RESOLUTION NO. 2025-19
AUTHORIZING EXECUTION OF A MASTER LICENSE AGREEMENT FOR SMALL CELL WIRELESS
FACILITIES IN THE PUBLIC RIGHTS-OF-WAY BETWEEN THE CITY OF FAIRFIELD AND NEW CINGULAR WIRELESS PCS, LLC.
WHEREAS, New Cingular Wireless PCS, LLC. requested entry into the City of Fairfield’s Master License Agreement for purposes of installing and maintaining their wireless communications facilities, consisting of small cellular wireless antennas and associated equipment, throughout the City on City-owned streetlights within the public rights-of-way; and
WHEREAS, the agreement provides a general framework for the installation and maintenance of small cell antennas and associated equipment on City streetlights within the City’s right-of-way; and
WHEREAS, detailed approvals of the installation will occur through the issuance of one or more site licenses and/or encroachment permits by the City; and
WHEREAS, the Federal Communications Commission (FCC) has already deemed the installation of small wireless facilities in the ROW to be approved, and as the Agreement does not permit any activity beyond those already permitted by the FCC and City regulations, there is no potential for these regulations to cause a significant effect on the environment.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FAIRFIELD HEREBY RESOLVES:
Section 1. The council authorizes the city manager to execute the Master License Agreement for small-cell wireless facilities with New Cingular Wireless PCS, LLC.
Section 2. The city manager or designee is hereby authorized to take actions necessary and appropriate to carry out the purpose and intent of this Resolution.
Section 3. The proposed approval of the Master License Agreement for small cell wireless facilities is not a project within the meaning of CEQA Guidelines Section 15378 because it has no potential to result in physical change in the environment, directly or indirectly. The agreement is exempt from the California Environmental Quality Act (CEQA) per Sections 15301 (Existing Facilities) as minor additions to existing facilities and/or 15303 (New Construction or Conversion of Small Structures) for new, small facilities or structures.
