You must use a bore sight laser or a larger over the barrel laser adapter. 4300-12 TACTICAL BARREL (12" TITANIUM) 1 4341 T3 PRO BREECH CAP 1 K4350PL PUSH LOCK BREECH PLUG-Assembled 1 7100 SHELL EXTRACTOR 1 7280 WATER BOTTLE 1 K3095T RED AND BLACK PUGS (15 EA) 1 4330 T3 THREAD PROTECTOR 1 2001 SEATING TOOL 1 7110 FIRING PIN TOOL 1 7250PL 7/16 NUT DRIVER 1 K3010PL PUSH LOCK BREECH PARTS KITContains: (4)Push Lock Y Fittings; (2)Push Lock Couplings; (2)Firing Pins;(3)Springs; (1)Push Lock Fitting 1 2045 GUN BORE CLEANING KIT 1 3130 WD-40 1 K3150 ROBOT DISRUPTER SLEEVE (W/GREN LASERS) with Mini-CALIBER mount 1 3153 8' PARACORD LANYARD 1.

Dear Valued Customer,

Thank you for your continued interest in Sky-Hero. We are thrilled to share that Sky-Hero has joined forces with Axon through a recent acquisition. Over time, Sky-Hero’s products will integrate into the Axon organization and become Axon’s first suite of tactical uncrewed vehicles. Sky-Hero products will augment the existing Axon Air portfolio, which includes drone operations software, hardware and professional services from leading third-party providers.

Recognizing that Axon is a much larger-scale, publicly traded company, there is a need for heightened diligence throughout the integration. As part of a routine compliance review, we are temporarily pausing sales of some Sky- Hero products, including the Loki, Sigyn, and Narfi devices, in the United States. This will allow Axon to carefully assess and implement a plan to ensure Sky-Hero’s products meet applicable compliance standards and adhere to all regulatory requirements.

We are sorry that this temporary pause causes inconvenience and are committed to working diligently to resume sales as soon as possible. I want to emphasize that this review has no impact on support, warranty and service on all existing products you have already purchased from Sky-Hero, or their distributor, Aardvark. Additionally, ground control systems, tactical screens, payloads, accessories, spare parts, batteries and chargers will continue to be available for sale.

If you have any questions or concerns, we are here to support you. Please do not hesitate to reach out to me or your Axon, Sky-Hero, or Aardvark customer success representative.

Sincerely,

Aydin Ghajar
General Manager, Axon Air

Agenda Item No: 14.

AGENDA REPORT
DATE:January 16, 2024
TO:Mayor and City Council
FROM:David Gassaway, City Manager
SUBJECT:Resolution 202410 of the City Council of the City of Fairfield Authorizing the Police Department’s Exchange of PepperBall Patrol Carbine Model Launchers with PepperBall Tactical SemiAutomatic Model Launchers and Update to the Police Department’s Lexipol Policy 711 to Reflect the Change in Inventory, in Accordance with City Ordinance 202206
RECOMMENDED ACTION
Adopt resolution.

STATEMENT OF ISSUE
The Police Department’s PepperBall brand less lethal PepperBall Patrol Carbine (PPC) launchers have experienced higher than anticipated maintenance times and failure rates.  PepperBall launchers are defined as military equipment and Fairfield City Ordinance 202206 and City of Fairfield Muncipal Code Chapter 31 requires City Council approval for the acquisition of military equipment; therefore, the Department requests modification of the Police Department’s Lexipol Policy 711, Military Equipment, to allow for the manufacturer to exchange PPC launchers for Tactical SemiAutomatic (Tac SA) launchers at no cost to the city.

DISCUSSION
Pepper ball launchers and munitions are less lethal tools used to address violent or riotous crowds that are engaged in criminal activity when there is a risk of physical safety. They are also used to safely extract a suspect from a fixed location or safely detain a suspect who poses a risk of violence to officers and the community. These weapons are less lethal and afford peace officers an added option to avoid lethal force encounters. When these items are reasonable and necessary for use, there is no other alternative.

