RESOLUTION NO. 2025-161
AUTHORIZING THE CITY MANAGER TO EXECUTE A DONATION CONVEYANCE AGREEMENT
BETWEEN THE CITY OF FAIRFIELD AND PASTOR HIRAM BERHEL AND AUTHORIZING THE CITY
MANAGER TO EXECUTE THE RIGHT OF ENTRY AGREEMENTS OR SIMILAR INSTRUMENTS
SUBJECT TO APPROVAL (IN FORM) FROM THE CITY ATTORNEY RELATED TO THE
CONSTRUCTION OF THE EAST TABOR/TOLENAS SAFE ROUTES TO SCHOOL AND SIDEWALK
GAP CLOSURE PROJECT
WHEREAS, the City of Fairfield intends to construct the East Tabor/Tolenas Safe Routes to School and Sidewalk Gap Closure Project (Project); and
WHEREAS, a portion of the proposed improvements are located within 1390 East Tabor Avenue (APN: 170-163-010) owned by Pastor Hiram Berhel (Berhel); and
WHEREAS, the City desires to enter into a Donation Conveyance Agreement with Berhel; and
WHEREAS, the City of Fairfield intends to construct the East Tabor/Tolenas Safe Routes to School and Sidewalk Gap Closure Project; and
WHEREAS, the City may also need to enter into a right of entry agreements or similar instruments related to the Project; and
WHEREAS, the city manager will have authorization to execute the right of entry agreement subject to approval (in form) from the city attorney related to the Project.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FAIRFIELD HEREBY RESOLVES:
Section 1. The city manager is hereby authorized to sign the Donation Conveyance Agreement on behalf of the City of Fairfield and to execute any additional forms as necessary to implement the agreement.
Section 2. The city manager is hereby authorized to execute the right of entry agreements or similar instruments subject to approval (in form) from the city attorney related to the Project.
Section 3. The city manager is hereby authorized to do all things necessary to implement the above-mentioned agreements.
