FAIRFAX TOWN COUNCIL MEETING

STAFF REPORT
AGENDA ITEM 4.e
MEETING DATE January 9, 2024
PREPARED FOR Mayor and Town Council
PREPARED BY Loren Umbertis, Public Works Director
SUBJECT Adopt a Resolution for the Approval of the Notice of Completion for the Tamalpais/Berry Retaining Wall Repair and Road Re-stabilization Project

RECOMMENDATION
Adopt the resolution authorizing the Town Manager to issue a Notice of Completion for the Tamalpais/Berry Retaining Wall Repair and Road Re-stabilization Project.

DISCUSSION
On July 17th, 2024, the Town Council authorized the Town Manager to solicit bids and to award a contract for the reconstruction of a failed retaining wall at the intersection of Tamalpais and Berry Trail if received bids did not exceed $400,000. The Town received multiple bids for the project and the project was awarded to RWR Construction Inc for a total price of $252,836. The Contract was executed on September 13, 2024.

Staff approved $27,055 in additive change orders for the project related to changing from wood-lagging wall to a concrete wall ($24,985) which will improve the longevity of the wall which is important due to the proximity of a critical Marin Municipal Water District Pump Station facility, in addition there was a small change order for replacing the asphalt ($2,070). RWR’s project scope was completed by the end of November 2024 for a total cost of $277,821.

The Work was substantially completed prior to the onset of winter rains which, had the wall not been in place, could have led to significant complications or additional erosion or increased damage to the street.

Upon the recordation of the Notice of Completion, staff will make final payments to RWR, Inc for their work.

FISCAL IMPACT
The total project cost was $277,821, which represents approximately a 9.88% increase in cost over original contract, which is very positive given the accelerated pace of design and construction.
