• Default density for low-income units in the Tulare region cities in this project: must accommodate at least 20
dwelling units per acre*
• Rezone sites must have a minimum density of at least 16 dwelling units per acre
• HCD recommends buffer of "at least 15 percent" more
"At least" means that the density range allowed under
capacity than required, especially for capacity to current zoning accommodates the HCD density accommodate the lower income RHNA standard for the income category.

Department Recommendation:
Staff recommends that the City Council affirms Planning Commission Approval of Conditional Use Permit 2022-05 Subject to Conditions of Approval to allow the sale and service of alcoholic beverages at an existing business located at 1102 W. Visalia Road.
Summary:
The City has received a request for a Conditional Use Permit to permit the sale and service of alcoholic beverages at an existing business, La Cabaña, located on the south side of W. Visalia Road, west of N. Belmont Road, 1102 W. Visalia Road. Currently, the business is operating as a restaurant, which is a permitted use and does not require a conditional use permit. The conditional use permit would allow the business to also sell alcoholic beverages in addition to their existing restaurant service. The subject property contains three structures, each containing a varying number of commercial spaces facing into a shared central parking lot, which currently serves the existing businesses located in this commercial center. The access to the site and the parking lot is provided by two access south onto W. Palm Street, one access east onto N.
Belmont Road, and one access north, onto W. Visalia Road. The applicant is not proposing any new structures or renovations of existing structures. The current condition of the property is good, and the site appears well maintained.
Background:
The applicant, Tannia Pamela Morales Aguilar, has applied for a Conditional Use Permit in order to allow the sale and service of alcoholic beverages at 1102 W. Visalia Road. The conditional use permit is required in addition to the business license to operate a restaurant serving alcoholic beverages in the Neighborhood Commercial district, and the applicant has also applied for a sign permit with the Planning Department. Any approval of conditional use permit amendment would be conditioned on the completion of licensing with the California Department of Alcoholic Beverage Control (ABC).
The subject property consists of one parcel that currently contains three structures which range in uses from a dialysis clinic to a nail salon to other restaurants. These businesses share a central parking lot with ample landscaping and access from surrounding public streets. A recent examination of the site indicates that the current condition of the property well-kept, all existing development meets the standards of the Neighborhood Commercial district. The applicant has provided landowner authorization to operate a restaurant serving alcoholic beverages on the subject property. The Conditional Use Permit, if affirmed, would run with the land.
The subject property is bounded by property zoned CN (Neighborhood Commercial) to the north, east, and west, and zoned O (Open Space) to the south. The General Plan designates the surrounding properties as General Commercial to the north and west, Residential - Low Density to the east, and Public Facilities to the south.
The W. Visalia Road and N. Belmont Road public rights-of-way, which the subject property fronts onto, contains existing curb, gutter, sidewalk, street trees and lights. There are approximately 75 existing parking stalls on site in the shared parking lot and in front of the bulldings. The street behind the subject property, W. Palm Street is paved with well-maintained accesses on one end, intended to extend into the Southwest Specific Plan area.
Conclusion:
Staff recommends that the Exeter City Council adopt Resolution 2023-07 affirming Resolution 2023-02, approving Conditional Use Permit 2022-05 subject to conditions of approval. This will allow the applicant to operate a restaurant serving alcoholic beverages.

Department Recommendation:
Staff recommends that Council authorize the City Administrator to execute a purchase agreement for one (1) 2022 Ford F-250 utility truck with Monarch Ford of Exeter, utilizing cooperative purchase agreement pricing in the amount of $58,564.48.
Summary/Background:
Included in the approved FY 2021/2022 budget was one (1) utility truck for the Public Works Department to replace an older Ford F-350 truck. Pricing for previous year vehicles had been identified through the State Department of General Services Statewide Commodity Contracts (CMAS). The CMAS price, under contract 1-18-23-20A, for a "base model" Ford F-250 truck was $25,595.
In order to utilize local business as much as possible, City staff met with representatives from Monarch Ford to discuss their ability to meet these prices. Monarch Ford staff quoted a price of $27,679 for a 2022 Ford F-250, with several added features that the base model did not have.
Per Monarch's staff, this was the lowest possible price under the governmental fleet contract.
Monarch also quoted the utility bed to outfit the truck at a cost of $9,378. Pricing for the utility beds was not available through CMAS.
The price difference between base model utility trucks through CMAS and 2022 model with added features through Monarch Ford was $2,084. This price difference appeared reasonable based on the vehicle differences and, if purchased locally, a portion of the taxes would come back to the City of Exeter. For that reason, it was staff's recommendation that the City purchase the 2022 utility truck from Monarch Ford. The total cost for the vehicle outfitted with a utility bed, including taxes and fees was $40,430.68. On July 27, 2021, the Council authorized the City Administrator to enter into a purchase agreement for one (1) 2022 Ford F-250 utility truck with Monarch Ford of Exeter, utilizing cooperative purchase agreement pricing in the amount of $40,430.68. The truck was subsequently ordered, and has been on back order since July of 2021.
On February 28, 2023, more than a year and a half later, staff received notification from Monarch Ford that a 2022 Ford F-250 (4X4) truck had become available. The price of this unit, equipped with the necessary utility bed, is $58,564.48. This truck had been ordered for another customer some time ago and, when it finally came in, the customer was no longer interested.
Notably, the base model Ford F-250 has gone up significantly in price over the past eighteen months. This particular unit is a 4 wheel drive which also increases the price. Additionally, the cost for utility bed needed for this truck has increased by $4,000.
Even with the increased cost of this Ford F-250 4 wheel drive unit, it is still approximately $7,000 cheaper than the same size truck in a Dodge Ram. Staff has checked with numerous other Ford dealers around the central valley, and everyone seems to be dealing with the same supply chain issues. There are simply no trucks available. To further complicate matters, staff has learned that Ford is only doing a limited production run on F-250 and F-350 model trucks, and there are several other public and private agencies on the waiting list to immediately purchase the units as soon as they become available. Accordingly, staff is recommending that the City jump on this opportunity while it's available.
Fiscal Impact: Utility truck purchases were included in the approved FY 2021/2022 and FY 2022/2023 budgets. This truck will be paid for using available water, sewer, and gas tax funds.
Prior Council/Board Actions:
Utility truck purchases were included in the approved FY 2021/2022 and FY 2022/2023 budgets. On July 27, 2021, the Council authorized the City Administrator to enter into a purchase agreement for one (1) 2022 Ford F-250 utility truck with Monarch Ford of Exeter, utilizing cooperative purchase agreement pricing in the amount of $40,430.68.
Attachments: Quote obtained from Monarch Ford.
Recommended motion to be made by Council/Board: I move to authorize the City Administrator to execute purchase agreement for one (1) 2022 Ford F-250 utility truck with a utility bed utilizing cooperative purchase agreement pricing with Monarch Ford of Exeter in the

Department Recommendation:
That Council award and authorize the City Administrator to execute an agreement for the purchase of one new police vehicle for $70,602.78 with Monarch Ford of Exeter and Approve the budget adjustment as outlined in the AUD308 Budget Adjustment Form attached.
Summary/Background:
In FY 2022/2023, the Police Department is looking to replace one police vehicle. The vehicle to be replaced is scheduled for replacement and has reached or exceeded its expected lifespan for service as an emergency vehicle. The vehicle is over 10 years old and in excess of 100,000 miles.
To maintain consistency with the police fleet, the replacement vehicle will be Ford Explorers.
Pricing for this vehicle was identified through the State Department of General Services Statewide Commodity Contracts (CMAS). In our attempt to keep as much business as possible going through local businesses, City Staff met with representatives from Monarch Ford to discuss their ability to meet these prices. Monarch Ford staff readily agreed to meet the CMAS pricing for the vehicle; therefore it is our intent to purchase the vehicle locally.
Total costs for the police vehicle is approximately $70,602.78.
Fiscal Impact: The vehicle being replaced will be sold at public auction and the funds from its sale will be combined with funds currently available through COPS grant funding, which will cover the purchase of the vehicle.
Additionally, the COPS funding vehicle replacement budget was approved for $100,000 for FY2022-2023. Due to the order backlog, the funds were already spent and the appropriation needs to be increased by another $100,000 to be able to move forward with the current purchase request and additional equipment needs. The difference between the approved revenue ($150,000) and the requested total expenditure ($200,000) represents use of fund balance. Currently, the COPS Fund has a balance of $297,932.88.
Prior Council/Board Actions: City Council has previously authorized the purchasing of police vehicles in a similar manner, and using the same funding sources.

Department Recommendation:
Staff recommends that Council authorize a sole source purchase and installation from the only regional manufacturer representative, Telstar Instruments of Hanford, CA, for three (3) Altivar 630 25 HP drives for the wastewater treatment plant's influent pumps, in the amount of $25,481, subject to execution of a contract approved by Administration and the City Attorney.
Summary/Background:
The Wastewater Treatment Plant headworks is equipped with three (3) influent wastewater pumps. The headworks receives wastewater from the City's collection system twenty-four (24) hours per day, and seven (7) days per week. One or two pumps will typically run at any time to keep up with the inflow. However, all three (3) pumps can run during times of very high flow.
These pumps raise the wastewater from the outlet of the collection system and pump it into the wastewater treatment plant for processing. If these pumps cannot keep up with the inflow from the collection system raw sewage will back up into the City at the low points in the collection system.
All three (3) of these pumps were replaced in February of 2021 by Shape Incorporated, but the drives for the pumps were still operational. Due to limited funds available at that time, the decision was made to utilize the existing drives as long as possible. It should be noted that Shape Incorporated, who was previously approved by Council as a sole source for the influent pumps, does not manufacture the pump drives.
Over the past year, all three of the pump drives have failed at various times. Fortunately, crews were able to make temporary repairs to keep the drives operational. Given the age of these drives, and the ongoing failures, staff feels that it is prudent to replace all three (3) of the existing 20 HP pump drives with upgraded 25 HP drives to ensure that the wastewater treatment plant continues to operate efficiently.
The Scope of Work includes:
1. Telstar will supply and install three (3) NEW Altivar 630 25 HP drives. Note: We upsized the drive, from the existing 20 HP to a 25 HP drive.
2. Telstar will remove the existing plate for the remote HMI and install a new plate, a total of three (3) plates.
3. Telstar will supply and replace the same size intake fans, a total of three (3) fans.
Telstar will program and test the new drives.
Lump Sum Price for this Scope $25,481.00
(Shipping and Handling for Telstar Supplied Materials IS INCLUDED Sales Tax IS INCLUDED) Fiscal Impact: This project was included in the approved FY 2022/2023 CIP budget for wastewater - project number 107.441.080.003.
Prior Council/Board Actions: August 13, 2019 - Council approved appropriation of $12,000 for rebuilding the #3 influent wastewater pump. December 10, 2019 - Council approved appropriation of $11,796 for rebuilding the #1 influent wastewater pump. February 9, 2021 - Council approved an appropriation of $73,588 into capital account 107.441.080.017 and affirm the sole source emergency purchase from the only regional manufacturer representative, Shape Incorporated, for three (3) 15 HP Flygt pumps for the wastewater treatment plant.

Summary:
City staff previously submitted a grant application to the California State Park's Office of Grants and Local Services (OGALS) to improve two parks: Exeter City Park (on Chestnut Avenue & South E Street) and Unger Park (on Belmont Road & Glaze Avenue). The application was subsequently approved and the City is set to receive $177,952 in Per Capita Program grant funding for play structure improvements at the aforementioned parks.
Staff reached out to Miracle Playsystems, Inc. and obtained detailed plans and cost estimates to install additional rubberized flooring around the existing play structures at City Park, and to install a new play structure with rubberized flooring at Unger Park. Miracle Playsystems, Inc. is a member of Sourcewell, a public corporation serving as a municipal contract agency for government agencies. Sourcewell holds hundreds of competitively solicited cooperative contracts, including the proposed play structure improvement contracts that have been awarded to Miracle Playsystems, Inc.