The department currently owns 12 PPC launchers. Staff responsible for maintaining and training others on the launchers have experienced a high level of failure in the devices, difficulty in training officers, and a higherthanexpected level of maintenance.  All police officers train quarterly on PepperBall launchers.

AGENDA REPORT
DATE:January 16, 2024
TO:Mayor and City Council
FROM:David Gassaway, City Manager
SUBJECT:Resolution 202411 of the City Council of the City of Fairfield Approving the Purchase of the Security Scorecard Tool from Reseller ePlus Technology Inc.

RECOMMENDED ACTION
Adopt resolution.

STATEMENT OF ISSUE
The City's Information Technology Department (IT) completed Cybersecurity assessments indicating the requirement for vendor cybersecurity risk assessment. The purchase of security scorecard tool from ePlus Technology Inc. will assist in the City’s assessment of the cybersecurity risk posture of vendors.

DISCUSSION
In 2022, the City's IT Department conducted multiple security assessments across City systems, data, and architecture resulting in a 5year roadmap for cyber security initiatives. The Cyber Resilience Plan (CRP) identified a list of technology initiatives, cybersecurity and data governance needs, training needs, and policies and procedures documentation to be implemented. The National Institute of Standards and Technology cybersecurity framework, (NIST) requires vendor risk assessments to evaluate vulnerabilities within software, hardware, and cloudbased applications used by the City for conducting business. The vendor risk assessment was identified as one of the high priority projects in the CRP and Security Scorecard will provide visibility into vulnerabilities within the City’s vendor supply chain. Additionally, the tool allows the IT Department to maintain a clear, continuous view into vendor security posture and vulnerabilities as new threats emerge. This visibility empowers the IT Department to ensure vendors address their vulnerabilities and grants vendors access to document the fixes and mitigations they have implemented. Subsequently, the City can generate reports for the Senior Leadership Team relating to vendor risk posture, quantifying risk levels across the technical portfolio.

The integration of vulnerability assessment and vendor management contributes to reducing overall risk across the City’s technology portfolio and meets the various cybersecurity and legal requirements associated with datasets.

FINANCIAL IMPACT
The proposed amount for this software is $235,531.76 over a fiveyear period includes initial software purchase, implementation services, five years of support and subscription costs with a $10,000 contingency in case additional licenses or additional data and reports are required to review new vendors during the five years. The proposed annual payments are as follows:

Year 1: $50,886.92
Year 2: $46,161.21
Year 3: $46,161.21
Year 4: $46,161.21
Year 5: $46,161.21
Contingency over five years: $10,000 to cover additional licenses Funds are budgeted in Fund 522 Cyber Resilience Plan Project CITCRP0001. Negotiating an annualized fiveyear payment decreases costs and ensures no 10% increase yearoveryear for the life of the term and is being purchased utilizing the National Association of State Procurement Officials (NASPO) negotiated contract #AR2472. It is anticipated that one additional renewal of a fiveyear discounted term will be needed, subject to budget appropriation.

PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION
N/A
ALTERNATIVE ACTION
The council may choose not to approve this purchase, but the City would not meet its cybersecurity risk management requirements to harden security posture as identified in the Cyber Resilience Plan. Not approving the purchase would make it more challenging for IT staff to view risk across the vendor supply chain.

In 2003, the City of Fairfield joined Public Risk Innovation, Solutions, and Management (PRISM) for procurement of insurance and risk management services. In order to ensure that individuals are authorized to fully act on behalf of their respective entity, PRISM requires the governing board of all member entities to officially designate a representative, either an individual or a position, which has authority to officially act on behalf of their entity.

DISCUSSION
Each member entity of PRISM has designated a primary contact person who receives all communication regarding matters related to PRISM such as notifications, requests for information, renewal premium quotes, invoices, etc. However, that individual may or may not be officially authorized by its governing board to act upon official matters such as executing Memorandums of Understanding and entering into service agreements. PRISM desires to ensure that the individuals executing such documents and agreements are authorized to do so. Therefore, they are requiring the governing board of each member to designate a representative. The official designated representative can be an individual or a position who has been delegated such authority. The representative for communications with PRISM will not change. All communications will still come through the primary contact person.

DISCUSSION
In October 2022, the project applicant requested to expand permitted uses for a vacant office building at 5253 Business Center Drive adjacent to Costco. The site is currently zoned CO, which allows a range of office and commercial uses. The applicant sought to allow industrial uses typical for the IBP zone. Following a public hearing, the council continued the project to September 12, 2023, to be able to consider the request in light of the ongoing General Plan Update. At the September 12th meeting, the council indicated support for expanding the set of permitted uses for the site to include a range of IBP activities and some manufacturing but not warehouses. They also expressed opposition to trucks at this location. The City Council then directed staff to return with a proposed Ordinance Amendment.

To implement this direction, staff proposes to amend an existing overlay zone for North Cordelia to permit selected IBP uses for CO zoned properties south of Business Center Drive, west of Green Valley Road, including 5253 Business Center Drive and 5251 Business Center Drive. The draft Ordinance Amendment is attached (Attachment 1).

A substantial overlap exists between uses allowed in the CO and IBP zones. The proposed overlay would expand the allowed uses in the specified COzoned properties. The expansion would permit most of the uses allowed in the IBP zone, including ‘Research and Development,’ with the notable exception of ‘Warehouses’ and ‘Medium Manufacturing,’ a type of industrial activity that can have various impacts on adjacent properties. For the complete list of additional uses allowed, see Table 25 NC (Attachment 1).

In addition to an expanded set of allowed uses, staff proposes establishing design and operating standards into the existing overlay zone. The proposed standards would prohibit truck docks, limit roll up doors facing City streets, and prohibit trailered trucks traveling during peak hours. The purpose of these proposed standards, is to align the code with the council’s direction to allow manufacturing in an area with nearby residences, prohibit warehouses and, as much as feasible, truck traffic. The proposed overlay amendment is intended to tread this narrow path. The City's Economic Development Division agrees with and supports these recommendations.

The applicant generally supports the proposed amendment but requests several changes. He seeks to add medium manufacturing, with no design and regulations. Notably, the applicant indicates that he would like to install as many as six truck docks in his building. Staff finds the applicant’s request to permit medium manufacturing and truck docks does not align with the council's direction to limit truck traffic. Staff is also concerned about ensuring compatibility of manufacturing uses near to housing, and the potential right of a landowner to tear down the existing buildings and design a more purely industrial building that is inconsistent with the design character along this stretch of Business Center Drive. If design and operational regulations are not established, any applicant would be able to demolish the existing building, build to existing development regulations, install as many truck docks as desired, and operate trucks at any time.

PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION
A public hearing notice was published in the Daily Republic newspaper on January 5, 2024.

The Planning Commission reviewed the proposed amendments at their meeting on December 13, 2023. At the meeting, the Commission supported the proposed list of additional uses, restrictions on hours for truck operations, and most design standards. On a 52 vote, the Commission approved Resolution No. PC202314, recommending these items, with one change to the staff recommendation.

The change would increase to four truck docks.

ALTERNATIVE ACTION
The council has a variety of alternatives to the staff recommendation. The council may 1) deny the Ordinance Amendment, 2) approve the project with the Planning Commission’s recommendation of allowing up to four truck docks, 3) approve the project as requested by the applicant, with no limits on truck docks, no design standards, and allowing “Manufacturing and Assembly, Medium” as a conditionally permitted use. The council may also direct staff to amend the proposed Ordinance in any other way to implement their vision for expanding uses inoffice use in this location.

B. On December 13, 2023, the Planning Commission was presented with the revisions to the Zoning Ordinance as contained herein and, after holding a duly noticed public hearing, voted to recommend that the City Council approve the proposed insertion.

C. The City has held a duly noticed public hearing on the proposed revisions to the Zoning Ordinance in accordance with the rules and regulations regarding such.

SECTION 2. Chapter 25, Article I, Section 25.28 Overlay Zoning Districts is hereby amended as follows:

25.28.5 North Cordelia (NC) Overlay District
A. Purpose and intent. The initial purpose and intent of the North Cordelia Overlay District (NC) is to implement the Green Valley Settlement Agreement (GVSA). In 2024, the NC Overlay District was revised to expand the set of allowable uses and establish certain design standards for Office Commercial (CO) zoned properties south of Business Center Drive.

B. Applicability and expiration. The NC Overlay District is applied to all properties within the City located north of Interstate 80 and west of Suisun Valley Road in Cordelia, as identified on the Zoning Map.

C. North Cordelia Design Standards. All development within the NC Overlay District shall comply with the North Cordelia Design Standards contained in Resolution 89-384, adopted by the city council on November 21, 1989, as may be amended. The approval Packet Page 201 of 204Attachment 1 Page 1 of 4

authority shall find that the proposed development is in compliance with the design standards prior to granting any development approval within the NC Overlay District.

For CO zoned parcels south of Business Center Drive, any new building containing an expanded use as listed in Section F below shall incorporate materials and design equal to or better than those approved for buildings in the Green Valley Technical Plaza and Green Valley Office Park. New and existing buildings may include roll-up doors, however, loading bays or docks facilitating more direct loading from the building into trucks are prohibited.

No more than one roll-up door may be permitted on a street facing elevation. Trim, materials, and paint for all roll-up doors shall be coordinated to blend with the building design to minimize the doors’ visual impact.

D. Traffic standards. Within the NC Overlay District, the City shall not approve any disposition and development agreement or other discretionary permit for commercial development that is greater than 10,000 square feet or that generates more than 150 daily trips if calculated Levels of Service (LOS) at the time of approval at any major intersection, as defined in Section 6.1 of the GVSA, is either operating at a level of service lower than LOS D, as a result of the proposed approval in combination with existing traffic levels and projected traffic from the projects described in Section 1.29 of the GVSA and all other approved residential and commercial agreements in North Cordelia.

E. Public art. Development within the boundary of the NC Overlay District shall include public art in the project or pay an in-lieu fee. As required by the Price Club Settlement Agreement (City Council Resolution 91-277), a public art fee equal to 0.0025 percent of the building permit valuation for a project shall be paid concurrent ly with issuance of a building permit. In lieu of payment of this fee, the developer may purchase public art or construct public art for inclusion in the project. Public art shall include, but shall not be limited to water features, sculptures, and tapestries. Design features incorporated into proposed building architecture, such as cornices, pilasters, or special paving materials , are not considered public art. The City shall approve all public art projects.

F. Expanded Land Uses. Within the NC Overlay District, parcels located south of Business Center Drive with an Office Commercial (CO) zoning designation may operate the following additional land uses by right or conditionally, as specified in Table 25-NC.

SECTION 3. The council hereby makes the following finding pursuant to the California Environmental Quality Act (CEQA): based on the information contained in the staff report and presented by staff, the council has determined that this ordinance amendment is exempt from CEQA review per Government Code Section 15305. Minor Alterations in Land Use Limitations. The text amendments would allow for an expanded list of permitted land uses. The additional uses proposed have lower Institute of Transportation Engineers (ITE) trip generation assessments. Additionally, incorporating a wider variety of employment opportunities and industrial business services will lead to lower vehicle miles traveled (VMT) for employees and consumers in the area. Lower traffic impacts result in lower air quality, greenhouse gas emissions, and energy impacts. The new land uses introduced by the proposed Overlay would result in lesser environmental impacts than any of the existing permitted uses under the current zoning designation.

SECTION 4. This Ordinance shall be effective 30 days following its adoption by the City Council. A summary of this Ordinance shall, within fifteen (15) days after passage, be published in accordance with Section 36933 of the Government Code of the State of California with the names of the City Councilmembers voting for and against it.
