RECOMMENDED ACTION
Adopt resolution.
STATEMENT OF ISSUE
As part of the Development Agreement (DA) between Rancho Tolenas Corporation (RTC) and the City of Fairfield, RTC was required to grant to the City certain Irrevocable Offers of Dedication for conservation easements and wetlands identified as Parcels C through F of RTC’s Final Large Lot Map for Villages at Fairfield - Village II, which was recorded on June 13, 2019. RTC completed the monitoring and maintenance for Parcels C, D, and F of these conservation easements, per section
8.a of the DA and section 3.1 of the Monitoring Plan for the Keswick Village Open Space Preserve, for the required term thereof three consecutive years or after five years of monitoring, whichever is longer. The recommended action will accept the offers of dedication for Parcels C, D, and F and transfer maintenance of the easements to the City.
DISCUSSION
Per Sections §66475 and §66477.2, of the Subdivision Map Act and Section 25.166.20 of Fairfield’s City Code, the City must wholly accept, conditionally accept subject to improvement, or reject Irrevocable Offers of Dedication (IOD) granted to the City, by the property owner, upon approval of a final map at the time of the map’s approval an IOD. If an IOD is rejected at the time
the map is approved, the offer remains open and can be accepted at a later date pursuant to §66477.2, unless and until the City affirmatively terminates and abandons the offer.
The Large Lot Final map, entitled “Villages at Fairfield Village II,” was filed with the Solano County Recorder on June 13, 2019. At the time of map approval, the owner made an IOD in fee for Parcels C, D, E, and F for conservation, wetland, and storm drain purposes. The City rejected the offer at the time the map was approved because the maintenance period, per the DA, was not complete.
The maintenance period for Parcels C, D, and F are now complete and the City can accept part of the IOD. The City will only be accepting the IOD for Parcels C, D, and F while the IOD for Parcel E remains rejected.
Staff recommends acceptance of the IOD for Parcels C, D, and F.
FINANCIAL IMPACT
Per Resolution No. 2019-255, Maintenance of Open space areas within the Village II development was included in the annexation of territory to the City of Fair field Landscaping and Lighting Maintenance District (LLMD) No. 14 (Woodlake). Parcels C , D, and F are considered Open space areas, and thus, their maintenance costs will be covered under the Woodlake LLMD.