Background:
Under the General Per Capita Program, the City was allocated $177,952 in Per Capita funds.
The grant funds are intended for local park rehabilitation, creation, and improvement. Stati submitted applications to revitalize the two parks: Exeter City Park (on Chestnut Avenue & South E Street) and Unger Park (on Belmont Road & Glaze Avenue).
The Per Capita Program was placed on the ballot via Senate Bill 5 and approved by the voters on June 5, 2028. It includes the General Per Capita Program and the Urban County Per Capita Program, which represent a combined total of over $198 Million in funding. The allocation is based on population of the cities, counties, or other eligible local districts. The Program is administered by California State Park's Office of Grants and Local Services (OGALS) with the intent of supplementing existing capital outlay expenditures for recreational purposes. Funds from the Per Capita Program may also be used for acquisition.
Fiscal Impact:
Staff worked with the OGALS representative to confirm that the 20 percent match is being waived because the parks are serving a severely disadvantaged community with median household income less than 60 percent of the statewide average. Additionally, the quotes indicate that the project will go over the funding limit by approximately $11,835.05 and the City received a donation pledge from a community partner, the Rocky Hill Triathlon group, to absorb this shortfall. Therefore, there is no financial impact to the General Fund.
Prior Council/Board Actions: November 9, 2021: The City Council adopted Resolution 2021- 28 Approving Applications for Per Capita Grant Funds.

Environmental Clearance: Not applicable for this project.

Department Recommendation:
Staff recommends that Council authorize the City Administrator to enter into a purchase agreement with Exeter Mercantile for a Wholegoods 2023 Kawasaki SX 4WD Fuel-Injected Gas Mule for the Recreation Department use.
Summary/Background:
The vehicle would be used to support the recreational programs needs in dragging, moving equipment, and field maintenance. The current vehicle is not capable to perform these tasks due to age and inability to hold a charge in spite of repairs and battery replacement.
Following the City's Purchasing Policy the following quotes for a Mules were obtained from the following vendors:
Exeter Mercantile (Gas) $10,425.48
Baker Supplies & Repairs (Electric) $19,485.00
Zeronox (Electric) $34,359.36
Despite the ongoing cost of the fuel, the first gas powered option is the best option for the City.
Cepartments unable to wait 1=2 years for the charging station instation an for is use and the purchase. Additionally, between the upfront cost of the higher purchase price, charging station installation, and the regular battery replacement cost considered, the bottom two are not the best options for the City. Furthermore, purchasing it from Exeter Mercantile meets local preference requirement. Due to the prolonged supply chain disruptions from the pandemic, additional quotes for other gas-powered carts (for a better comparison) was not an option based on the lengthy timeline to obtain quotes. Exeter Mercantile currently has availability of the cart proposed which may not be available in the future due to conversion to electric type vehicles to meet State requirements over the next couple of years.
Fiscal Impact:
There will be no negative impact as the purchase will be made with the raining funds from the budget for the Online Recreation Software ($60,000) starting in fiscal year 2023, which only used $9,198.66 of the budget.

"17.64.14 Mobile Food Vendors
The purpose of this section is to establish procedures and operational standards for mobile food vendors in Exeter. The City Council finds that the operation of mobile food vendors can provide a benefit to the community by increasing local access to alternative food retailers, which in turn stimulates community and economic activity. However, mobile food vendors also pose various potential hazards to the public health, safety, and welfare of the residents of the City. Therefore, the intent of the City Council, by enacting this Section, is to provide businesses and persons engaged with mobile food vending operations with clear regulations to preserve the health, safety, and welfare of the community.

Department Recommendation:
Staff recommends that Council receive an overview of the City's storm drain system, provide Council comments, and accept the updated Storm Drain Master Plan for the City of Exeter.
