RECOMMENDED ACTION
Adopt resolution.

STATEMENT OF ISSUE
The City of Fairfield has secured $234,710 in Transportation Development Act (TDA) Article 3 Local Transportation Funds under Public Utilities Code (PUC) Section 99233.3, which provides funding for pedestrian and bicycle projects. These funds will support the construction phase of the East Tabor Avenue/Tolenas Avenue Safe Routes to School and Sidewalk Gap Closure Project (Project). Adoption of the proposed resolution is required to support the City’s allocation request to the Metropolitan Transportation Commission (MTC).

DISCUSSION
The TDA was developed by Caltrans to improve public transportation services and coordinate regional transportation. The TDA was signed into California law on November 4, 1971, and went into effect on July 1, 1972. This law provides funding to be allocated to transit and non -transit related purposes that comply with regional transportation plans.

The Project was identified by the Solano Transportation Agency (STA) as eligible to receive TDA Article 3 funding in the amount of $234,710. The Project would close an existing sidewalk gap on East Tabor Avenue that crosses Union Pacific Railroad (UPRR), widen sidewalk on Tolenas Avenue, and provide safety improvements to bicycle and pedestrian users. To receive TDA Article 3 funds, the City is required to approve the Findings to the Metropolitan Transportation Commission (MTC), as outlined in Exhibit A, along with the corresponding resolution. In addition, a formal funding request and project application must be submitted, as shown in Exhibit B.

On June 17, 2025, City Council adopted Resolution No. 2025 -112, executing Public Highway At- Grade Crossing Agreement with UPRR and receiving construction authorization from the California Public Utilities Commission (CPUC) on September 23, 2025. Prior to advertising the Project, staff must secure right-of-way certification and construction authorization from Caltrans, which are anticipated by the end of 2025. This would allow the Project to be advertised in early 2026, with construction scheduled for summer 2026 to minimize impacts on nearby schools.

Funding for the remaining construction costs were not included in the FY 2025 -2026 Capita l Improvement Budget for the East Tabor Avenue/Tolenas Avenue Safe Routes to School and Sidewalk Gap Closure Project (CPW070008). A budget adjustment of $234,710 to include TDA 3 funds and increase appropriations to the construction expenses is required.

FINANCIAL IMPACT
The City will receive TDA funds from STA in the amount of $234,710 for construction costs that will be incurred for the project (CPW070008) in fiscal year (FY) 2025-2026 and FY 2026-2027. An increase in appropriations for construction for the project will require a budget adjustment of $234,710 funded by TDA Article 3 funds. There is no local match for the TDA funds.

PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION
On June 13, 2025, STA staff recommended to the STA Board that the Project receive TDA funding in the amount of $234,710. The STA Board approved this request on June 25, 2025.

ALTERNATIVE ACTION
The council may choose not to approve this request, but this is not recommended as this would mean the City would not receive the funding from MTC.
