FAIRFAX TOWN COUNCIL MEETING

STAFF REPORT
AGENDA ITEM #15
MEETING DATE November 6, 2024
PREPARED FOR Mayor and Town Council
PREPARED BY Heather Abrams, Town Manager
SUBJECT Authorize the Town Manager to Pay Fairfax’s Contribution of $27,642.44 to the Marin Countywide Stormwater Pollution Prevention Program (MCSTOPPP) Baseline Program for Fiscal Year 2024-2025

RECOMMENDATION
Authorize the Town Manager to pay the Town of Fairfax's required contribution of $27,642.44 to the Marin County Stormwater Pollution Prevention Program (MCSTOPPP) for Fiscal Year 2024-2025.

BACKGROUND
The Marin County Stormwater Pollution Prevention Program (MCSTOPPP) is a countywide effort aimed at reducing stormwater pollution and ensuring compliance with state and federal water quality standards. All municipalities in Marin County, including Fairfax, contribute annually to fund the baseline program, which implements stormwater pollution prevention initiatives in compliance with the National Pollutant Discharge Elimination System (NPDES).

The contribution amount for each municipality is determined by a weighted formula based on population and area. The Town of Fairfax has participated in this program for several years, and the FY 2024-2025 contribution of $27,642.44 represents Fairfax's share of the $950,000 total program cost approved by the Marin General Services Authority (MGSA) and the Marin County Flood Control and Water Conservation District Board of Supervisors.

DISCUSSION
The required contribution of $27,642.44 is part of the Town’s ongoing obligation to support the regional stormwater pollution prevention efforts. While the amount is slightly above the Town Manager’s authority to approve expenditures (which is capped at $25,000), this payment ensures that Fairfax remains compliant with regulatory requirements under the NPDES and continues to support vital environmental programs in Marin County.

This payment was not unexpected, and the contribution amount is consistent with previous years.

MCSTOPPP remains an essential program to help minimize pollutants entering local waterways, thus protecting public health and the environment.

FISCAL IMPACT
The contribution of $27,642.44 was included in the Town's approved budget for FY 2024-2025 and will be paid from Fund 01-510-823.

To: County Administrator and Marin City and Town Managers From: Rob Carson, Stormwater Program Administrator, MCSTOPPP RE: MCSTOPPP INVOICES for Fiscal Year 2024-2025
Please see the attached invoice(s) for payment into the Marin County Stormwater Pollution Prevention Program (MCSTOPPP), administered by the Marin County Flood Control and Water Conservation District (District). The total MCSTOPPP baseline municipal contribution for FY 24-25 is $950,000. The allocation of municipal contributions is based on a weighted formula using population and area for the cities and towns and population only for the unincorporated County. The attached invoice #MC2025-BPC defines the amount of each municipality's baseline contribution to MCSTOPPP in FY 24-25.

The baseline program contribution was included in the MCSTOPPP 2024-25 workplan and budget approved by the MCSTOPPP Agency Staff Committee, recommended by the Marin General Services Authority and adopted by the Marin County Flood Control and Water Conservation District Board of Supervisors. Please let MCSTOPPP staff know if you have questions. Thank you for your attention to this matter and for your participation in MCSTOPPP.
