AMENDMENT NO. 2 TO THE PROFESSIONAL SERVICES AGREEMENT FOR ENGINEERING DESIGN SERVICES FOR FISCAL YEARS 2024 AND 2025 CAPITAL IMPROVEMENT PROJECTS BETWEEN THE CITY OF FAIRFIELD AND NICHOLS CONSULTING ENGINEERS, CHTD. (NCE)
On February 26, 202 4, the City of Fairfield, a municipal corporation, hereinafter referred to as “CITY,” and Nichols Consulting Engineers, Chtd, hereinafter referred to as “CONSULTANT,” entered into an agreement for professional design services for fiscal years 2024 and 2025 capital improvement projects.
Based upon the revised scope of work and need for continued work outside the term of the agreement, the CITY and CONSULTANT do hereby agree to amend the existing PROFESSIONAL SERVICES AGREEEMENT as follows:
WITNESSETH:
WHEREAS, CITY desires to contract for certain consulting design work necessary for the preparation of construction documents and provide construction assistance support for fiscal years 2024 and 2025 capital improvement projects, and for the purposes of the Agreement shall be called “PROJECTS;” and
WHEREAS, the CONSULTANT is providing design services for fiscal years 20 24 and 2025 capital improvement projects; and
WHEREAS, Amendment No. 1 extended the terms of the PSA through June 30, 2027; and
WHEREAS, CONSULTANT is willing and qualified to provide design services for the PROJECTS; and
WHEREAS, Amendment No. 2 will increase total PSA authorization by $ 169,800 to provide engineering design services.
NOW, THEREFORE, in consideration of the mutual promises, covenants and agreements herein set forth, the parties do hereby agree as follows:
EXHIBIT “A”, Project Table, shall be amended to the following:

EXHIBIT “B”, Section 1 of the AGREEMENT, shall be amended to the following:
The total contract price for services rendered by the CONSULTANT under this Agreement shall not exceed $569,800, or as amended, in accordance with the hour rates specified on the following page. Each January 1 st of subsequent years, the CONSULTANT’S rates shall not exceed the most current available increase in the Consumer Price Index. The term “Consumer Price Index” means the average of the percent change in Consumer Price Index for Urban Wage Earners and Clerical Workers, as reported by the Bureau of Labor Statistics or successor agency , from the October preceding the annual contract adjustment over the preceding October, for the San Francisco Bay Area, the Western Urban Region, and the U.S. Cities indices.
