RECOMMENDED ACTION
Adopt resolution.

STATEMENT OF ISSUE
Adoption of the resolution will formally accept the subdivision improvements for the Red Top – Unit 3 Subdivision (Subdivision) as complete.

DISCUSSION
Albert D. Seeno Construction Company, LLP (Developer) has completed all the required improvements for the Subdivision in accordance with the subdivision improvement agreement adopted by the City Council on February 4, 2025, by Resolution No. 2025 -23. The Subdivision consists of 15 single -family residential lots located on the south side of Red Top Road near Interstate 80.

Staff have inspected the subdivision improvements and found them to be complete in accordance with City standards and the requirements of the subdivision improvement agreement. The final punch list was completed on September 16, 2025. The proposed resolution accepts the subdivision improvements as being complete, except for the obligation of the Developer to repair or reconstruct defective work for a period of one year after the final acceptance.

FINANCIAL IMPACT
Acceptance of the public improvements by the council will obligate the City to maintain the public improvements, including Trillium Court, public water, sewer, and storm utilities within the public right-of-way. Ongoing maintenance for the public improvements will be funded by the City’s General Fund. The subdivision is annexed into the City’s Community facilities District 2012-2 (CFD 2012-2) and Lighting and Landscape Maintenance District No. 16 (LLMD No. 16) which will provide funding to maintain the public landscape and irrigation along Red Top Road.
