STAFF REPORT

Page 1 of 2 ends

MEETING DATE July 22, 2026
PREPARED FOR Mayor and Town Council
PREPARED BY Jeffrey Beiswenger, AICP, Planning & Building Services Director SUBJECT Adopt a Resolution Authorizing Execution of a Three-Year Cooperation Agreement with the County of Marin for the Community Development Block Grant (CDBG) and HOME Programs

RECOMMENDATION
Adopt a Resolution Authorizing Execution of a Three-Year Cooperation Agreement with the County of Marin for the Community Development Block Grant (CDBG) and HOME programs.

DISCUSSION
The Community Development Block Grant Program (CDBG) provides grants from the U.S. Department of Housing and Urban Development (HUD) to local governments for housing, community facilities, and public service programs serving lower-income people. The HUD Home Investment Partnerships Program (HOME) provides additional assistance for affordable housing activities. Marin County qualifies for both the CDBG and HOME programs because the cities have signed cooperation agreements to participate with the County government in a single joint countywide program. This qualifies Marin County as a HUD “urban county,” enabling Marin to receive annual CDBG and HOME grant allocations established by formula.

Marin County qualifies for federal funding from the CDBG Program because Cities, Towns and the County have, through cooperation agreements, joined together to form a consortium referred for purposes of CDBG and HOME federal funding as an "urban county" which meets the program's qualification requirements for annual formula funding, providing a reliable and non-competitive source of federal revenue for local projects. Marin County's status as a CDBG "urban county" also qualifies it for formula funding from the HOME Program, allowing for a coordinated regional approach through the County's five-year Consolidated Plan. Every three years the County, Cities and Towns must renew the Cooperation Agreements, and the new agreement covers fiscal years 2026 through 2028.

Benefits of applying together as an ‘urban county’, means that Marin County receives these noncompetitive funds which are vital to projects which serve Fairfax residents, including:
• Fairfax Vest Pocket – low-income family housing
• Fairfax San-Anselmo Children’s Center – public services and capital project support • Piper Court Apartments – preserved affordable rental housing • Legal Aid of Marin
• Fair Housing Advocates of Northern California
Victory Village was also a previous recipient of funds.

The Town participates in CDBG and HOME funding decisions through the Countywide Priority Setting Committee, staffed by the Marin County CDA, Housing and Grants Division. Councilmember Coler serves as our Council representative and Phillip “P.J.”. Feffer serves as a community representative currently serves on the committee. Some years ago, the County added community representatives from protected classes to the PSC in addition to elected representatives. P.J. Feffer also serves as a Fairfax Planning Commissioner.

The Marin County CDBG Cooperation Agreement began in 1974. The agreement allows for small towns and cities in Marin County to combine populations to get federal grant money. The towns and cities would not qualify for the federal grant money independently. In 2014, all eleven Marin cities/ towns entered into three-year CDBG Cooperation Agreements enabling us to obtain formula funds as an urban county. In 2017, 2020 and 2023 the Council approved the renewal of the Cooperation Agreement to remain eligible to receive funds.

In order to continue the CDBG and HOME programs in Marin County, all cities and towns are being asked to renew their Cooperation Agreements and deliver them to the County.

The attached 2026 Cooperation Agreement is similar to the 2017, 2020 and 2023 agreements. The County receives notice from HUD every three years and the agreement typically needs to be changed with new or modified language from HUD. The 2026 agreement includes a rollover provision, so that it will stay in effect for federal fiscal years 2030, 2031 and 2032 without the need for a new agreement.

FISCAL IMPACT
The Town does not receive funds directly from this program, but the CDBG/HOME allocations county wide would be impacted without this agreement.
