with the historical trend, has resulted in current, low instream flows in the region, including in Etna Creek.

The City of Etna, its residents, and businesses are entirely dependent on diverted water from Etna Creek for all uses. While the City has a water right that allows for substantial diversion, California law requires Etna, as well as any other diverters, to leave water instream for the benefit of other diverters, as well as wildlife. Thus, as instream flow continues to decrease over the summer, so will the amount of water that Etna may law fully divert. Less water diverted will, in turn, will place pressure on the City of Etna, its residents and businesses to conserve water and potentially even eliminate discretionary uses altogether as those uses increasingly conflict with higher priority uses such as public health (e.g., drinking water, sanitation, etc.) and public safety (e.g. fire protection).

The following Water Conservation and Outreach Plan is intended to provide background information on Etna's current water supply, identify the current uses of water, prioritize them, and create guidelines as well as a plan for water conservation in the City of Etna. The plan is currently a proposal and, thus, subject to revision as appropriate. Ultimately, enforceable ordinances are intended to be developed from this plan and adopted into law.

Clearly, consensus on water management and conservation is already and will continue to be a challenge. However, this is a challenge that the City of Etna, its residents, businesses, and surrounding community face together. Within that challenge also lies an opportunity to strengthen our bonds and mutual trust in the premise that all parties share a vision of collective well-being and prosperity.

On April 20, 2020, the City of Etna's City Council created a Drought Response Committee to help address potential consequences of extended drought as it relates to the City's water supply. The City's water source comes solely from Etna Creek in the form of a pre-1914 appropriative water right to divert a maximum 2.4 cubic feet per second (cfs) or 1,077 gallons per minute (gpm), as confirmed by the court in the 1980 Scott River Decree. The City maintains a surface water diversion dam and pipeline intake located at approximately Etna Creek 9.0 river mile.

The City's use of water is governed by a body of legislative law that governs the use of surface water, as well as court decisions, such as the Scott River Decree. One of these laws is California 1 City of Etna - Water Conservation Plan
Code, Fish and Game Code - FGC § 1602 which allows diverting water from the natural flow of a stream, in this case Etna Creek. While diversion may be lawful, Fish and Game Code - FGC § 5901 states that it is unlawful to maintain any instream device that prevents, impedes or tends to prevent or impede the passing of fish up and down stream. Furthermore, Fish and Game Code - FGC § 5937 states that the owner of a dam shall allow sufficient water at all times to pass through a fishway or over, around or through the dam, to keep in good condition any fish that may exist below the dam. The City intends to fully comply with the laws set forth so as not to jeopardize this critical resource or our access to it.

In 2004, a Water Master Plan Report was prepared for the City of Etna Water System to identify problems and recommended improvements (Oscar Larson & Associates). Since then, upgrades have been accomplished to help make the system more reliable in both quantity and quality. In 2010, the City made substantial improvements to the point of diversion which included the construction of a fish ladder over the dam. From the point of diversion, the City's water is piped by gravity to a series of 3 storage reservoirs (tanks), where the water is treated with alum and polymer then run through a sand filter and chlorinated. Then the water is gravity fed to the City's residents, businesses, schools, parks, cemetery and pool. In 2018, the City completed the installation of additional storage so that the City's current tank storage capacity is approximately 493,000 gallons.

The availability of potable water must meet minimum health and safety allocation for human consumption, sanitation and fire protection needs. It is also understood the City's water supply is finite and will fluctuate based on the water year. Per California's Water Code "the governing body of a distributor of a public water supply, whether publicly or privately owned and including a mutual water company, shall declare a water shortage emergency condition to prevail within the area served by such distributor whenever it finds and determines that the ordinary demands and requirements of water consumers cannot be satisfied without depleting the water supply of the distributor to the extent that there would be insufficient water for human consumption, sanitation, and fire protection." (Division 1. General State Powers Over Water [100-540] (Enacted in 1943, Ch. 368; Amended by Stats. 2018, Ch. 14, Sec. I. (SB 606), effective January 1, 2019.) Purpose of Plan
To ensure the integrity of the City's water supply for the near and long term, the purpose of this Water Conservation Plan is to promote the wise and responsible use of water as a scarce and valuable resource by: (1) encouraging programs to minimize waste; (2) supporting publiceducation programs that promote water conservation and a better public understanding of water usage; and (3) working through the City Council to develop, adopt, and implement waterconservation policies and ordinances that help the City meet its mandate of delivering an adequate 2 City of Etna - Water Conservation Plan
water quantity for the needs of the City of Etna's residences, businesses and schools and for fire protection in a manner consistent with the law.

There are direct threats to the City of Etna's water supply both for quantity and quality:

1. Drought

2. Fire within city limits or wildfire within the watershed

3. Chemical spill or other contamination

4. Water theft
This conservation plan targets the quantity issues and does not directly address future water quality issues.

City of Etna Water Use
Water use depends on various factors such as population, climate, land use patterns, (lot sizes, square footage of irrigated landscape), the age and condition of the water distribution infrastructure (water losses), and industrial and socioeconomic characteristics (the cost of water and income level of residents) of the City.

The City, and its duly authorized agents, and employees, shall have the exclusive right to deliver water within the city's water service area. The city shall also have the right to manage water demand within the city's water service area.

Priorities of Water Deliveries
The use of available potable water allocations in a water emergency are recommended for all customers, in accordance with the California Water Code (Sections 350-358), and in the following order of priority:
• Minimum health and safety allocation for residential domestic use, sanitation, and fire protection.
• Commercial, industrial, institutional operations to maintain jobs and the economic base of the commercial (not landscape uses).
• Permanent commercial agriculture.
• Annual commercial agriculture.
• Existing landscaping.
• New Customers
Wasteful Use of City Water
Any of the following acts or omissions, whether intentional, unintentional, willful or negligent, shall constitute the wasteful use of water:
3 City of Etna - Water Conservation Plan
a) Water flowing away from a property caused by excessive application(s) of water beyond reasonable or practical irrigation rates, duration of application, or other than incidental applications to impervious surfaces.
b) Causing or permitting an amount of water to discharge, flow, run to waste into or flood any gutter, sanitary sewer, water course or storm drain, or to any adjacent lot, from any tap, hose, faucet, pipe, sprinkler, or nozzle.
c) Allowing water fixtures or heating or cooling devices to leak or discharge water. d) Maintaining ponds, waterways, decorative basins or swimming pools without water recirculation devices or with known leaks, both seen and unseen. e) Discharging water from, and refilling, swimming pools, decorative basins or ponds in excess of the frequency reasonably necessary to maintain the health, maintenance or structural considerations of the pool, basin or pond, as determined by the City. 1) Continued operation of an irrigation system that applies water to an impervious surface. g) Use of a water hose not equipped with a control nozzle capable of completely shutting off the flow of water except when positive pressure is applied. h) Irrigation of lawns or landscaping when it is raining. i) Overfilling of any pond, pool or fountain which results in water discharging from the pond, pool or fountain.
j) Failure to repair customer pipes, faulty sprinklers or other water-related fixtures that leak water within five working days, unless the director informs the customer that the leak must be repaired more quickly, in which case the customer shall repair the leak in the time specified by the City.
k) Irrigating lawns or landscaping between the hours of 10:00 a.m. and 6:00 p.m., with the exception of drip irrigation.
1) Using potable water from the city water system for compaction, dust control or other construction purposes without first obtaining approval from the City. m) Installing a single pass cooling system, such as a water-cooled air compressor, in any property that is newly connected to the city water system. This does not apply to evaporative cooling systems.

City of Etna's Waste of Water Ordinance Code 13.08.100 gives City Staff authority to notify and/or inspect for the waste of water. If the waste of water is determined and situation is not corrected within 5 days, water may be disconnected.

