RECOMMENDED ACTION
Adopt resolution.

STATEMENT OF ISSUE
Per Chapter 25, Division 6, Section 25.165 of the City of Fairfield Municipal Code, prior to City Council’s approval of a final map, the developer shall enter into an agreement with the City to construct the proposed improvements. The recommended action approves the final map, authorizes the city engineer to accept the subdivision design drawings for construction, and authorizes execution of the subdivision improvement agreement (Agreement) for the Canon Stati on Planning Area 5 – Neighborhood J & K -2 subdivision (Subdivision).

DISCUSSION
One Lake Holding, LLC (Developer) is proposing to construct the Subdivision within Planning Area 5 of the Train Station Specific Plan (TSSP). Planning Area 5’s Master Planned Unit Development (MPUD) entitlements were previously approved with adoption of Planning Commission Resolution No. 2021-22, and as subsequently amended by an administrative hearing held on April 15, 2024, for project number PDA2024-001.

The council’s app roval of the final map for this Subdivision will allow the Developer to construct 84 single-family, residential lots in Planning Area 5. Separately, this final map also creates 29 privately - owned and maintained pedestrian realm parcels, which shall be gran ted to a future homeowner’s association.

Secondly, a portion of the Subdivision drains toward a water quality/detention basin that will be granted to the City upon future acceptance of the improvements by the council. This basin is located next to the future dog park, near Trailblaze Court. Approval of this Agreement will obligate the Developer to construct a temporary maintenance vehicle access road from the Subdivision to the detention basin, thus allowing City staff to access and maintain this detention basin.

Additionally, the Developer is required to construct a Zone II Pump Station facility to support water demands to this development, pursuant to conditions as adopted by the MPUD and per TSSP policies.

Execution of this Agreement obligates the D eveloper to pay the City to conduct a water modeling analysis to determine the number of residential units that may be constructed before necessitating this pump station.

Lastly, per Section 5.8.1.6 of the development agreement (DA) executed between the City and Developer, the City may assign Transportation Improvements, as defined by the DA, up to a total value equal to 2,125 equivalent dwelling units (EDUs). Construction of Vanden Road remains the City’s top priority. Since 2020, the City has been executing subdivision improvement agreements and accruing the authority to assign construction of Vanden Road – Segments 17a, 17b, and 18 to the Developer. The City submitted a letter dated August 8,2024, to the Developer identifying the City’s authority to ass ign $22,239,571 (2023 dollars) towards construction of Vanden Road.

Execution of this agreement recognizes an additional $3,987,262.91 (2023 dollars) at 150% or $2,861,157.26 at 100% of AB1600 traffic impact, Northeast traffic impact, and Northeast linea r park impact fees, allowing the City to assign the Developer a total of $26,226,833.91 at 150% or $25,100,728.26 at 100% of public improvements.

As part of the development obligations, the Developer will be providing dust control by frequently applying water to the site throughout construction, which is a typical mitigation measure. The proposed improvements will have no traffic impacts, as the improvements contemplated are outside of any active public roadways. Additionally, the Developer will minimize disturbances to nearby residents by working within the allowed construction hours, between 7:00 a.m. and 5:00 p.m., and providing public outreach to notify residents of any anticipated construction impacts.

Approval of the final map and execution of the Agreement will obligate the Developer to construct all public and private improvements, including streets, underground utilities, streetlights, and pedestrian sidewalk, to serve future residents of the proposed subdivision.

The Developer has provided al l the necessary bonds and insurance and has paid the fees required to enter into this Agreement.

FINANCIAL IMPACT
There is no cost to the City in constructing the public improvements contemplated under the Agreement.

Acceptance of the public improvement s by council will obligate the City to maintain the public improvements, which includes Briones Drive, Calero Drive, Freeform Drive, Gibraltar Drive, Open Green Drive, and Tempo Drive and all public water, sewer, and storm utilities located within these streets. The future homeowner’s association shall maintain improvements within the pedestrian realm, including landscape, irrigation, streetlights, and sidewalks. Maintenance costs shall be funded by the newly formed TSSP Community Facilities District (CFD) No. 2023-1 and CFD No. 2023-2.

PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION

ALTERNATIVE ACTION
Sections 66458 and 66462 of the Subdivision Map Act require that the council approve the Agreement if the conditions of the tentative map have been met. The Developer has met the necessary conditions and has provided the proper documents for the Agreement. However, if the council has any questions regarding the layout of the subdivision or public improvement construction, approval can be postponed until the questions are addressed.
