STATEMENT OF ISSUE
Staff are recommending that the City enter into the Third Amendment to the Land Lease Agreement (Third Amendment) with T-Mobile West LLC (T-Mobile) for the purpose of modifying certain terms and extending the term of T-Mobile’s existing cellular site land lease located off Hilborn Road.
DISCUSSION
The City and T-Mobile entered into the Land Lease Agreement dated September 5, 2006, a First Amendment to Land Lease Agreement dated April 18, 2013, and a Second Amendment t o Land Lease Agreement dated October 31, 2016 (collectively “the Lease”) for a cellular site at the Waterman Water Tower located off of Hilborn Road (Property).
The Lease is set to expire on August 3, 2026, and T-Mobile has requested to extend the lease for an additional five years with three five year options to extend for a total of 20 years through August 3, 2046. The rent will increase each year by 3% effective August 4, 2026.
In addition to the lease term, T -Mobile also asked that certain sections of the Lease be updated to match current F ederal Communications Commission regulations and update the address contact information for future notices.
Both the City and T -Mobile would like to enter into the proposed T hird Amendment to modify the terms of the Lease.
