RECOMMENDED ACTION
Adopt resolution.

STATEMENT OF ISSUE
ADS West, LLC (ADS West) constructed a Zone II pump station and wishes to grant improvements and land to the City of Fairfield. The improvements are on land currently owned by ADS West located on Yarrow Drive, more commonly known as Assessor Parcel Number 0180 -401-060 (Property). The recommended action authorizes the city manager to execute the grant deed and accept the land.

DISCUSSION
ADS West, a subsidiary of Albert D. Seeno Construction Company, Inc. (Developer), is the owner of the Property located on Yarrow Drive within the Enclave subdivision. On May 17, 2022, the City Council adopted Resolution No. 2022-92 authorizing an improvement agreement for the Red Top Zone II Pump Station Improvements. Pursuant to Section 3(f) of the Restated and Amended Development Agreement No. 2014-1 (DA) executed by the City and the Developer, the Developer is required to design and construct a Zone II hydro-pneumatic pump station. This Zone II water pump station is necessary to provide water service to current and future developments along Red Top Road, including the enclave subdivision. ADS West has constructed and completed the

pump station improvements and is prepared to grant improvements to the City of Fairfield. Prior to the City’s acceptance of such improvements, ADS West must grant the Property to the City.

FINANCIAL IMPACT
There is no cost to the City for the transfer of the Property. However, acceptance of the parcel by council will obligate the City to maintain the existing property. Maintenance costs shall be funded by the Water Fund.