Water Conservations Actions
This Plan includes four Water Conservation Levels that have been identified and methodology of setting these levels, are set by the use of triggers developed by availability of water resources information.
4 City of Etna - Water Conservation Plan
The four water conservation levels of the City of Etna's water supply will be determined, initially by the U.S. Forest Service (USFS) Klamath National Forest (KNF)'s annual May Ist Snow Surveys taken at two stations in the Etna Creek watershed: Swampy John (elevation 5,500) and Etna Mountain (elevation 5,900°), both established in 1951. The relevant parameter that will be used is snow water content or also known is the "snow water equivalent". This information will be used as the initial trigger to establish the Level in which the City finds itself after May Ist for its potential water supply, as the city's water source from Etna Creek is highly dependent upon snow melt into the upper watershed's groundwater to help sustain creek flow during the summer and fall.

At any time after May 1st, if the flow becomes less than the City's water right of 2.4 cubic feet per second (cfs), the City will declare the water conservation level to automatically increase to the highest stage of concern at Level IV.

Furthermore, if the Scott Valley becomes subject to regulatory mandates that limit water use to minimum standards, the city will automatically elevate the water conservation level to the highest stage, Level IV. Should these regulatory standards be more stringent than the current conservation plan, the city will petition the State Water Board to adjust the conservation measures to meet a threshold of 280 gallons per day per residence, based on an average household size of four people using 70 gallons per day each.

Public Education and Notification
The City will notify residents of changing conditions through bill messages, mailing inserts, and public announcements, website, Facebook postings and provide relevant information regarding the personal conservation strategies. City will develop a widely visible kiosk or sign ("Drought- Meter") as well as a public messaging board that will to stay current on flow conditions within Etna Creek. Additionally, the City may notify customers of unusually high-water usage based on billing records.

Water Conservation Levels:

The different water conservation levels are as follows:

Level I - Basic (Blue) - Voluntary Conservation: Voluntary Conservation would apply when the Etna watershed has received near normal or above normal snowpack levels. This is the normal mode of operation. Voluntary water conservation are measures suggested to encourage prudent water use, as an unreasonable waste of water is not allowed at any time.

Level II - Water Alert ellow) - Elevated Voluntary Conservation Measures: Voluntary Conservation Measures would apply when the Etna watershed has received significantly below normal snow water equivalent at 75% of average. Elevated voluntary conservation measures shall limit residential use to 400 gallons per day per residence, as measured at the water meter.

Assumption is that the City's residences average 4 people, at 100 gallons per day per person. 5 City of Etna - Water Conservation Plan
Penalties for unnecessary water usage may be enacted by the City Council.

Level III - Water Shortage (Orange) - Mandatory Conservation Measures: Mandatory Conservation Measures would apply when the Etna Creek watershed has received an extremely below normal snow water equivalent of 50% of average. Mandatory conservation measures shall 6 City of Etna - Water Conservation Plan
limit residential use to 340 gallons per day per residence, as measured at the water meter.

Assumption is that the City's residences average 4 people, at 85 gallons per day per person. Penalties for unnecessary water usage may be enacted by the City Council.

Level IV - Water Emergency (Red) - Maximum Conservation Measures: Maximum Conservation Measures would apply when the stream flow as measured at the Etna Creek gage near the diversion dam becomes less than 2.4 cfs or during state-imposed curtailment on surface water with the Scott River watershed. Maximum conservation measures shall limit residential use to 280 gallons per day per residence, as measured at the water meter. Assumption is that the City's residences average 4 people, at 70 gallons per day per person. Penalties for unnecessary water usage may be enacted by the City Council.

