STATEMENT OF ISSUE
The City owns the property located off Poppy Hills Court, more commonly known as Assessor’s Parcel Number (APN) 0167 -100-160 (Property). Pacific Gas & Electric (PG&E) is requesting an easement over the Property to supply power to the previously approved DISH Wireless cellular site.
DISCUSSION
On December 20, 2022, the City Council approved a Communications Facility Ground Lease Agreement between the City and Dish Wireless (DISH) to build and maintain a cellular site on the Property. In preparation for the new cellular site, DISH reached out to PG&E to supply power to their site at which time PG&E notified DISH that an easement would be required to ensure power is provided from the street to the hilltop where the cellular site will be built.
PG&E drafted, and DISH presented to the City, the proposed Easement Deed for a 3,860 square foot easement (Easement) that will run from t he street at Poppy Hills Court up to the future cellular site location. City Staff and the City Attorney’s Office have reviewed and approved the proposed Easement Deed.
At the City Staff’s request, DISH obtained an appraisal report of the Easement, which determined its value at $500. DISH has agreed to pay the City $500 to secure the Easement for PG&E.
Both the City and PG&E would like to execute the Easement Deed for the sale of the Easement.
FINANCIAL IMPACT
The City will receive a payment of $500 for the appraised value of the easement. The payment will be deposited into the General Fund (Account code 101-6505).
