RECOMMENDED ACTION
Hold Public Hearing and adopt resolution.
STATEMENT OF ISSUE
Adoption of a Resolution declaring that certain real properties owned by the Successor Agency to the Fairfield Redevelopment Agency (Successor Agency or Agency) are surplus land, as applicable, is required pursuant to Government Code Sec tion 54221(b)(1) before the Successor Agency may take action to dispose of the properties consistent with the Agency’s policies or procedures.
DISCUSSION
Under Health & Safety Code Section 34177, the Fairfield Successor Agency to the Redevelopment Agency is required to dispose of assets and properties of the former redevelopment agency as directed by the oversight board expeditiously and in a manner aimed at maximizing value.
The Successor Agency is the owner in fee simple of certain real property (Prope rty) located on Mangels Boulevard, and more specifically identified and described as Property 1 in Attachment 3 (Real Property Surplus Land List) and Attachment 4 (Property Profiles for Surplus Land). Under the Surplus Land Act, Government Code Section 542 20 et seq. (Act), land that is not necessary for the City’s use shall be declared either surplus land or exempt surplus land. The disposition of surplus land and exempt surplus land is governed by the Act.
The Property identified in Attachment 3 & 4 is not currently being used by the Successor Agency and Staff has evaluated the properties for their potential to be used for City work or operations, including Agency facilities. Staff have determined that the Property described in Attachment 3 & 4 is not ne cessary or suitable for the Successor Agency’s use. The Act provides that land not necessary for the Agency’s use shall be declared either surplus land or exempt surplus land.
Sections 54221(b) of the Act defines surplus land as land that meets the condi tions described in such section.
Staff recommends that the Board of Directors declare that the Property identified in Attachment 3 & 4 is surplus land and not necessary or suitable for the Successor Agency’s use (Surplus Land).
The basis for this recommendation is as follows:
Under Government code sections 54221(b), Surplus Land is that which is owned in fee simple by any local agency for which the local agency’s governing body takes formal action in a regular public meeting to declare the land is surp lus and not necessary for the government’s use. The land described in Attachments 3 and 4 is not necessary for the Successor Agency’s use, primarily because of the inability to develop on it due to its location and size. Specifically, the property does not have any potential for use because of issues regarding its accessibility, and its proximity to the freeway. These barriers prevent the Successor Agency from putting the land to productive use.
