RECOMMENDED ACTION
Adopt resolution.
STATEMENT OF ISSUE
All recipients of Federal Transit Administration (FTA) funds and contractors of those recipients are required to implement and maintain an FTA compliant drug and alcohol policy for all safety - sensitive employees. The City of Fairfield receives funding directly from FTA and as a subrecipient from other agencies, such as the California Department of Transportation. The proposed resolution adopts the City of Fairfield ’s updated FTA Drug and Alcohol Policy (Policy) in accordance with recent changes to FTA drug and alcohol testing regulations.
DISCUSSION
The Omnibus Transportation Employee Testing Act of 1991 mandates that the Secretary of Transportation issue regulatory requirements that prohibit the misuse of drug and alcohol within the transportation industry. The FTA is delegated the authority to implement these rules within the transit agency to prevent accidents, injuries, of fatalities related to the misuse of alcohol and use of prohibited drugs by employees who perform safety -sensitive functions, as defined in 49 Code of Federal Regulations (CFR) Part 655.
As the City receives operational and capital funding from the FTA to support the operation of FAST services and various transit -related capital projects, the City is required to maintain an
updated drug and alcohol policy that is compliant with the most up-to-date FTA drug and alcohol testing regulations. The proposed Policy provides updates in accordance with the most recent requirements adopted by FTA.
The proposed Policy update removes language that identifies urine testing as the sole drug testing collection method , which enables use of the temporary oral fluid testing option in accordance with changes adopted by the FTA. The update also modifies the format of the Policy utilizing an FTA-approved policy builder to en sure the City’s Policy remains compliant with all other FTA drug and alcohol testing requirements.
