Adopt a Resolution Authorizing the Town Manager to Issue a Notice of Completion for the 145 Canyon Road Retaining Wall Repair and Road Restabilization Project
RECOMMENDATION
Authorize the Town Manager to issue a Notice of Completion for the 145 Canyon Road retaining wall repair and road re-stabilization Project.
DISCUSSION
On August 2, 2023, the Town Council authorized the Town Manager to award the 145 Canyon Road Retaining Wall Repair and Road Re-stabilization construction contract to RWR, Inc for the total price of $406,588. The Council also approved a project contingency of $40,658 for a total of up to $447,246.
Staff approved $18,208 in additive change orders for the project related to encountered field conditions.
RWR’s project scope was completed by the end of November 2023 for a total cost of $424,796.
The project was complicated by the fact that work took place within the creek limits. Staff and consultants worked with the California Department of Fish and Wildlife to alert them to our schedule and any changes. Ultimately the project had no issues with any regulatory agencies.
Upon the recordation of the Notice of Completion, staff will make final payments to RWR, Inc for their work.
FISCAL IMPACT
The total project cost was $424,796, which represents approximately a 4.5% increase in cost over original contract, which is very positive given the potential for significant challenges at the job site.

RESOLUTION 24-__
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF FAIRFAX DIRECTING THE ISSUANCE OF A NOTICE OF COMPLETION FOR THE 145 CANYON
ROAD RETAINING WALL AND RESTABILIZATION PROJECT
WHEREAS, On August 2, 2023, the Town Council authorized the Town Manager to award the 145 Canyon Road Retaining Wall and Road Restabilization construction contract to RWR, Inc for the total price of $406,588 and the Council also approved a project contingency of $40,658 for a total of up to $447,246; and
WHEREAS, Staff approved $18,208 in additive change orders; and WHEREAS, RWR’s project scope was completed by the end of November 2023 for a total cost of $424,796, approximately 4.5% over original contract cost; and WHEREAS, Staff has received, reviewed and approved all invoices associated with said Work by RWR, Inc for payment in full; and
NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Fairfax hereby accepts the Work as complete and directs that a Notice of Completion be issued.
The foregoing resolution was duly passed and adopted by the Town Council of the Town of Fairfax at a duly noticed meeting held in said Town on the 10th Day of January 2024 by the following vote:
