CITY OF FAIRFIELD
RESOLUTION NO. 2025-183
AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 1 TO THE AGREEMENT BETWEEN THE CITY OF FAIRFIELD AND ONYX DEVELOPMENT GROUP LLC.
WHEREAS, on August 20, 2024, the City Council adopted Resolution 2024-213 authorizing the city manager to execute a Solar Power Purchase Agreement (Solar PPA) with Onyx Development Group LLC. (Onyx) to design, build, and operate a solar field at the Waterman Water Treatment Plant (WTP); and
WHEREAS, various technical, operational, and environmental modifications have developed during the design-build process; and
WHEREAS, City staff is seeking to amend the Solar PPA to conform to the necessary modifications and ensure the agreement remains aligned with the c hanging conditions of the design -build process.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FAIRFIELD HEREBY RESOLVES:
Section 1. The city manager is hereby authorized and directed to execute on behalf of the City of Fairfield Amendment No. 1 between the City of Fairfield and Onyx Development Group LLC.
Section 2. The city manager or designee is hereby authorized to do all things necessary to implement the above-mentioned amendment.
