STATEMENT OF ISSUE
The Human Resources (HR) Department seeks approval to amend its current Professional Services Agreement with Bertrand , Fox, Elliot, Osman, & Wenzel , LLP (BFEOW) for legal representation in the City’s Public Safety personnel, disciplinary, and employment matters by increasing the not-to-exceed amount.

DISCUSSION
Bertrand, Fox, Elliot, Osman, & Wenzel, LLP (BFEOW) has a long history of representing municipal agencies in Solano County and possesses expertise in public safety personnel matters and litigation areas that are beneficial to the City of Fairfield. BFEOW is regarded as an expert in this highly specialized field, and their on-going counsel is an asset to protecting the City’s interests.

Since 2017, the Police Department has retained BFEOW for repres entation in personnel investigations, disciplinary matters and litigations. Recently, the Fire Department has also begun using them for personnel matters.

The City of Fairfield entered into a one-year agreement with BFEOW on July 1, 2024, with an end date of June 30, 2025, and a not -to-exceed amount of $100,000. On July 25, 2025, Amendment No. 1 extended the terms of the contract to December 31, 2025, but did not increase the not-to-

exceed as funds were still available on the current contract. As the need for these services continues, the Human Resources Department requests approval of Amendment No. 2 to increase the not-to-exceed amount by $100,000.

FINANCIAL IMPACT
The amount of the proposed amendment is $100,000. The funds for this amendment are accounted for in the General Fund (10150101-8902 & 10155100-8902).
