SUBJECT Adopt a Resolution Authorizing the Town Manager to Issue a Notice of Completion for the Rockridge Storm Drain Improvement Project
RECOMMENDATION
Authorize the Town Manager to issue a Notice of Completion for the Rockridge Storm Drain Improvement Project
BACKGROUND
On March 26, 2024, the Town Council authorized the Town Manager to award the construction contract for the Rockridge Storm Drain Improvement Project to John Boylan Engineering Inc. The contract was approved at $40,700, with an additional project contingency of $4,070, totaling $44,770.
During the project, staff approved changes in the scope of work, resulting in a total project cost of $38,500, which is $2,200 under the original contract price.
DISCUSSION
The Rockridge Storm Drain Improvement Project was completed successfully and under budget. The project, initially estimated at $40,700 with a $4,070 contingency, resulted in a final cost of $38,500. The completion of this project addresses critical stormwater management needs in the Rockridge area and enhances the infrastructure's resilience.

NOTICE OF COMPLETION
NOTICE IS HEREBY GIVEN that the undersigned Town of Fairfax, 142 Bolinas Road, owners, caused certain construction work to be performed within the County of Marin, which work is generally described as follows (including address):
The Rockridge Storm Drain Improvement Project located at Intersection of Iron Springs Road to add additional storm drain Inlets and Improve drainage.
That the contract for the performance of such work was awarded to John Boylan Engineering. Inc, and that said work was completed on the 1st day of June 2024, and that said John Boylan Engineering, Inc., was the contractor.
This notice is given pursuant to Section 3094 and 3129 of the Civil Code of the State of California.
This is to certify that the Notice of Completion above is hereby authorized by minute action of the Town Council of the Town of Fairfax on August 7, 2024, and owner consents to recordation thereof by its duly authorized officer.

RESOLUTION 24-
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF FAIRFAX
DIRECTING THE ISSUANCE OF A NOTICE OF COMPLETION FOR THE ROCKRIDGE
STORM DRAINAGE IMPROVEMENT PROJECT
WHEREAS, on March 26, 2024, the Town Council authorized the Town Manager to award the construction contract for the Rockridge Storm Drain Improvement Project to John Boylan Engineering, Inc., at the total price of $40,700, with an additional project contingency of $4,070, making the total budget $44,770; and
WHEREAS, during the project, staff approved changes in the scope of work that ultimately resulted in the project having a total cost of $38,500, which is $392 below the original contract price; and
WHEREAS, the project was completed successfully, coming in at 5.5% lower than the original contract price; and
WHEREAS, staff has received, reviewed, and approved all invoices associated with the work by John Boylan Engineering, Inc., for payment in full; and WHEREAS, the completion of this project addresses critical stormwater management needs in the Rockridge area and enhances the infrastructure's resilience; and NOW, THEREFORE, BE IT RESOLVED, that the Town Council of the Town of Fairfax hereby accepts the Rockridge Storm Drainage Improvement Project as complete and directs that a Notice of Completion be issued.
The foregoing resolution was duly passed and adopted by the Town Council of the Town of Fairfax at a duly noticed meeting held in said Town on the 7th Day of August 2024 by the following vote:
