Approving Expenditure for Lease Agreement of Multifunction Copiers, Plotters, and Print Services with Canon Financial Services

RECOMMENDED ACTION

STATEMENT OF ISSUE
City Council approved a lease agreement with Canon Financial Services (C anon) on March 1, 2022, via Resolution 2022-35 to lease multifunction copy machines citywide and provide ongoing maintenance and service. Since the agreement’s inception, t he City has added equipment and related services under the existing lease terms. As a result, staff now seek to increase the spending authority granted in the original resolution.

DISCUSSION
The City’s existing lease agreement with Canon is for 60 months with defined monthly lease costs plus printing costs. Monthly printing amounts fluctuate based on usage volume, print type (e.g. color versus black/white) and the number of machines covered. When the original lease was created, staff estimated the financial costs over the life of the lease and requested and received council spending authority for $500,000 to cover 41 machines.

Since that time , the City’s usage and staffing has grown, requiring the addition of four multifunction copiers to replace 16 aging desktop printers, and incorporated two Canon large format p lotters that were formerly maintained by other vendor s. This consolidation has improved operational efficiency and reduced the City’s reliance on third -party vendors for

Page 5 of 190 ends

maintenance and printing services. However, these additions have increased the monthly charges under the Canon lease.

A recent budget review identified that current expenditures are approaching the original council- approved spending limit. To ensure continued service throughout the remainder of the lease term, staff recommend increasing the spending authority by $230,000 to accommodate projected costs through March 2027.

FINANCIAL IMPACT
The Canon agreement is based upon cooperatively negotiated pricing from the Omnia University of California contract #20200002755 and provides the City with the best pricing and services for the machines in use until March 6, 2027. The initial agreement with Canon was for $500,000 and with the proposed $230,000 expenditure, the total amount is not to exceed $730,000. The current agreement is beneficial to the City and does not require any changes for the remaining months of the term. The planned costs are included in the current two-year budget cycle. Council approval of this resolution will enable the City to maintain the current level of equipment and services without disruption. Sufficient funds are available in Computer Fund 522.

PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION
N/A

ALTERNATIVE ACTION
Council may choose not to approve the proposed expenditure . Without council approval to increase spending authority, current use of the Canon copy and plotter machines will not be feasible. Staff would either have to drastically decrease the use of leased machines or significantly increase the use of more costly copiers. Based on the current pricing model, reducing the number of machines will not likely reduce the City’s cost or monthly printing volume; instead, it will increase wear, stress, and availability issues for the remainin g copiers without lowering costs.

Agenda Item No: J.2

AGENDA REPORT
DATE: August 5, 2025

TO: Mayor and Council

FROM: David Gassaway, City Manager

SUBJECT: Resolution 2025-159 PW Routeware Agreement

Authorizing the City Manager to Approve a Second Amendment to the Technology Software-As- A-Service Agreement Between the City of Fairfield and Routeware, Inc.

Funding Source: $194,775; Solid Waste Fund

Contact: Corey Beavers, (707) 428-7528

RECOMMENDED ACTION
Adopt resolution.

STATEMENT OF ISSUE
Approve the attached resolution authorizing a five-year amendment of the existing Technology Software-as-a-Service (SaaS) Agreement between the City of Fairfield and Routeware , Inc (Routeware).

DISCUSSION
In September 2016, Governor Brown signed into law Senate Bill 1383 (SB 1383) which aims to reduce organic waste disposal by 75% and increase edible food recovery by 20% and went into effect January 1, 2022. To ensure legislative compliance with SB 1383 regulations, Public Works Solid Waste staff recommend renewing a five-year agreement with Routeware for the continued use of their Program Tracker software (Program Tracker). Routeware is a cloud-based platform that is designed for municipal solid waste programs and is utilized by many districts. The Program Tracker is a specialized SaaS product that allows staff to organize, track, log, export, and coordinate outreach activities conducted at local businesses and residences. Th e data collected through the Program Tracker is then used by staff for State reporting.

The Program Tracker utilizes account service data from waste haulers such as Republic Services and organizes this information into a concise, useful database. Data is accessible in real -time to both the City and Republic Services, and any updates made by either party are automaticall y

Page 44 of 190 ends

synchronized. As the Program Tracker is cloud -based, Routeware would not have any access to internal City databases or infrastructure. Routeware will manage a ll ongoing maintenance, updates, not the City Information Technology (IT) staff.

