STATEMENT OF ISSUE
Adopt the current fee schedule for parking fines and add an additional violation of 22500(n) of the California Vehicle Code (CVC) with a $58 fine. This updates the parking fee schedule previously updated by the City Council in 2010.
DISCUSSION
In 1993, Assembly Bill (AB) 408 (California Vehicle Code 40200) decriminalized parking citation s and removed the parking citation processing from the courts effective July 1, 1993, thereby making standing or parking citations a civil offense. AB 408 changed the parking violation adjudication process and shifted the responsibility of establishing a schedule of parking penalties for parking violations to the governing bodies within a county, which includes the City Council. A parking fee was created in a resolution and was passed by the council on July 20, 1993, Resolution No. 93-125 (Attachment 3).
On December 7, 2010, Resolution No. 2010-333 (Attachment 4) was passed by the council, which added a $3 increase to all parking offenses listed on the parking fee schedule. This $3 surcharge was established due to the passing of Senate Bill (SB) 857 on December 7, 2010, which increased the amount the City pays to the State of California for every parking citation issued.
Between 2010 and 2023, the parking fines were increased to their current rate of $58.
On October 10, 2023, the State of California pa ssed AB 413, also known as the California Daylighting Bill. AB 413 added a new subdivision to Vehicle Code section 22500. Section 22500(n) prohibits the stopping, standing, or parking of a vehicle within 20 feet of any unmarked or marked crosswalk or 15 feet of any crosswalk where a curb extension is present. This section was added to the CVC to help increase pedestrian safety and hopefully reduce the number of vehicle versus pedestrian crashes. Effective January 1, 2025, vehicles that are in violation of this section can be issued a parking citation.
Since 22500(n) CVC is a new section, the Fairfield Police Department has not yet set a fee amount.
Similar sections, such as 22500(a) CVC -parked within an intersection, 22500(b)CVC-parked over a crosswalk, 22500(e) CVC -Parked blocking a driveway, 22500(f) CVC-parked blocking sidewalk, 22500(h) CVC -double parked, 22500(I) CVC-parked in a bus zone, currently all impose a $58 fee.
The Police Department proposes to impose the same $58 fee on people who are in vi olation of the new section 22500(n) CVC. For any other parking violation listed in the Fairfield Municipal Code or California Vehicle Code and not listed in the proposed schedule, the fine shall be $58 unless otherwise indicated in the body of the statute.
The City’s fee must be comparable to fees issued by other cities in Solano County. The current $58 fee is comparable to surrounding agencies and therefore staff does not recommend increasing the fee amount.
FINANCIAL IMPACT
Additional revenue is generated from the fees collected from parking citations, which are entered into the Police Department General Fund account.