Summary:
The City of Exeter Storm Drain Master Plan was prepared to provide the City with a Capital Improvement Program to identify improvement projects for existing flooding issues and new development within the City's Sphere of Influence. The report is an update to the Storm Drainage System Master Plan prepared by QK in 2009.
The last system-wide hydrologic analysis was completed as part of the 1977 Storm Drain Master Plan. Therefore, a completely updated hydrologic and hydraulic analysis was performed as part of this Master Plan. The Rational Method was used to determine peak runoff from defined tributary areas throughout the City. The peak runoff was then incorporated into a hydraulic model to evaluate the City's existing storm drain system. The hydraulic model was developed using existing plans, Geographic Information System (GIS), and QK survey information. The hydraulic model confirmed the majority of the City's storm drain system is adequately sized and operating sufficiently for the 2-year design storm. The flooding issues observed by City staff were mostly the result of non-functioning bubble-ups in the downtown area and undersized gravity mains. The hydraulic model was used to help identity these areas in greater detail and model potential solutions. The drainage improvement projects were developed and assigned costs as part of a Capital Improvement Program. The Capital Improvement Program included project priorities based on the following categories:
• Near-term - Facility requirements needed to resolve existing drainage problems within the next five years.
• Mid-term - Facility requirements needed to resolve minor drainage problems of existing developed areas.
• Long-term - Facility requirements needed to provide drainage facilities to areas of future development.
The following Capital Improvement Program costs, by priority, have been developed:
Near-term $15,756,926
Mid-term (20% increase) $6,177,600
Long-term (25% increase) $15,061,406
Total Costs $36,995,932
The hydraulic model developed as part of this Master Plan is dynamic and should be updated to reflect any changes that would affect the City's storm drain system. It is recommended that City Council adopt this report as the City of Exeter's Storm Drain Master Plan and evaluate existing drainage fund reserves and developer impact fees to implement the Capital Improvement Program.
Background:
On January 27, 2020, the Department of Housing and Community Development released a Notice of Funding Availability under the Local Early Action Planning Grants Program (LEAP Program). The LEAP Program supports the state's commitment to work in partnership with local government agencies to address California's critical housing needs. Many local government agencies are using LEAP Program grant awards for the preparation and adoption of planning documents and process improvements.
The City of Exeter applied for LEAP Program funding to update its Storm Drain Master Plan to include an analysis for the integration of new development into the City's current infrastructure, an analysis of the demands on the current infrastructure including new development and establish a list of infrastructure needs to improve the current system and support new development.
In February of 2021, City staff received a Notice of Award from the Department of Housing and Community Development congratulating the City of Exeter on its successful grant application.
The notice served as a conditional commitment of an award in the amount of $65,000. An agreement between the City of Exeter and the Department of Housing and Community Development was executed on May 3, 2021. The City received a subsequent authorization to proceed with selecting a consultant to update its Storm Drainage Master Plan, and then submit expenditures for reimbursement.
QK Engineering submitted a proposal and cost estimate that included a basic plan update which consisted of researching, collecting, and/or calculating all of the required data, and updating the City's current Storm Drain Master Plan at a cost of $65,000.
Staff presented the basic plan update proposal at the City Council meeting of September 28, 2021, and the Council authorized the City Administrator to execute an Extra Work Authorization with the City's contract City Engineer firm - QK, in an amount not to exceed $65,000 to update the City's Storm Drain Master Plan.
After much discussion regarding the need for enhanced information on the City's current storm drain facilities, as well as future growth areas surrounding the community, staff reached out to QK about the possibility of enhancing the Storm Drain Master Plan update, which was already in progress, to include a full analysis with hydraulic modeling. With work on the basic update already well underway, QK responded with a price quote of $25,000 to perform the additional fine screening analysis and hydraulic modeling.
The additional $25,000 quoted for the fine screening analysis and hydraulic modeling took the total price of the Storm Drain Master Plan update to $90,000. This was $60,000 less than what QK originally quoted. Because the LEAP grant will reimburse $65,000 of the expenditures for the plan update, the total cost to the City would be $25,000, which could easily be funded from Storm Drain Impact Fees.
