RECOMMENDED ACTION
Adopt Resolution.
STATEMENT OF ISSUE
Construction is underway for the Linear Park Node 4A – 2030 North Texas Recreation Center Project (Project). As part of the Project’s implementation, special inspections and construction material testing services are required to ensure compliance with regulatory standards and overall quality. The City staff does not possess the necessary certif ications, equipment, or expertise to conduct special inspections and testing for the Project. To ensure timely Project completion, staff recommend executing a professional service agreement with Kleinfelder , Inc. (Kleinfelder) to provide the required services and authorize an update to the fiscal year (FY) 2024-2025 budget.
DISCUSSION
On December 17, 2024, the City Council awarded a construction contract to CWS Construction Group, Inc. for the Project. The Project includes the development of 4.4 acres of undeveloped land at the old bowling alley site. The Project is immediately adjacent to a segment of the Linear Park Trail and, in the future , will directly connect to the trail system . The Project includes the construction of a 6,700 square foot recreation center for First 5 Solano Children and Families, multi-use fields, perimeter trail, and other amenities. Construction started on March 17, 2025.
Pursuant to California Building Code Sections 1701, 1704, and 1705, the Project requires special inspection and testing. Specifically, special inspection and testing are required for observing the soil compaction of the building foundation, hop and field welding, and bolted connections of structural steel, and various structural concrete placement and grouting.
In July 2023, staff released a Request for Qualifications (RFQ) for construction management and inspection services, inviting qualified firms to submit Statement of Qualifications (SOQs) to meet the City’s need in construction management and inspections of various public buildings and park projects. An evaluation committee reviewed and ranked the SOQs and determined that Kleinfelder was the most qualified to provide special inspection services for the Project.
Kleinfelder has worked in Fairfield since 2000 and has provided testing, inspections, laboratory services, and geotechnical engineering on several capital projects. Recently , they have assisted with the construction of the Fairfield-Vacaville Train Station and Allan Witt Dog Park.
Kleinfelder’s proposed work includes special inspection and material testing. Kleinfelder proposes completing the required services for a not -to-exceed amount of $150,329. Due to the magnitude of this construction Project, there may be deviations or field decisions that will require additional effort from Kleinfelder. Staff are requesting a management reserve of 10% to be responsive to the needs of the project and prevent construction delays that may be outside the control of the city (e.g., changing site conditions, weather, etc.).
FINANCIAL IMPACT
The professional services agreement with Kleinfelder will authorize a contract for an amount not- to-exceed $150,329 plus 10% management reserve ($152,329 + $15 ,033 management reserve).
Total authorization for this agreement would be $ 165,362. Special inspections and construction material testing were not budgeted in the adopted FY 2024-2025 budget and will require a total budget adjustment of $165,362 from AB 1600 Park (Fund 26 1) to the Park Capital Projects Fund (Fund 251, CPW050035) . The Finance Department has confirmed that adequate reserves exist and that no projects will be jeopardized by this additional expenditure.
PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION

ALTERNATIVE ACTION
The council may decide not to carry out a contract with Kleinfelder and request staff to procure proposals from other consultants. This is not recommended due to Kleinfelder’s understanding of the project requirements and technical field expertise and certification that the City currently does not have in-house.
The council may decide not to complete special inspections and construction material testing altogether. Special inspections and construction material testing are mandated by the California Building Code and the Project will be non-compliant. While foregoing special inspections might reduce upfront costs, there might be long -term liability that could outweigh any immediate financial savings.
