STATEMENT OF ISSUE
Staff are recommending the City enter into the First Amendment to the Lease Agreement (First Amendment) with Solano County Special Education Local Plan Area (SELPA) for the purpose of modifying certain terms of SELPA’s existing lease agreement located at 3305 Cherry Hills Court.

DISCUSSION
The City and SELPA entered into the Lease Agreement dated November 19, 2020 (Lease) for the purpose of operating and administering programs and services for individuals with special needs at 3305 Cherry Hills Court (Property).

The Lease is set to expire on November 19, 2025, and SELPA has requested to extend the Lease for an additional twelve months with an option to purchase the Property at the end of the extension. Staff completed the Surplus Land Act process and received approval from the California Department of Housing and Community Development (HCD) to dispose of the Property to SELPA.

In addition to the lease term and option to purchase, SELPA also agreed to begin paying all the utilities for the Property effective November 19, 2025.

Both the City and SELPA would like to enter into the proposed First Amendment to modify the terms of the Lease.
