Subject: APPOINTMENT TO SHORT TERM POSITION IN LIEU OF ELECTION
INTRODUCTION
At the close of the nomination period on August 10, 2026, no candidates submitted nomination papers for the two year short term open council seat for election on November 3, 2026.
Section 10229 of the Elections Code provides that if no one or only one person is nominated for an office that is up for election, the legislative body may choose one of the following courses of action:
1. Appoint to the office the person who has been nominated.
2. Appoint to the office any eligible voter if no one has been nominated.
3. Hold the election if either no one or only one person has been nominated Notice of Facts was prepared on August 13. 2026 by the Elections Official and posted. The facts states that no candidate filed for the short term council seat.
The council may therefore choose to proceed with the election, or appoint to office an eligible vote if no one has been nominated. (Options 2 or 3 above). If the Council chooses option 2 above, the appointee shall take office and serve exactly as if elected at a municipal election for the office.
The appointee will be sworn in and commence their term at the first regular Council meeting in December 2026. Once an appointment has been made the elections official shall not accept for filing any statement of write-in candidacy (Elections Code Section 10229( c)).
If the Council does not appoint a a person to fill the seat by the 75th day before the election (August 20, 2026), pursuant to (2) above, the election will be held with a space provided for a write in candidate.
As required by Section 10229 of the California Government Code, the Town Clerk hereby certifies that the facts set forth in this staff report are true and correct.
RECOMMENDATION
Staff recommends that the Town Council:
1. Consider adoption of a resolution appointing a person eligible to serve as a council member to the City Council for the "Member, City Council, Short Term" seat in lieu of holding an election for that position..

RESOLUTION 2026-015
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ETNA
PROVIDING FOR THE APPOINTMENT TO THE OFFICE OF CITY
COUNCIL MEMBER FOR THE MEMBER, CITY COUNCIL, SHORT
TERM SEAT ORDERING THE CANCELLATION OF SAID
ELECTION FOR THAT SEAT PURSUANT TO ELECTIONS CODE
SECTION 10229
WHEREAS, under the provisions of the laws relating to general law cities of the State and California and the City of Etna, a General Municipal Election shall be held on Tuesday, November 3, 2026, for the election of certain municipal officers; and WHEREAS, pursuant to the California Elections Code, the City Council of the City of Etna calls and gives notice of the General Municipal Election; and WHEREAS, three full term seats of the Etna City Council will expire in November 2026, and one short term seat of the Etna City Council will expire in November 2028 ("Member, City Council, Short Term") is required to be placed on the November 3, 2026 election; and WHEREAS, City Council adopted Resolution 2026-013 Calling and Giving Notice of a General Municipal Election to be Held on November 3, 2026, and Requesting Consolidation of this Election With the Statewide Election for three (3) full term seats and one (1) short term (2-year) seat; and
WHEREAS, the County Clerk Laura Bynum as the Elections Official for the County of Siskiyou has certified on August 13, 2026 in a Certificate of Facts that no person was nominated for the office of Member, City Council, Short Term by the close of the nomination period; and WHEREAS, California Elections Code Section 10229 enables the City Council to appoint an eligible person to the office when no one has been nominated; and WHEREAS, the City Council, at a meeting held on August 19, 2026; determined it is in the city's best interest to make an appointment rather than hold an election for said seat.
NOW THEREFORE THE CITY COUNCIL OF THE CITY OF ETNA DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
Section 1: Pursuant to Elections Code Section 10229, is appointed as City Council Member for the two year seat Member, City Council, Short Term.
SECTION 2. The appointed individual shall serve as if elected to that seat.
SECTION 3. The election for this seat is cancelled.
SECTION 4. The City Clerk shall notify the County Registrar of Voters of this cancellation. 454140.1

Subject: Main Street Change Order Request #1 and Project Budget RECOMMENDATION:
Approve Main Street change order request #1.
DISCUSSION:
This change order is necessary because Pacific Power did not complete the underground electrical work for the Main Street Paving project before winter, delaying the downtown paving until 2027 and requiring equipment remobilization.
The change order will keep the project within the state-approved budget but will reduce the amount of money available for retention or to be returned to the state.

This Contract Change Order No. 1 (CCO#1) is made to modify the construction contract as follows:
1) Change in Work:
[1) Pacific Power will not be able to complete their underground work prior to October 30th, 2026.
This pushes the reconstruction work on Main Street into Novermber which due to winter conditions, paving work will not be allowed. The reconstruction work on Main Street will need to $40,750.00 be pushed into Summer of 2027. The additional costs are meant to cover Re-mobilization, a price increase of 3/4" base rock of $5/ton, and a price increase of asphalt of $20/ton.

Total Net Adjustment of Contract Price $40,750.00
III) Adjustment of Contract Price:
