CITY OF FAIRFIELD
RESOLUTION NO. 2025-190
AUTHORIZING EXECUTION OF THE AGREEMENT PURSUANT TO GOVERNMENT CODE SECTION 66462.5 FOR ACQUISITION OF STREET A AND PEABODY ROAD RIGHTS-OF-WAY
WHEREAS, the Planning Commission of the City of Fairfield reviewed and approved the entitlements for both the “Master Planned Unit Development – Planning Area 1” and the “Aviatrix” development with adoption of Resolution s No. PC 2023-01 and No. PC2024-01, respectively; and
WHEREAS, the developer, Republic Urban Properties, is required to construct public roadways commonly referred to as Street A and Peabody Road as a condition of their development; and
WHEREAS, the necessary rights-of-way for these public improvements are generally located on land owned by James A. Ewing, Trustee of the Velma J. Ewing Trust (Assessor’s Parcel Number:
0166-110-390); and
WHEREAS, the City desires to acquire the necessary land in accordance with Government Code Section 66462.5 to construct these right-of-way improvements; and
WHEREAS, the developer is responsible for reimbursing the City for all costs incurred in the acquisition of this property.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FAIRFIELD HEREBY RESOLVES:
Section 1. The mayor of the City of Fairfield is authorized and directed to execute that certain agreement entitled “Agreement Pursuant to Government Code Section 66462.5 Between Republic Fairfield LLC and City of Fairfield for Acquisition of Ce rtain Real Property Interests (Aviatrix Development Public Street Infrastructure – Street A and Peabody Road).”
Section 2. The public works director is authorized and directed to do all things necessary and proper to implement the above-mentioned agreement.
