On April 7, 2025, an application for a zone change from Regional Commercial (CR) to Mixed Commercial (CM) for the property located at 3331 N Texas Street (APN: 0167-130-240) (Project) was properly filed with the Community Development Department in accordance with the rules and regulations governing the official filing of such applications.
SECTION 2. The Planning Commission held a duly noticed public hearing on June 25, 2025, to consider the applications for a Zone Change (ZC2025-004) and Environmental Review (ER2025- 010). The City staff presented substantial factual information regarding the proposed Project in staff reports and through oral presentations before the commission, and the commission considered all public testimony and information presented during the public hearing regarding this application.
SECTION 3. Based on the information presented by staff, the commission has determined that the proposed amendments to the text of the Zoning Ordinance are exempt from CEQA review under Section 15061(b)(3): Common Sense Exemption. adequate housing; Objective LU-2.1: Require residential development to be consistent with the density ranges included in the General Plan; Objective LU-2.2: Promote the development of a greater variety of housing types and sizes in existing neighborhoods. (b) The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the city. The proposed amendment will facilitate the development of permanent supportive housing, providing housing for unhoused individuals and veterans.
(c) The site is physically suitable (including, but not limited to access, provision of utilities, compatibility with adjoining land uses, and absence of physical constraints) for the requested zoning designations and anticipated land uses/developments. The site has access to city utilities and is physically suitable for any development under the CM zoning regulations. Such as, the proposed hotel conversion project to provide permanent supportive housing. Additionally, land uses under the CM zoning regulations are all compatible with the surrounding existing commercial uses. (d) The proposed amendment is in compliance with the provisions of CEQA. The proposed zone change is exempt under CEQA Section 15061{b}{3}: Common Sense Exemption. The legislative activity does not involve any physical changes to the site and will not cause a significant effect on the environment, and therefore, it is not subject to further CEQA review.
