Department Recommendation:
Staff recommends that the Council approve a request for facility use for the Exeter Lions Club to host an Independence Day Fireworks Show at Dobson Field, with a $50 fee waiver, subject to the terms and conditions presented by staff.
Summary/Background:
It is the request of the Lions Club to host a free community Independence Day Celebration at Dobson Field. This event traditionally draws thousands of people and the aerial show is enjoyed for many miles. A fee waiver of $50 is requested with this show which is free to the public. As they have done since the initiation of COVID protocol, the fireworks will be aerial only with no public admittance to Dobson Field or Lion's a Stadium. Lions Club members will staff the parking lot to prevent admittance. Due to the rising cost of fireworks, insurance and the pyrotechnic company fees, the Lions Club will host the fireworks event on July 2nd rather than July 4*. In addition to cost savings and the afternoon concert at the Memorial Building, this will allow for a full day of celebrating Independence Day.
1) Event set up will begin at 8:00am with clean up concluding prior to 11:00pm.
The city will provide road closure barricades.
3) All potential entrance/exits will be required to be closed to the public. 4) Group will provide all necessary application, permit fees and insurance requirements 5) Group will require the use of overhead lighting
Staff recommends that Council approve the Facility Use Permit Application subject to the above conditions outlined by staff.
Fiscal Impact: None to the City.
Prior Council/Board Actions: None for this event.
Attachments: None
Recommended motion to be made by Council/Board: I move to approve the special event at Dobson Field for the Exeter Lions Club on July 2, 2023 from 8:00 a.m. to 11:00 p.m., and the $50 tee waiver and authorize the Independence Day Fireworks Show, subject to the conditions as presented by staff.

Department Recommendation:
Staff recommends that the Exeter City Council adopt Resolution 2023-20 as presented.
Summary/Background: Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and Signed into law by the Governor in April 2017, to address some of the significant multi-modal transportation funding shortfalls statewide. As a result, the City, will receive an estimated $250,894. in Road Maintenance and Rehabilitation Account (RMRA) funding in Fiscal Year 2023/24 from SB 1.
SB 1 includes accountability and transparency provisions to ensure the residents of our City are aware of the projects proposed for funding in our community. To that extent, the City, must annually prepare and submit a list of all projects proposed to receive funding from the RMRA, created by SB 1.
The project list being recommended by staff represents the City's most urgent projects to ensure revenues are being used on the most high-priority and cost-effective projects that also meet the community's priorities.
The project that has been identified is:
Glaze Avenue Cape Seal and Micorsurfacing Project:
This project will include Glaze Avenue between SR 65 and Belmont Road. The project will consist of raising valve boxes and manholes and patching and repairing asphalt concrete where needed, as well as the application of Type III Cape Seal or Slurry Seal and striping. The estimated useful life of this treatment to the roadway is approximately 8 - 12 years. As part of this project, necessary ADA concrete improvements will also be constructed. Construction is anticipated to begin this summer. This project is consistent with the Department's recommendation that the RMRA funds be used to preserve the City's street investment. By applying cape seals, slurry seals, or other appropriate rehabilitation applications to streets, the pavement life is extended in a good condition. Like projects will be proposed in the future.
If it is determined that conditions or priorities have changed, the City Council may redirect this funding to other projects at a future date.
Fiscal Impact: The City will receive an estimated $250,894. in RMRA funding in Fiscal Year 2023/24 from SB 1. Those funds, along with previous years allocations which total approximately $564,000. will be utilized for the aforementioned project.
Prior Council/Board Actions: Numerous actions pertaining to the approval of prior fiscal year project lists.

Department Recommendation:
Staff recommends that Council hold the public hearing and adopt Resolution 2023-21 establishing an FY 2023-2024 General Fund appropriation limit of $10,666, 171.
Summary/Background:
In 1979, California voters approved Proposition 4, informally known as the "GANN Initiative", which provides limits to the amount of tax proceeds state and local governments spend each year. Annually City Council is required to establish an appropriation limit for the City of Exeter to comply with this legislation. The California Revenue and Taxation Code, Section 2227, mandates that the State Department of Finance transmit an estimate of the percentage change in population at the beginning of the year to local governments which is the basis for this calculation (See Attachment B).
The State of California provides the population and California per capita personal income change data for local jurisdictions to calculate their appropriations limit. Each local jurisdiction must use the percentage change in population factor from January 1, 2023, in conjunction with a change in the cost of living or cost factor, to calculate their appropriations limit for fiscal year 2023-2024. As shown on the Attachment A, the percentage change of personal income per capita over the prior year was 4.44 (a 41% decrease from January 1, 2022). The population percent change for Exeter was -0.65 percent (a further decline from the prior year of -0.47).
Based on this information, the 2023-2024 General Fund appropriation limit for the City of Exeter is $10,666, 171 as shown in Table 1. The GANN limit increase from $10,279,543 (FY2022/2023) to $10,666, 171 is mainly from the increase in state-wide per capita personal income.
The General Fund is the only fund subject to the appropriation limit mandated by the State. The adopted appropriation for the General Fund for FY2023-2024 is $5,794,610 which represents 54% of the appropriation limit. Any challenge must be brought within 45 days from the effective date of the resolution.

