STAFF REPORT

Page 1 of 1 ends

MEETING DATE September 2, 2026
PREPARED FOR Mayor and Town Council
PREPARED BY Christine Foster, Assistant to the Town Manager/Deputy Town Clerk SUBJECT Pursuant to Town Code Section 2.08.090, a Residents’ Petition was Received Regarding Cannabis – Petitioner: Martin Kaufman

RECOMMENDATION
Hear the petition and direct staff as appropriate.

BACKGROUND
Pursuant to Fairfax Municipal Code Section 2.08.090 (C), if the Council is presented with a petition signed by 25 Fairfax residents urging consideration of an issue, the issue shall be placed on the Council’s agenda for discussion.

DISCUSSION
On August 17, 2026, a residents’ petition was submitted to the Town for the Council’s consideration.

The agenda item requested is as follows:
“Consideration and adoption of an ordinance amendment to Chapter 5.56 of the Fairfax Municipal Code to authorize the Town's currently permitted medical cannabis storefront location(s) to also conduct adult-use (recreational) cannabis sales to persons 21 and older at the same existing location(s), subject to all applicable state and local age restrictions (21+), safety requirements, and regulations. This amendment applies only to existing permitted sites, involves no new locations, no change to the two-business cap, no zoning amendments, and no new environmental or traffic impacts.”
The Town Clerk’s Office sent the petition to the Marin County Registrar of voters for signature verification. The petition contains at least 25 signatures of Fairfax residents as required by Fairfax Municipal Code Section 2.08.090(C).

The petitioner will be present at the meeting to make a brief presentation. After the presentation and public comment, the Council may discuss the matter and direct staff as needed.

FISCAL IMPACT
Not applicable at this time. Any fiscal implications of Council direction would be addressed in a future staff report.