Water Use Restrictions
The following water use restrictions apply for the severity of the conditions as described above:

Level I - Basic (Blue) - Voluntary Conservation: Voluntary conservation measures are proposed in this stage to embed water efficiency programs into the fabric of the community and achieve permanent reductions in per capita water use. Similarly, the City already encourages energy conservation through the use of additional energy efficient technologies in residential units, subdivisions, and commercial developments. Since the community's structures tend to be older, the City encourages customers to update to modern, low flow, high efficiency water using fixtures and appliances. Under this level of normal water conditions, the following measures are suggested to encourage prudent use of this scarce natural resource:

Water Line Leak Detection
Minor leaks - The goal should be for both the City and its residents, to identify and repair minor leaks within 48 hours.

Major leaks - The goal should be to identify and repair major leaks within 8 hours.

Infrastructure - The goal should be to identify and pursue opportunities to enhance and upgrade the service infrastructure whenever possible to minimize waste on a system wide scale. The City should actively fund its Water Department's capital replacement programs.

Outdoor Landscaping - Outdoor water use for landscaping most often represents the highest water use for residential users. As such, conservation efforts in the city should encourage drought tolerant landscaping.

Irrigated Turf Area - Minimize the amount of irrigated turf in new development to permanently reduce system-wide per capita water use.

Irrigation Control Systems - New and renovated irrigation systems should include automatic timers and rain or soil moisture sensors that can automatically override the timer control of the sprinkler system.
7 City of Etna - Water Conservation Plan
Drip Irrigated Area - Drip irrigation is more efficient than spray for many applications, especially those where bushes, flowers, gardens and areas of unusual shape are being irrigated Sidewalk and Driveway Design - Lot design should be configured such that spray irrigation does not overspray and pavement areas. Landscape areas can be designed to catch any runoff instead of allowing water to drain off.

Landscape Plants - Seek to use low water using plants that are drought tolerant.

Individual water conservation habits
Bathroom - Turn off water while brushing teeth and shaving. Bathe using half-full tubs and take shorter showers.

Piping - Insulate hot water heaters and pipelines to reduce the time needed to get hot water at the tap.

Kitchen - Store drinking water in refrigerator and run dishwasher only when full.

Laundry - Purchase high efficiency appliances and wash full loads of laundry.

Watering Hours - Watering during the heat of the day allows for high evaporation rates, therefore, watering should be done before 10:00am and after 6:00pm.

Drip Irrigation - Use drip irrigation wherever possible for deep watering of trees, bushes, flowers and gardens.

Hose Shutoff Valves - Equip hoses with a shutoff valve that requires hand pressure to open.

Exterior Cleaning - Sweep patios, sidewalks, driveways, and other hard exterior surfaces.

Car Washing - Use spray from a hose equipped with a shutoff valve and/or a bucket of water to wash cars.

Hot Water Lines Insulation - Insulating hot water lines or installing a recirculation pump in new construction will reduce heat losses and the amount of time the water has to run' before it gets to the proper temperature. Pipe insulation can save both water and energy.

Thermostatic Mixing Devices - By running the hot water and cold-water lines into a single mixing valve, the person taking a shower can set and get the target water temperature much more quickly, especially when the hot water line is insulated.

Water Saving Devices - Install low-flow devices and flow restrictions for high use fixtures like shower heads and install updated, low flush toilets and low water use appliances.

Plumbing Repairs - Promptly repair any leaking fixtures. Test your plumbing by carefully checking the water meter reading and then turning off all water using devices. After 30 to 60 minutes, check if the meter has recorded any usage. Toilets can be checked by placing a drop of food coloring in the water tank and checking in 30 minutes for any coloration of water in the bowl.

Toilets are responsible for some of the most common household leaks.

Level II - Water Alert (Yellow) - Voluntary Conservation Measures: Immediate action is necessary in Level II. The City's primary tool for achieving short-term reductions in water use is public education to encourage additional voluntary restrictions to reduce water consumption until adequate supplies are available.
8 City of Etna - Water Conservation Plan
All water conservation measures contained in previous levels apply to Level II.

Voluntary Restrictions The following voluntary rationing measures will be in effect.

1. Residential use limited to 400 gallons per day per residence, as measured at the water meter. Assumption is that the City's residences average 4 people, at 100 gallons per person.

2. Use of potable water to irrigate turf and landscape vegetation is excluded between the hours of 10:00 AM and 6:00 PM.

3. Equipment hoses with a shutoff valve that requires hand pressure to open.

4. Use of potable water for exterior washing, except at commercial facilities using recycled water, is minimized

5. Potable water for car washing, construction, compaction, dust control, street or building wash-down shall be from a hose equipped with a shutoff valve and/or a bucket of water for washing. Similarly, sweeping patios, sidewalks, driveways and other hard exterior surfaces will be utilized.

Level III - Water Shortage (Orange) - Mandatory Conservation Measures: Immediate action is necessary in Level III. The City's primary tool for achieving short-term reductions in water use is to declare a water emergency and enact mandatory Level III restrictions to drastically reduce water consumption. The goal is to protect the health, safety and welfare of the public and to ensure that minimum water needs for the City residents are met.

Please note that restrictions other than those identified below may be necessary during prolonged or extreme drought conditions to safeguard the adequacy of the water supply for essential uses.

Additional restrictions may include limitations on new connections, water shortage pricing, limitations on non-essential water use, installation of flow restriction devices for excessive use customers or other measures deemed necessary.

All water conservation measures contained in previous levels apply to Level Ill.

Regulations and Restrictions The following mandatory conservation measures will be in effect.

1. Residential use limited to 340 gallons per day per residence, as measured at the water meter. Assumption is that the City's residences average 4 people, at 85 gallons per person.

2. No customer shall waste water.

3. Use of potable water to irrigate turf/lawn, landscape vegetation and between the hours of 10:00 AM and 6:00 PM or in such a manner that results in runoff for more than 5 minutes is prohibited. Outdoor watering shall be limited to 1-hour total duration.

4. Restaurants and food service establishments shall serve water to customers only upon specific request.
9 City of Etna - Water Conservation Plan

5. Use of potable water for construction, compaction, dust control, street or building wash down is prohibited.

6. City Pool shall use a pool covering when not in use to minimize evaporation.

Level IV - Water Emergency (Red) - Maximum Conservation Measures:

If Level IV is determined at any time during the year, the City of Etna's City Council and Staff will immediately notify its residences using the Code Red notification system through phone lines, cell phones, emails, Facebook, and other media methods. Additionally, a special meeting will be held with the intent to issue a rate increase for excessive water use. Any said rate increase would stay in effect until the flow within Etna Creek improved to at least 2.4 cfs for at least two consecutive weeks or until the state-imposed curtailment on surface water with the Scott River watershed is lifted by the State Water Resources Control Board. Other restrictions deemed necessary to safeguard the adequacy of the water supply for the City of Etna are subject to change if conditions warrant additional water conservation measures. Public Works staff and the Code Enforcement Officers has full authority to issue penalty notices when seeing violations.

All water conservation measures contained in previous levels apply to Level IV.

Regulations and Restrictions

1. Residential use limited to 280 gallons per day per residence, as measured at the water meter. Assumption is that the City's residences average 4 people, at 70 gallons per person.

2. Outdoor watering shall be limited to 30 minutes total duration per day.

3. Penalty for excess water use shall be issued on the connection's water bill.

Other Water Users
Schools, parks, cemetery, churches and pool shall use water in a reasonable way so not to directly or indirect harm the City's ability to meet minimum health and safety allocation for human consumption, sanitation and fire protection needs. The City reserves the rights to impose stronger water conservation measures to individual water users who are deemed to have an excessive and/or unreasonable use of water.

Unauthorized Water Use
Unauthorized use of a fire hydrant, public or private, for anything other than fire suppression efforts is not permitted at any time or any water level. 10 City of Etna - Water Conservation Plan
Fire and Other Emergencies
Nothing in this plan limits or may be construed as limiting the availability of water for extinguishing fires, meeting the demands of any other similar emergency, or routine inspection and maintenance of fire hydrants.

