RECOMMENDED ACTION
Adopt resolution.

STATEMENT OF ISSUE
Per Chapter 25, Division 6, Section 25.165 of the City of Fairfield Municipal Code, prior to City Council’s approval of a final map, the developer shall enter into an agreement with the City to construct the proposed improvements. The recommended action approves the final map, authorizes the city engineer to accept the subdivision design drawings for construction, and authorizes execution of the subdivision improvement agreement (Agreement) for The Enclave at Red Top – Unit 3 Subdivision (Subdivision).

DISCUSSION
Albert D. Seeno Construction Company, LLP (Developer) previously received entitlement approval to construct the Subdivision per the adoption of Planning Commission Resolution No. 2014-11.

The council’s approval of the final map for this Subdivision will authorize the Developer to construct the remaining 15 single -family residential lots of the overall Enclave at Red Top Development, which is located on the south side of Red Top Road near Interstate 80.

The Vallejo Water Department (VWD) owns and maintains two major water transmission mains, sized 30 inches and 42 inches, that bisect the Subdivision. These transmission mains are located within utility easements previously granted to the City of Vallejo by the Developer. The Developer coordinated the Subdivision design with VWD staff to satisfy their design requirements and ensure that homes and permanent structures are located outside the easement limits. These transmission mains are located within a portion of the front and backyards of three future residential lots. The Developer is providing disclosures to future homebuyers within this Subdivision informing them of the existence of these transmission mains and notifying them of restrictions on improvements and permanent structures, such as accessory dwelling units or sheds.

The Subdivision is located next to a water channel that is located on private property. Currently, this water channel is privately owned and maintained and will not be granted to the City.

The Developer will provide dust control by applying water frequently to the site throughout construction, which is a typical mitigation measure. The proposed improvements should have minimal traffic impacts to Red Top Road, as the improvements are outside of active public roadways. Additionally, the Developer will minimize disturbances to nearby residents by working within the allowed construction hours between 7:00 a.m. and 5:00 p.m.

Approval of the final map and execution of the Agreement will obligate the Developer to construct all public improvements, which includes land scape along Red Top Road, streets, underground utilities, streetlights, and pedestrian sidewalks.

The Developer has provided all the necessary bonds and insurance and has paid the fees required to enter into this Agreement and desires to begin construction as soon as possible.

FINANCIAL IMPACT
There is no cost to the City in constructing the public improvements contemplated under the Agreement. Acceptance of the public improvements by the council will obligate the City to maintain the public improvement s, including Trillium Court, public water, sewer, and storm utilities within the public right -of-way. The Subdivision is annexed into the City’s Community Facilities District 2012 -2 (CFD 2012 -2) and Lighting and Landscape Maintenance District No. 16 (LLMD No. 16), which will provide funding to maintain the public landscape and irrigation proposed along Red Top Road.

ALTERNATIVE ACTION
Sections 66458 and 66462 of the Subdivision Map Act require that the counc il approve the Agreement if conditions of the tentative map have been met.