RESOLUTION 2023-21
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EXETER
ESTABLISHING THE FISCAL YEAR 2023-2024 APPROPRIATIONS LIMIT WHEREAS, IN 1979, California voters approved Proposition 4 (Article XIII-B of the California State Constitution), informally known as the "GANN Initiative" ", which provides limits to the amount of tax proceeds state and local governments spend each year; and WHEREAS, in 1980, the State Legislature added Section 9170 of the Government Code stating that the governing body of each City must establish by resolution, an appropriation limit for the following year. The limit for any fiscal year is equal to the previous year's limit, adjusted for population changes and the change in the U.S. Consumer Price Index (or California per. capita personal income, if smaller). The information is provided by the California Department of WHEREAS, Proposition 111 modified Article XIII-B. A City may choose which annual adjustments to use. The adjustment factors include the growth in the California Per Capita Income, or the growth in the non-residential assessed valuation due to construction within the City and the population growth within the City or county.
IT IS NOW THEREFORE RESOLVED THAT; the appropriations limit as defined by Propositions 4 and 111 is set at $10,666,171 for the 2023-2024 fiscal year using the personal income per capita change of 4.44 and the population percent change of -0.65 as established by the Department of Finance.

Staff recommends that Council discuss and direct to either appoint a new candidate or solicit applications for candidates for the City of Exeter's representative on the Measure R Citizen's Oversight Committee for a 2-year term beginning July 1, 2023.
Summary:
The City of Exeter has a community representative position on the Measure R Citizen's Oversight Committee. Robyn Stearns has been the citizen representative for the City on this committee and her current term expires June 30, 2023. The Tulare County Association of Governments has requested that the Council make an appointment to this committee for another two-year term. Although Ms. Stearns has expressed her willingness to serve an additional two-year term, she has already served a total of 8 years on the committee, which is the maximum appointment length allowed. The Council could choose, or solicit for, other candidates to fill the term if they so choose.
Background:
On November 7, 2006, the voters of Tulare County approved Measure R, imposing a 1/2 cent sales tax for transportation within the incorporated and unincorporated area of Tulare County for the next 30 years. The transportation measure will generate slightly more than $652 million over 30 years to Tulare County's transportation needs.
The Citizens' Oversight Committee consists of 16 members and is designed to reflect the diversity of the County of Tulare. The purpose of the committee is to provide input on implementation of the Measure R Expenditure Plan, and to advise the Authority Board if and when the plan needs to be augmented and to ensure that the funds are being spent in accordance with the plan. The committee is also responsible for informing the public and ensuring that the transportation measure expenditures are made in accordance with the plan and in the best interest of the residents of the county.
The committee meets quarterly and reviews transactions of Measure R and discusses upcoming projects. They have received multiple presentations on the usage of Measure R funds from member agencies. The committee has scrutinized multiple projects and shown a great interest in making sure Measure R funds are used to their maximum capacity.
Fiscal Impact: None directly to the budget. However, this position would assist in advocating for City projects that could benefit from Measure R funding.
Prior Council/Board Actions: Previous appointments to the committee.
Attachments: None
Recommended motion to be made by Council/Board:
|l move to:
1) Appoint a new candidate to the two-year term on the committee, OR
2) Solicit for potential candidates to fill the two-year term on the committee.

Department Recommendation:
Staff recommends that Council receive information regarding the proposed landscape conversion for the downtown area bulb-outs, provide input, and direct staff on preferred alternatives for ground cover.
Summary/Background:
In an effort to enhance water conservation and freshen up the look of the downtown area, the plants and vegetation, staff desires to re-landscape the bulb-outs with a more drought tolerant and aesthetically pleasing design. Much of the existing vegetation had been lost due to on-going improvement project that was designed over ten (10) years ago. This was well before the severe drought conditions developed across the state of California, which forced cities to re- think landscape design strategies.
Staff is proposing to modify the landscape design to enhance water conservation and minimize future landscape maintenance. The new design would include drought tolerant vegetation similar to what was used in the newly constructed Visalia Road medians, with rock or mulch as ground cover. Given our current staffing challenges and continuing drought conditions, staff feels this is a prudent approach to the long-term sustainability of the downtown landscape.
There are a variety of options for ground cover which include wood mulch or rock. Rock options include the California Gold Rock that was previously approved by Council for use on the Visalia Rd. project, and a similar material called Mojave Gold Rock. Many surrounding cities have transitioned to the Mojave Gold Rock as it's approximately 1/3 of the cost of the California Gold and is more readily available. This material has a richer tone (more orange) than the California Gold which has a yellow tone with a matte look. Another rock option is the stone-colored pea gravel used by the Garden Club at the corners of Pine and E Steet. Staff is seeking concurrence from the Council on the proposed design and input as to which ground cover material is preferred.
Fiscal Impact: The full fiscal impact of this project could range between $5,000. - $10,000. depending upon which ground cover materials are chosen. The project will be paid for using available street funds.