On May 10, 2022, the Council authorized the City Administrator to execute a second Extra Work Authorization with the City's contract City Engineer firm - QK, in an amount not to exceed $25,000 for enhanced updates to the City's Storm Drain Master Plan.
Fiscal Impact: During June 2020, the Council approved up to a $75,000 expenditure (120.541.080.015) for the project. The total cost of the Storm Drain Master Plan update will be $90,000. Because the LEAP grant will cover $65,000 of the expenditures for the plan update, only $25,000 will ultimately be taken from the Storm Drain Impact Fees. The current balance in the Storm Drain Impact Fee account is $15,469.05. We also have a pending reimbursement from LEAP in the amount of $65,000.
Prior Council/Board Actions:
During June 2020, the Council approved up to a $75,000 expenditure (120.541.080.015) for the project. On September 28, 2021, the Council authorized the City Administrator to execute an Extra Work Authorization with the City's contract City Engineer firm - QK, in an amount not to exceed $65,000 to update the City's Storm Drain Master Plan. On May 10, 2022, the Council authorized the City Administrator to execute a second Extra Work Authorization with the City's contract City Engineer firm - QK, in an amount not to exceed $25,000 for enhanced updates to the City's Storm Drain Master Plan.

Department Recommendation: (Initials Required)
Staff recommends that the Council discuss, consider and provide direction to staff regarding future City facility planning.
Summary/Background:
Over the last several years Council has given direction to staff to work on improving City resources so that the provision of services and projects to the community could be in turn improved. Funding has been a major focus since improving most other resources requires adequate funding. Many actions have been taken to improve City finances, such as utility rate right sizing, refinancing debt, allocation adjustments and implementation of a sales tax measure.
As these financial improvements come to fruition, one of the resources used by the City organization to provide services and projects to the community is facilities.
Due to the lack of finances in the past, City facilities have suffered and are quickly becoming an obstacle to providing services and projects. The Council Chambers at City Hall is extremely small and often overcrowded for the attendance at the Council meetings. Our current City Hall is overcrowded with staff and equipment and the interior temperatures in winter are very cold and, in the summer, reach the mid 80's. Similar conditions occur at the Police/Administration building with areas not well laid out for operations and many space heaters and makeshift coolers, such as window air conditioners, placed in an attempt to make the spaces bearable to work in. In addition, the exterior of the building has significantly deteriorated. Many of the issues at the Police/Administration building are being addressed with a current improvement project.
Planning and improving City facilities takes a significant amount of time and resources, so discussion and consideration of future plans need to begin. This planning will assist staff in understanding the long-term facility goals of the Council and determining appropriate interim solutions to accommodate additional staff and to build toward ultimate long-term facility solutions.
Some of the common considerations with facilities is location, space, relative costs and timeframe. For example, some City of Exeter considerations could be:
1.) Historical City Hall - Keep or not, also considering increased costs of keeping
2.) Increased cost of construction for public safety facilities versus non-public safety
3.) The level and timing of funding available for City Facilities
4.) Timeframes for expanding City services and projects that need additional facilities
5.) The ability to implement interim city facility solutions Fiscal Impact: None for this discussion. To be determined for future facility improvements.
Prior Council/Board Actions: Unknown

Recommended motion to be made by Council/Board: 1 move to provide direction to City staff as discussed regarding City facility planning.

Staff recommends that the Council discuss and give staff direction for expenditure plan of remaining funds from the Coronavirus Local Fiscal Recovery Fund established by the American Rescue Plan Act.
Summary:
As part of the Coronavirus State and Local Fiscal Recovery Fund (SLFRF) established by the American Rescue Plan Act (ARPA), the City of Exeter has received total funding of $2,508,234.
The City received the first half on July 13, 2021 and the second half in July of 2022. The draft Interim Final Rule and Guidance from the U.S. Department of the Treasury had laid out categories of eligible expenses, with several of the categories having certain restrictions on the amount and eligible expenses that could be covered in those categories. The City Council reviewed this information on July 27,2021 and directed staff to focus on three main categories of eligible expenditures listed in the Interim Final Rule and Guidance, including:
1) Premium Pay,
2) Revenue Loss and
3) Infrastructure (water and sewer).