On February 8, 2021, the City executed the initial SaaS agreement for a one -year term length.

The City found the program beneficial, and t he City executed Amendment #1 to the initial agreement on March 30, 2022, extending the term for three years. The proposed resolutio n would authorize the city manager to execute Amendment #2, which would extend the term to use the Program Tracker software for an additional five years. A five-year commitment offers the City more favorable pricing than single or three-year terms, with th e amendment retroactively starting on May 1, 2025, and ending on April 30, 2030. The agreement would also permit five data uploads per year. No other significant changes are proposed.

Staff recommend adopting this resolution to authorize the city manager to execute Amendment #2 with Routeware, extending the agreement for five years at a cost of $185,499.81. Staff also recommend adding a 5% management reserve/contingency of $9,27 4.99 to cover potential incidentals during the term, for a total authorization amount of $194,774.80.

FINANCIAL IMPACT
The SaaS agreement with Routeware will authorize an a greement for $185,499.81 plus a 5% management reserve of $9,27 4.99. Total authorization for this amendment would be a not to exceed the amount of $194,774.80. Funding is captured through the Solid Waste Funds (Fund 156; Project 10371) via annual SB 1383 Reporting Program Cost Contributions, as specified in the City’s Franchise Agreement with Republic Services.

PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION
N/A

ALTERNATIVE ACTION
The City Council may choose not to approve the SaaS agreement amendment; however, this is not recommended, as it could impair the City’s ability to fully comply with legislative solid waste requirements, specifically SB 1383.

AGENDA REPORT
DATE: August 5, 2025

TO: Mayor and Council

FROM: David Gassaway, City Manager

SUBJECT: Resolution 2025-160 PW Community Development Block Grant for the Americans with Disabilities Act Curb Ramp Replacement Project Budget Adjustment

Authorizing an Update to the Fiscal Year 2025 -2026 Budget for the Community Development Block Grant for the Americans with Disabilities Act Curb Ramp Replacement Project

Funding Source: $15,000; Gas Tax Fund

Contact: David Vong, (707) 428-7784

RECOMMENDED ACTION
Adopt resolution.

STATEMENT OF ISSUE
The Public Works Department received a total of $150,000 from the Community Development Block Grant (CDBG) to fund the design of the Americans with Disabilities Act ( ADA) Curb Ramp Replacement Project (CPW070128), which will be implemented along various streets within the City. The Project scope includes the installation of new curb ramps, sidewalks, curb and gutter replacement, striping improvements, and additional related work. To meet grant requirements, staff have reallocated funds to support construction activities and are conducting the design work in-house. The initial funding did not include soft costs associated with implementing the construction phase. The propose d resolution authorizes a budget adjustment of $15,000 from Gas Tax Fund to the 2025-2026 Streets Capital Project Fund.

DISCUSSION
On July 2, 2024, the City Council adopted Resolution No. 2024-177, which approved the fiscal year (FY) 2024 -2025 CDBG Annual Action Plan (Action Plan) The resolution also endorsed the allocation of $150,000 for the Project's design phase. Funding for the construction phase for the project was not included in the Action Plan, as the construction will span over multiple years.

Following further discussion s and clarification with the Housing Department (CDBG Administrator), it was determined that funding for the design phase of CDBG projects is not

Page 93 of 190 ends

technically reimbursable, as no physical improvements or services have yet been provided to the community.

To ensure compliance with grant requirements, demonstrate progress, and support the timely expenditure of funds, the funding will be reallocated from design to construction. Staff promptly initiated in -house design efforts and expedited the project to facilitate bidding and award processes. As all funds were redirected toward construction, associated soft costs, such as preliminary eng ineering and public advertising, were not included in the current budget. A budget adjustment of $15,000 from the Gas Tax Fund is required to correct the reallocation budget and fund design costs.

FINANCIAL IMPACT
The funding allocated for the design wor k for FY 2025-2026 budget for $150,000 will be reallocated to the construction of the Project (CPW070128). An increase in appropriations for design for the project will require a budget adjustment of $15,000 from the Gas Tax Fund (Fund 162) to the Capital Streets Fund (Fund 252). This adjustment will not impact the progress or completion of any ongoing projects.

AGENDA REPORT
DATE: August 5, 2025

TO: Mayor and Council

FROM: David Gassaway, City Manager

SUBJECT: Resolution 2025-161 PW Donation Conveyance Agreement and Execution of Right of Entry Agreement

Authorizing the City Manager to execute a Donation Conveyance Agreement Between the City of Fairfield and Pastor Hiram Berhel and Authorizing the City Manager to Execute Right of Entry Agreements or Similar Instruments Subject to Approval (in form) from the City Attorney Related to the Construction of the East Tabor/Tolenas Safe Routes to School and Sidewalk Gap Closure Project
Funding Source: $2,000; Capital Improvement Program for Streets Fund

Contact: Phil Layoso, (707) 428-7505

RECOMMENDED ACTION
Adopt resolution.

STATEMENT OF ISSUE
To construct the necessary improvements for the East Tabor/Tolenas Safe Routes to School and Sidewalk Gap Closure Project (Project), the City will need to acquire a portion of private property, which is located at 1390 East Tabor, Avenue Assessor’s Parcel Number (APN) 170-163-010. The property owner, Pastor Hiram Berhel (Berhel) has agreed to donate a portion of his property to facilitate the construction of the Project. The resolution, if adopted, would grant the city manager the authority to execute the donation of conveyance agreement (Agreement) with Berhel.

DISCUSSION
On June 17, 2025, the City Council approved Resolution No. 2025-112 which authorizes the city manager to execute a public highway at-grade crossing and maintenance agreement with Union Pacific Railroad (UPRR) for the Project. The agreement with UPRR allows for the Project to construct an at-grade pedestrian crossing over railroad tracks and the installation of sidewalk on the north side of East Tabor Avenue . The configuration of these improvements block UPRR’s existing driveways that allow UPRR to perform maintenance on the northeast and northwest

Page 97 of 190 ends

quadrant of the railroad crossing. As the improvements are entirely within UPRR right-of-way, UPRR requires the City to make modifications to their driveways so that it can accessed by their vehicles. The driveway that gives access to the northwest quadrant of the railroad crossing requires 35’ of mountable curbs to be installed at this location.

The northeast driveway is adjacent to a private property located at 1390 East Tabor Avenue, which is owned by Berhel . Currently, the existing driveway is accessible to UPRR’s work trucks without encroaching onto Berhel’s property. As the Project progresses with improvements, UPRR’s work trucks will not be able to use the driveway without encroaching onto Berhel’s property.

To address the issue, the City intends to modify the existing driveway by installing 35’ mountable curb. To proceed with these modifications, the City must acquire approximately 250 square feet of property from Berhel. This portion of land will also serve as the primary driveway for Berhel’s property.

The acquisition of approximately 250 square feet of property will require full closure of the Berhel’s primary driveway. In response, the City will construct a new driveway entrance at the intersection of East Tabor Avenue and Olive Avenue to maintain site access. As the new driveway does not directly connect to the existing parking lot, the City will also make site improvements to provide emergency-compliant access and restore full parking functionality.

City staff has met with Berhel and his team on multiple occasions to discuss the impacts and proposed solutions. In recognition of the City’s commitment to installing an im proved, code - compliant driveway and parking layout, Berhel has agreed to donate the required portion of his property to facilitate the project.

The proposed resolution authorizes the city manager to execute the donation conveyance agreement, and right of entry agreements, or similar instruments related to the Project. The city manager’s authority would only be exercised after the agreements and other documents are approved as to form by the city attorney.

FINANCIAL IMPACT
The City has agreed to cover the escrow and recording costs for executing the Agreement. Staff estimate these costs will total approximately $2,000. Funds are budgeted in the adopted fiscal year (FY) 2025-2026 through FY 2029-2030 Capital Improvement Program for Streets (Fund 252, CPW070008).

Accepting the Canon Station Planning Area 4 – Lake Trail Park as Complete

Funding Source: N/A

Contact: Roger Dunham, (707) 428-7478

RECOMMENDED ACTION
Adopt resolution.

STATEMENT OF ISSUE
The adoption of the resolution accepts the Canon Station Planning Area 4 – Lake Trail Park (Lake Trail Park) as complete.

DISCUSSION
One Lake, LLC (Developer) has completed all the required improvements for the construction of Lake Trail Park in accordance with the improvement agreement approved by City Council on March 15, 2022, by Resolution No. 2022-47.

