RESOLUTION NO. 2025-72
APPROVING AND AUTHORIZING THE EXECUTION OF THE FIRST AMENDMENT TO THE LAND
LEASE AGREEMENT BETWEEN THE CITY OF FAIRFIELD AND T-MOBILE WEST LLC FOR THE
CELLULAR SITE LOCATED AT PEABODY ROAD AND CEMENT HILL ROAD (ASSESSOR PARCEL NUMBER 0166-102-100, PREVIOUSLY 0167-301-040)
WHEREAS, the City of Fairfield and T-Mobile West LLC (T -Mobile) entered into the Land Lease Agreement dated September 4, 2007 (the Lease) for a cellular site at the corner of Peabody Road and Cement Hill Road (Property); and
WHEREAS, T-Mobile has requested to extend the lease for an additional five years with four five year options to extend for a total of 25 years through September 3, 2052; and
WHEREAS, the City and T-Mobile wish to enter into the proposed First Amendment to the Land Lease Agreement to modify the terms of the Lease.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FAIRFIELD HEREBY RESOLVES:
Section 1. The City Council hereby approves the First Amendment to Land Lease Agreement by and between the City of Fairfield and T -Mobile West, LLC, substantially in the form and content presented and attached hereto as Exhibit A.
Section 2. The council authorizes the city manager to do all things necessary to implement and execute the First Amendment to the Land Lease Agreement attached as Exhibit A.
