RECOMMENDED ACTION
Adopt resolution.
STATEMENT OF ISSUE
Staff recommend that the City enter into the First Amendment to the Land Lease Agreement (First Amendment) with T -Mobile West LLC (T -Mobile) to modify certain terms and extend the term of T-Mobile’s existing cellular site land lease located at Peabody Road and Cement Hill Road.
DISCUSSION
The City and T-Mobile entered into a Land Lease Agreement dated September 4, 2007 (the Lease) for a cellular site at the corner of Peabody Road and Cement Hill Road (the Property).
The Lease is set to expire on September 3, 2027, and T-Mobile has requested to extend the lease for an additional five years with four additional five-year options to extend for a total of 25 years through September 3, 2052 . The rent will increase each year by 3 .5%, effective September 4, 2032.
Both the City and T-Mobile would like to enter into the proposed First Amendment to modify the terms of the Lease.