Lake Trail Park , located to the west of Lake Park, includes over three acres of full landscape improvements, a pollinator garden, a 10’ wide all weather pedestrian trail, pathway lights and play equipment area. Lake Trail Park is directly adjacent to multiple residential subdivisions, offering convenient access to park amenities for the approximately 228 future residents that will reside in the area. Additionally, Lake Trail Park includes a pedestrian trail that links nearby neighborhoods to the existing Lake Park and the Lakehouse Clubhouse, which is partially completed and operational, though the rear section is still under construction. Lake Trail Park also provides direct access to Lake Club Drive, which the Train Station Specific Plan identifies as a major roadway that will accommodate vehicle, bicycle, and pedestrian access across several planning areas.

Page 131 of 190 ends

Construction of Lake Trail Park began on May 23, 2022. There was one added delay , as the architect submitted a revised se t of plans on March 1, 2024, to include the areas between the sidewalk and curb , which were missed in the original set of plans. The construction was completed in June 2025.

Staff has inspected the improvements and found them to be complete in accordance with City standards and the requirements of the improvement agreement. The proposed resolution accepts the improvements as being complete, except for the obligation of the Developer to repair or reconstruct defective work for a period of one year after final acceptance.

FINANCIAL IMPACT
The Homeowner’s Association (HOA) will maintain public improvements with a portion of the maintenance costs being funded by the Train Station Specific Plan Community Facilities District (CFD #2018-1). The Developer shall maintain public improvements until the HOA has collected adequate funding.

Pursuant to Section 4 of the Maintenance, Access Easement, Reimbursement and Lease Agreement (MARLA) that was executed between the Developer and the City and recorded by Solano County on November 14, 2019, the City’s maintenance cost contribution shall not exceed the lesser of (a) 22% of the Development Agreement Service Cost or (b) $165,7234 per year, escalated to the year end.

Resolution 2025-163 Authorizing the City Manager to Suspend Competitive Bidding and Purchase Electrical Infrastructure Related to the Fairfield Corporation Yard Fleet Electrification Project; and

RECOMMENDED ACTION
Adopt resolutions.

STATEMENT OF ISSUE
To ensure compliance with the California Air Resource Board’s mandate for zero-emission government fleets by 2040, the City of Fairfield has initiated the Fairfield Electrification at the Corporation Yard Project (Project). This facility will support the first phase of electric vehicle charging infrastructure. Pacific Gas & Electric (PG&E) must design and construct necessary power upgrades to support the City’s oper ational needs. PG&E’s design work can only begin once specific electrical equipment – specifically the transformer, switchboard, and bu s duct are selected. To avoid potential delays caused by long lead times , the c ity staff recommend purchasing this equipment through Sourcewell to avoid significant project delays.

As PG&E will install and maintain their infrastructure on City property, a separate resolution will authorize the city manager to grant an easement to PG&E to facilitate ongoing access and maintenance.

Page 134 of 190 ends

DISCUSSION
To support the operation of future electric vehicle chargers, improvements are required to both behind-the-meter (BTM) and to -the-meter (TTM) electrical infrastructure BTM improvements, including the transformer, switchboard, and bus duct, will be installed, owned and maintained by the City, while TTM improvements will be installed and owned by PG&E. Since the TTM design depends on the specified BTM equipment, the city staff has proactively coordinated with PG& E for the past 6 months to identify and gain approval for the equipment to avoid project delays.

The City participates in a cooperative purchasing agreement with Sourcewell, a government agency that conducts competitive procurement processes on behalf of o ther government agencies nationwide. To ensure timely delivery and cost efficiency, the City proposes purchasing the approved equipment for $301,55 3.44 through Wesco (Vendor), utilizing the competitively awarded Sourcewell Contract (091422-WES). This cooperative purchasing agreement gives the City access to prequalified vendors and service providers and Sourcewell’s national competitive pricing structure. The vendor is a reputable provider of electrical solutions with proven experience in supporting municipal fleet electrification projects. Purchasing through Sourcewell’s pricing structure will save the City approximately $20,000 compared to advertising the procurement per cross comparison.

Staff are requesting that the City Council adopt the resolution to suspend competitive bidding and authorize the purchase of the BTM equipment from the Vendor for $301,553.44 which includes the equipment, delivery, and sales tax. The equipment will be installed by the general contractor for the Project and construction for the Project is anticipated to start in Spring 2026.

As PG&E will install and maintain the TTM improvements, PG&E is requesting that the City grant a 30-foot by 30-foot easement at the Corporation Yard located at 420 Gregory Lane (APN 0031- 182-400). The easement will be located within the employee parking lot of the Corporation Yard.

The proposed resolution authorizes the city manager to execute the easement deed. As this Project is a part of the PG&E fleet readiness program, the design and construction of the TTM improvements will be at no cost to the City.

FINANCIAL IMPACT
The total cost for the purchase of the BTM equipment is $301,553.44 plus a 10% contingency of $30,155.34 for a total authorization for this purchase of $331,708.78. Funding for this equipment purchase is captured in the Fixed Route Capital Fund (Fund 451; CPW080104). The expense will be paid for utilizing Transportation Development Act (TDA) local funds and Low Carbon Transit Operations Program state grant funds (LCTOP).

There is no financial impact for approving the conveyance of an easement to PG&E.

PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION
N/A

Page 135 of 190 ends

ALTERNATIVE ACTION
The procurement of the equipment can be assigned as the contractor’s responsibility. This would require the contractor to go through the review and approval process from PG&E. This review process can take approximately 6 months, and it may potentially require the City to revise the Project design. Additionally, the BTM infrastructure has a lead time of 32 weeks which means that after the award of the Project, the City will experience a one-year delay. Staff do not recommend this course of action as this could cause a significant delay.

GRANT OF EASEMENT DISCLOSURE STATEMENT

This Disclosure Statement will assist you in evaluating the request for granting an easement to Pacific Gas and Electric Company (PG&E) to accommodate a utility service extension to PG&E’s applicant. Please read this disclosure carefully before signing the Grant of Easement.

• You are under no obligation or threat of condemnation by PG&E to grant this easement.

• The granting of this easement is an accommodation to PG&E’s applicant requesting the extension of PG&E utility facilities to the applicant’s property or project. Because this easement is an accommodation for a service extension to a single customer or group of customers, PG&E is not authorized to purchase any such easement.

• By granting this easement to PG&E, the easement area may be used to serve additional customers in the area and may be used to install additional utility facilities. Installation of any proposed facilities outside of this easement area will require an additional easement.

• Removal and/or pruning of trees or other vegetation on your property may be necessary for the installation of PG&E facilities. You have the option of having PG&E’s contractors perform this work on your property, if available, or granting permission to PG& E’s applicant or the applicant’s contractor to perform this work.

Additionally, in order to comply with California fire laws and safety orders, PG&E or its contractors will periodically perform vegetation maintenance activities on your property as provide d for in this grant of easement in order to maintain proper clearances from energized electric lines or other facilities.

• The description of the easement location where PG&E utility facilities are to be installed across your property must be satisfactory to you.

• The California Public Utilities Commission has authorized PG&E’s applicant to perform the installation of certain utility facilities for utility service. In addition to granting this easement to PG&E, your consent may be requested by the applicant, or app licant’s contractor, to work on your property. Upon completion of the applicant’s installation, the utility facilities will be inspected by PG&E. When the facility installation is determined to be acceptable the facilities will be conveyed to PG&E by its applicant.

By signing the Grant of Easement, you are acknowledging that you have read this disclosure and understand that you are voluntarily granting the easement to PG&E. Please return the signed and notarized Grant of Easement with this Disclosure Statement attached to PG&E. The duplicate copy of the Grant of Easement and this Disclosure Statement is for your records.

AGENDA REPORT
DATE: August 5, 2025

TO: Mayor and Council

FROM: David Gassaway, City Manager

SUBJECT: Ordinance 2025-06 CD Vista Ridge Zone Change

Amending Chapter 25 of the Fairfield City Code, Article I, Section 25.12.3, also Known as the City of Fairfield Zoning Map to Redesignate the Zoning of 3331 North Texas Street (Assessor’s Parcel Number 0167-130-240) from Regional Commercial to Mixed Commercial Consistent with the Fairfield General Plan

Funding Source: N/A

Contact: Yee-Lynn Wong, (707) 428-7449

RECOMMENDED ACTION
Provide second reading and adopt Ordinance 2025-06.

STATEMENT OF ISSUE
Cameron Dart of Danco Group requests a Zone Change from Regional Commercial (CR) to Mixed Commercial (CM) to support the development of a permanent supportive housing project, consisting of converting an existing hotel into housing units, at 3331 N Texas Street ( Assessor’s Parcel Number [APN]: 0167-130-240).

DISCUSSION
On June 25, 2025, the Planning Commission adopted Resolution PC2025-3 recommending council approve the Zone Change (ZC2025 -004) from Regional Commercial (CR) to Mixed Commercial (CM) on a 1.5-acre site at 3331 N Texas Street (APN: 0167-130-240). On July 15, 2025, the Council approved the first reading of the proposed ordinance with a 4-2-1 vote.

