RESOLUTION NO. 2025-42
APPROVING THE EXECUTION OF THE AGREEMENT FOR THE ACQUISITION OF PERMANENT
EASEMENT BETWEEN THE CITY OF FAIRFIELD AND TAL GREEN VALLEY, LP RELATED TO FIRE STATION 36 ON BUSINESS CENTER DRIVE
WHEREAS, the City of Fairfield (City) plans to construct a new Fire Station 36 (Project) located on Business Center Drive; and
WHEREAS, a portion of the proposed improvements are located with property located at 4555 Business Center Drive (APN: 148-540-410) owned by TAL Green Valley, LP; and
WHEREAS, a permanent easement must be acquired in order to construct the Project; and
WHEREAS, the City would like to enter into a certain Agreement for Acquisition of Permanent Easement (Agreement) with TAL Green Valley, LP, and authorize the city manager to execute the Agreement and any associated instruments, including the acceptance of conveyance.
THE COUNCIL OF THE CITY OF FAIRFIELD HEREBY RESOLVES AND ORDERS:
Section 1. The Agreement between the City of Fairfield and TAL Green Valley, LP , attached as Exhibit A, is hereby approved.
Section 2. The city manager is hereby authorized to sign the Agreement on behalf of the City of Fairfield to execute such additional instruments and undertake such measures as may be necessary to implement the Agreement, including one or more certificates of acceptance and Escrow Instructions as may be required.
Section 3. The city manager is hereby authorized to take all necessary steps to implement the above-mentioned appropriation authorization.