On September 14, 2021 Council directed staff to 1) process premium pay of $5,000 per employee, with the exception of Department Heads and the City Administrator, in October 2021 and February of 2022, 2) develop a priority list of Revenue Loss expenditures up to $752,572 (the maximum allowed for the Revenue Loss category at that time) for Council review and approval and 3) begin planning infrastructure projects for the infrastructure funding of about $1.4M for Council consideration. On October 26, 2021, Council approved extending premium pay to all full time City employees. Based on the Interim Final Rule and Guidance premium pay cost was going to be approximately $310,000 of ARPA funding and $60,000 spread through other City funds.
At the September 14, 2021 Council meeting, staff provided some potential needs that SLFRF could be used to fund or assist in funding. Several of the items had some funding outside the SLFRF but not enough to fund without some contribution from the SLFRF.
In January of 2022, the U.S. Department of Treasury produced their Final Rule on the funding, and apparently to make the funding more flexible, increased the maximum allowed amount for the Revenue Loss category to $10,000,000, which is well above our current total allocation.
This allowed all of the City's SLFRF to be used in the most flexible and discretionary category allowed. It also allowed for the cost of all the premium pay, $370,000, authorized by Council to be paid from this funding. With this change there was approximately $2,138,234 remaining for other expenditures. City staff have tried to determine and propose potential needs to assist the organization in providing improved services and projects to the community that might otherwise be very difficult to fund in other ways.
On February 10, 2022, and August 23, 2022 Council approved the following expenditures from the SLRF, which have been completed:
1) Police Department Portable Radios $33,000
2) Arborist evaluation of City owned trees $35,000
Reconstruction of Industrial Lift Station $78,156
4) Purchase of Sewer Vactor Truck $519,984
Total = $666,140
Air conditioning repairs at City Hall and the Treatment Plant (up to $80,000) was previously approved by Council but some additional updates on costs have occurred and will be discussed below. With the premium pay and the costs of the above outlined needs paid from the SLFRF, approximately $1,472,094 would remain available for additional needs. Additional needs that staff have previously presented to Council at this point are:
1) PD/Admin Building Improvements $300,000
2) Air Conditioner Repairs/Replacements (Other than City Hall) $80,000 3) Air Conditioner Replacement City Hall $250,000
4) Information Techn.-phones/networks/website/cybersecurity $50,000 5) Downtown City Owned Street Light Improvements $400,000 6) Facility Security $50,000
7) Graffiti Abatement Equipment $15,000
Total =$1,145,000
Additional items Council may want to consider
8) Fire Hydrant Replacements - 12 In Operable $300,000
9) Sewer Infrastructure - Lift Station Upgrades $600,000 10) Dobson Field Fencing $100,000
11) City Hall/Council Chamber Improvements $4,000,000
The staff is currently working with an architect to complete design for the improvements to the PD/Admin building so that bids for the work can be obtained and actual costs evaluated. Some funding has been budgeted in Measure P and other City funds for these building improvements, but additional funding will likely be needed
Evaluation of the air conditioning needs for City Hall have been completed and it has been determined that due to the age and type of construction a traditional air conditioning system replacement is not going to improve the issues experienced in that building. An alternative system has been proposed, with a cost estimate of $250,000 for that building.
There are several needs for information technology. A hard line for data services is being installed for Public Works due to consistent issues with data service interruptions at that facility.
This new line cost is approximately $20,000. Due to insurance requirements from our Central San Joaquin Valley Risk Management Agency (CSJVRMA), the city is currently being evaluated for cybersecurity issues that may require correction to continue receiving insurance coverage.
The cost of addressing this issue will be evaluated once all vulnerabilities and their solutions are identified.
As part of the Clean California Grant application, staff is currently obtaining engineering cost estimates to improve the Downtown City owned streetlights. The current planning level total cost estimate is at about $400,000.