The applicant is working with the Housing Services Department on a project funded through the HomeKey+ Program, which is administered by the California Department of Housin g and Community Development (HCD). The HomeKey+ proposal involves converting an existing three- story hotel into permanent supportive housing units. The target population for the housing

Page 177 of 190 ends

project includes unhoused individuals experiencing behavioral or mental health challenges, as well as veterans.

Under the project site’s current CR zoning designation, residential land uses are not permitted.

The proposed Zone Change from CR to CM will support the HomeKey+ Program project by allowing residential land uses at the project site. This Zone Change does not include any physical changes to the site or building. A separate entitlement application for physical improvements will be submitted to the Community Development Department for review and approval at a future date.

The proposed Zone Change is consistent with the site’s Highway and Regional Commercial General Plan designation in that the CM Zoning District allows for a broader range of permi tted land uses, including many of the commercial and retail land uses currently permitted in the CR zoning district, with the addition of residential land uses. Furthermore, the land use change would support the following General Plan objectives and policies:

Housing Element Goal A-4:

Encourage infill development

Housing Element Goal A-5:

Facilitate a mix of affordability levels in residential projects

Housing Element Goal D-3:

Facilitate the development of transitional and supportive housing to meet the needs of unhoused residents

Housing Element Goal D-6
Ensure that new residential developments include housing accessible to persons with disabilities and others with physical conditions

Objective LU-1.2
Provide a variety of land uses throughout the city that fosters the development of a balanced community and adequate housing

Objective LU-2.1
Require residential development to be consistent with the density ranges included in the General Plan

Objective LU-2.2
Promote the development of a greater variet y of housing types and sizes in existing neighborhoods

FINANCIAL IMPACT
N/A

Page 178 of 190 ends

PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION
The Planning Division published a public hearing notice in the Daily Republic newspaper and mailed to all property owners within 500 feet of the project site for both the Planning Commission meeting of June 11, 2025, which was continued to June 25, 2025, and the council meeting of July 15, 2025. The Planning Commission passed Resolution PC2025 -3, recommending the council approve the zon e change. The council held a public hearing for the item on July 15, 2025, and moved to approve the item. Three emails opposing the zone change were sent to the council on July 15, 2025. As of the writing of this staff report, the staff has not received a ny subsequent correspondence on the project.

ALTERNATIVE ACTION
The council may choose to deny any or all the requests and not adopt the proposed ordinance.

In this case, the proposed Zone Change would not occur, and the Homekey+ permanent supportive housing project would not be able to proceed.

THE CITY COUNCIL OF THE CITY OF FAIRFIELD DOES ORDAIN AS FOLLOWS:

SECTION 1. Statement of Intent

The City of Fairfield has adopted a Zoning Map to address development consistent with the Fairfield General Plan and City Policy.

On April 7, 2025, Cameron Dart of Danco Group applied for a Zone Change for the subject property from CR to CM and an Environmental Review. The zone change will permit residential land uses at the subject property and help facilitate the permanent supportive housing project.

On June 25, 2025, the Planning Commission was presented with the revisions to the Zoning Map contained herein and, after holding a duly noticed public hearing, voted to recommend that the City Council approve the proposed revision.

The proposed Zoning Map changes would not be detrimental to the public interest, health, safety, convenience, or welfare of the city; and

Land uses under the CM zoning regulations are all compatible with the surrounding and existing commercial uses. Any anticipated development on the site permitted by the CM zone is physically suitable (including, but not limited to access, provision of utilities, compatibility with adjoining land uses, and absence of physical constraints); and

The proposed Zoning Map change is in compliance with the provisions of the California Environmental Quality Act (CEQA). Based on the information presented by staff, the Planning Commission has determined that the proposed amendment to the text of the Zoning Ordinance is exempt from CEQA review under Section 15061(b)(3): Common Sense Exempti on. Land uses permitted in the proposed CM zoning are similar to the permitted uses in the CR District. Environmental impacts from any specific proposed development on the property will be evaluated at the time a proposal is considered by the City.

SECTION 3. This Ordinance shall be effective 30 days following its adoption by the City Council. A summary of this Ordinance shall, within fifteen (15) days after passage, be published in accordance with Section 36933 of the Government Code of the State of California with the names of the City Councilmembers voting for and against it.