12 Etna/Fort Jones Police Department Monthly Report
April 2026
The month of April flew by quickly with predominately unseasonably warm weather bringing people outdoors to enjoy the longer days. We had several events in both towns including the beginning of baseball season begin also which brought people in from out of the area to enjoy our valley festivities. I'm happy to report that while town was experiencing an influx of others, each event was safe and fun for all. With new events and activities occurring throughout the summer we expect to see these numbers of visitors continue to grow, bringing more opportunities to local businesses. We are also seeing the first PCT hikers of the season visiting Etna, which is another indication summer has begun.

Traffic- With more people comes more traffic and the difficulties that arise with distracted driving. Speed is obviously one of our main concerns and we will be very proactive, prioritizing enforcement in and around town. Public works and I have been working on a few new safety measures within town, which council will be updated when in place. We actively work with CAL-Trans regarding issues on Hwy 3 as well as County roads when dealing with roadways approaching town. Although it is a little more difficult, we do see progress in making our town's streets safer for drivers and pedestrians. As mentioned before, If you notice a traffic issue around town or the valley, please let me know so we can address it before it becomes a bigger problem.

Schools- As the summer session approaches, our local students become a bit more antsy.

Although it is a normal part of the school year, it does bring more excitement to containing the spring energy in the right direction. We have actively been working with school staff and administration to bring a seamless transition into summer while already preparing for next year.

Animal Control- While animal control issues have been leveling out, we are taking the opportunity to prepare for the new licensing year by working with city staff in reviewing past registrations and comparing them to what we are seeing on patrol. Thank you city hall for providing this critical information and making our lives at the PD easier. We continue to receive donations from the public to our animal control program, giving us the ability to create a better housing situation if the need arises to home animals for short periods of time.

Reports/Cases- Cases continue to be on a normal track for the year and I anticipate the number beginning to climb as summer approaches and the addition of Officers is implemented.

Calls for Service- Calls for service remain high but again most of them positive mixed in with everyday life. We continue to support our amazing fire and ems services when we can.

This unification of services is very important and critical to our communities' existents and preservation of services we utilize on a daily basis. Our values, partnerships, and morals are a rare commodity these days and it is very special to our valley that others don't get to experience. We hope to have updates in the very near future on the developments of our consolidation efforts.

Ordinance Enforcement-Several more code enforcement cases have been addressed with positive results. We continue to look forward to our next meeting with Siskiyou code enforcement and the DA's office. Anyone interested in joining us is more than welcome and we hope to see you there. These critical meetings help us all understand policies and procedures in code enforcement while helping us build partnerships needed to succeed in these issues. Several properties incorporated within town and the county have become our main focus lately. We will continue to work hand in hand with County Code Enforcement to ensure nothing falls through the cracks and we deal with properties within the jurisdictional reach of both the city and county. Fire calls have spiked as we transition into summer with the PD responding to several vegetation fires throughout the valley. Vegetation is growing quickly along with winds becoming the catalyst to fires as people continue to try and get their residential burning done before summer. We are attempting to address property owners in the education and assistance in reducing these fire hazards before they become a major concern.

PAL- PAL is continuing our clay birds, wrestling, and swimming programs while continuing our efforts in bringing a skate park to our valley and reestablishing access to existing infrastructure.

It is a lot of work to maintain these programs and keep them going, so thank you to all the volunteers and their tireless efforts in making sure these youth programs can continue.

Misc.- We are excited to see shortly the return of Officer Martin after a maternity leave as well as Lieutenant Mendes. While we congratulate her and her new family member we can't wait to have her back on patrol. We will also be seeing two new officers join our department shortly and we hope to introduce them soon. These two officers will be an amazing addition to the department and can't wait to see what amazing services they bring to our community. One officer will be graduating from the Police Academy on the 29th of this month. If you can make it we would love to see your presence as we pin his badge during the ceremony.