Currently, City facility security is minimal and should be bolstered in upcoming years.
Understanding the future direction of City facilities will assist in additional evaluations needed to determine what facility security measures could be made and their costs. This item is estimated at $50,000 but should be brought back after further evaluation.
In the past graffiti abatement has been directly considered for funding and equipment.
However, in recent years this issue has grown in the community with private properties being heavily affected. Setting up a properly funded and organized graffiti abatement program would be an important asset for the community.
Based on rough estimates staff believes there would be enough remaining SLFRF funding to cover these needs close to that originally directed by Council.
As the City grows in the future to provide the projects and services needed in the community the Council will need to keep an eye toward City facilities. Adequate space for Council meetings with public attendance and room for staff to work has dwindled considerably and hasn't left room for growth in multiple areas.
There are significant improvements that can be funded in the areas of water, sewer, roads and parks. Water and sewer components, such as water production wells (new and rehab), water storage tanks, pipeline and valve replacements, lift station upgrades and increasing wastewater treatment capacity and road improvements and rebuilds are some just to name a few.
However, many improvements over the last several years are beginning to come to fruition that should assist in these areas, such as the utility rate increases that are nearly complete and Measure P. In addition, the water system improvements being brought about by State grant funding in connection with the Tooleville consolidation will assist in addressing millions of dollars of current water system needs. This mix of funding from the different sources should begin addressing the more significant needs of the water, sewer and roads in the coming years.
SLFRF funds must be obligated by December 31, 2024, and expended by December 31, 2026.
The City must take all responsibility for interpreting the Final Rule and the expenditures meeting the rule. The City must also submit a project and expenditure report to the U.S. Department of the Treasury annually on the use of funds. The first report was due April 30, 2022, with on- going reports required each subsequent year. Financial records relating to the funds and expenses must be retained for 5 years after all funds have been expended. This funding does not require the City to maintain a local emergency declaration.
Background:
The American Rescue Plan Act (ARPA) established the Coronavirus State and Local Fiscal Recovery Fund (SLFRF) to provide support to State, local, and Tribal governments responding to the impacts of COVID-19 on their communities, residents, and businesses. This funding includes $1.2 billion distributed to 291 small California cities (population less than 50,000) by population based on 2019 U.S. Census data. The State assumes the ministerial role of disbursing the funding to these small cities under the category of non-entitlement units (NEU's).
The NEU's were required to accept or decline the funds and provide basic data by June 23, 2021 to receive the funding. The amount of funding received by cities could not exceed more than 75 percent of their total operating budget in effect as of January 27, 2020. The City of Exeter's total available funding is $2,508,234, with the first half received on July 13, 2021 and the other half received 12 months later. Currently, this funding is slated to be one-time funding.
The U.S. Department of the Treasury Interim Final Rule and Guidance outlined eligible uses of the funding and requirements for expending and reporting. Those eligible uses are:
a) To respond to the public health emergency or its negative economic impacts, including assistance to households, small businesses, and nonprofits, or aid to impacted industries such as tourism, travel, and hospitality. b) To respond to workers performing essential work during the COVID-19 public health emergency by providing premium pay to eligible workers. c) For the provision of government services to the extent of the reduction in revenue due to the COVID-19 public health emergency relative to revenues collected in the most recent full fiscal year prior to the emergency. d) To make necessary investments in water, sewer, or broadband infrastructure There are some restrictions on the use of this funding including no contributions toward pensions, building of reserves or debt financing.
Fiscal Impact: Using this funding adds $2,508,234 of one-time available funds for a variety of potential uses. The proposed uses would also meet the Council's Financial Policy for expenditure of one-time funding. This funding may offset budgeted expenses depending on which use(s) are selected. If an expenditure is not accepted by the U.S. Treasury when the reports are submitted, the City would be responsible to cover the cost.
Prior Council/Board Actions: Council direction provided on July 27, August 10, August 24, September 14, October 26, 2021 and February 10, 2022.
