SUBJECT Adopt a Resolution Authorizing the Town Manager to Execute and Pay for a Change Order for the 103 Rocca Project for Additional Mobilization Costs in the Amount of $32,155
RECOMMENDATION
Adopt a resolution authorizing the Town Manager to execute a change order with RWR Inc. for the 103 Rocca Project to cover additional mobilization costs of $32,151.
BACKGROUND
RWR Construction, Inc (RWR) was awarded the project to install a retaining wall at 103 Rocca.
The project aims to prevent slope failure, which could result in property damage and road closure.
Given the narrow streets and urgency to complete the work before winter, the Town permitted RWR to close Rocca Drive during the project. Local residents could still access the street from either direction, but through traffic was restricted to expedite completion.
After the project started, the Ross Valley Fire Department (RVFD) raised concerns that the road closure could impede emergency vehicle access, potentially increasing response times.
DISCUSSION
To address RVFD’s concerns and maintain public safety, RWR will need to remove their equipment, specifically a mini excavator, from the site daily. This change ensures emergency access after work hours, but requires early morning and later evening mobilization, leading to additional costs of $32,151.
FISCAL IMPACT
The original contract for the 103 Rocca project is $234,643 with a 10% contingency of $23,463, for a total budget of $258,106. The change order exceeds the contingency by $8,688, increasing the total project cost to $266,794.

JOB: 103 Rocca Drive Roadway Stabilization and Retaining Wall Project The construction agreement dated 9/13/2024, between Town of Fairfax, CLIENT and RWR Construction, Inc. GENERAL CONTRACTOR is hereby modified by the following deviations from original plans and specifications:
Daily Equipment Mobilization
• Per Ross Valley Fire Department and Town of Fairfax orders, mobilize and demobilize equipment daily from Rocca Dr. project. See attached cost breakdown sheet.
Cost: $32,151.00
It is mutually agreed that for such changes the contract price is increased by a total cost of:
$32,151.00 payable with the payment becoming due under the original construction agreement.
Time for completion of the above cited contract/subcontract work is hereby increased by 8 days beyond any completion date set forth in the original Contract for such work. All the provisions of the original Contract and agreement shall remain in full force and effect, without change because of above deviations.

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF FAIRFAX
AUTHORIZING THE TOWN MANAGER TO EXECUTE AND PAY FOR A CHANGE ORDER FOR THE 103 ROCCA PROJECT WITH RWR INC. TO COVER ADDITIONAL MOBILIZATION COSTS IN THE AMOUNT OF $32,151
WHEREAS, the Town OF Fairfax has contracted with RWR Construction, Inc. (RWR) to install a retaining wall at 103 Rocca to prevent slope failure that could lead to property damage and potential road closure; and
WHEREAS, the Ross Valley Fire Department (RVFD) raised concerns that the road closure could impede emergency vehicle access, thereby necessitating modifications to the construction plan; and
WHEREAS, in response to RVFD’s safety concerns, RWR agreed to remove equipment from the construction site at the end of each workday, ensuring emergency vehicle access during non-working hours; and
WHEREAS, the additional mobilization required to comply with RVFD’s recommendations will result in increased costs totaling $32,151, exceeding the original project contingency by $8,688 and bringing the total project cost to $266,794; and
WHEREAS, sufficient funds are available within the overall capital improvement budget to accommodate this change order, ensuring the project remains funded; NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Fairfax hereby authorizes the Town Manager to execute a change order with RWR Construction, Inc. in the amount of $32,151 to cover the additional mobilization costs associated with the 103 Rocca Project; and
PASSED AND ADOPTED by the Town Council of the Town of Fairfax at a regular meeting held on the 6th day of November 2024 by the following vote:
